As federal district courts and courts of appeals attempt to apply the Supreme Court’s dictates in Universal Health Services, Inc. v. U.S. ex rel. Escobar, it is necessary to ask whether the Court succeeded in easing the complexity of this aspect of the Federal Claims Act (FCA). Have lower courts been able to consistently apply the new standards to assess materiality? Or, has the opinion, which arguably both broadened and narrowed application of the implied false certificate theory and when liability might attach, further muddied the waters for courts and parties attempting to determine whether behavior is of the sort …

There is a big gulf between GIScience as an academic endeavor and its application in the form of GIS project management in the real world. Project activities are complex because they rarely involve routine repetitive acts, but often require specific knowledge and skills to be used in their design, execution, and management. This article explains what project management is, its objectives, and the required ingredients from personnel to budgets, and the integration of the GIS project into the larger context of an organization’s and even societal culture.

Maximal repetitions or runs in strings have a wide array of applications and thus have been extensively studied. In this paper, we extend this notion to 2-dimensions, precisely defining a maximal 2D repetition. We provide initial bounds on the number of maximal 2D repetitions that can occur in a matrix. The main contribution of this paper is the presentation of the first algorithm for locating all maximal 2D repetitions in a matrix. The algorithm is efficient and straightforward, with runtime O(n^2 log n log log n+ rho log n), where n^2 is the size of the input, and rho is …

Every year, Congress gives hundreds of specific directions to agencies through legislative history. Amidst debates about how agencies use legislative history as an interpretive tool to implement directives contained in statutory text, there is little analysis on how agencies respond to directives contained in the legislative history itself. How agencies respond to directives in legislative history, such as committee reports, provides important information about interactions between agencies and Congress. This Article explores how congressional committees leverage legislative history to direct agency action by studying instructions to the Food and Drug Administration (FDA) in appropriations committee reports. Inclusive higher education is elusive for students with disabilities, especially in developing countries. The adoption and rapid ratification of the Convention on the Rights of Persons with Disabilities (CRPD) provides, if applied as its drafters intended, a “whole of institution” framework for its realization (CRPD Committee, 2016). Myriad legal, attitudinal, physical, and communication-based barriers limit or exclude participation. The individual impact of such discrimination is clear and carries lifelong consequences. Equally endemic are the broad societal and pedagogical effects of this exclusion. While the right to express one’s opinions has become increasingly problematic in society at large, it is particularly imperiled in the very places that pride themselves as being open marketplaces of ideas – on college and university campuses.

The anti-death penalty movement is rooted in the Enlightenment, dating back to the publication of the Italian philosopher Cesare Beccaria’s treatise, Dei delitti e delle pene (1764). That book, later translated into English as An Essay on Crimes and Punishments (1767), has inspired anti-death penalty advocacy for more than 250 years. This Article traces the development of the abolitionist movement since Beccaria’s time. In particular, it highlights how the debate over capital punishment has shifted from one focused primarily on the severity of monarchical punishments, to deterrence, to one framed by the concept of universal human rights, including the right …

Donald Trump ascended to the presidency largely on the promise to protect the American people—their physical and financial security, their culture and language, even the integrity of their electoral system—against an invading foreign menace. Only extraordinary defensive measures, including “extreme vetting” of would-be immigrants, a ban on Muslims entering the United States, and a 2,000-mile-long wall along the nation’s southern border could repel the encroaching hordes. If candidate Trump’s scapegoating of unauthorized migrants and refugees was disarmingly effective, it was also eerily familiar to those of us who study the history of immigration law and policy. From secret stingray devices that can pinpoint a suspect’s location, to advanced forensic DNA-analysis tools, to recidivism risk statistic software—the use of privately developed criminal justice technologies is growing. So too is a concomitant pattern of trade secret assertion surrounding these technologies. This Article charts the role of private law secrecy in shielding criminal justice activities, demonstrating that such secrecy is pervasive, problematic, and ultimately unnecessary for the production of well-designed criminal justice tools. This Article makes three contributions to the existing literature. Recent scandals involving national governing bodies for sport and allegations of athlete abuse have captured media attention. The most recent, focusing on the actions of USA Gymnastics, prompted Congress to propose legislation to require better protections for Olympic Movement athletes. Signed into law on February 14, 2018, the Protecting Young Victims from Sexual Abuse and Safe Sport Authorization Act of 2017 designates the United States Center for SafeSport (SafeSport) as the independent organization charged with exercising jurisdiction over the United States Olympic Committee (USOC) and sport national governing bodies to safeguard amateur athletes against all forms of abuse. We investigated the hypothesis that environmental factors affect interaction network structure by influencing the functional diversity of ecological communities. Notably, we expect more functionally diverse communities to form interaction networks with a higher degree of niche partitioning. Location: Americas. Time period: Current. ObjectivesHead injury is a common reason for emergency department (ED) attendance. Around 1% of patients have life-threatening injuries, while 80% of patients are discharged. This review paper critically examines four “constructive tensions” in current resilience research, the first three of which are: its association with the roots of the resilience concept in ecological research; issues surrounding resilience as a normative or neutral concept; and confusion about the often interchangeable use of “resilience” and “sustainability” as possibly synonymous terms. The paper refers to these ambiguities as constructive tensions which have sparked fruitful discussions and debates. The methods described in this chapter cover the cohort data collection, which constituted the common data set for all three studies reported in this paper. A sample of 430 bilingual toddlers, learning British English and one of 13 target Additional Languages (N = 372), or any other Additional Language (N = 58), were identified over a 2-year period. In an effort to encourage men with experience of being subject to the criminal justice system to contribute to focus group discussions on the sensitive topic of mental health, while also doing our utmost to protect them from discomfort or risk of exploitation, we used a novel technique involving the creation of a fictional character, supplemented by an audio-recorded vignette. This paper considers two methods for determining the local wave particle kinematics and hydrodynamic forces on an idealised wind turbine monopile in the southern North Sea using sea-state data from Teesside Offshore Wind Farm. An assessment of local flow hydrodynamics is important with regard to safe access of personnel from a crew transfer vessel to a monopile. The hydrodynamic behaviour was calculated using an analytical solution from linear diffraction theory and numerical predictions using OpenFoam, with both slip and no-slip cylinder boundary conditions. Human neurodegenerative disease are currently difficult to model in rodents and only a handful of transgenic mice show a phenotype related to the human disease. This is most likely due to several reasons such as restricted life expectation of rodents, restricted environmental influences in the holding cages and slightly different gene and protein sequences. Western New England’s Mini-Law School Program increases civic engagement and awareness and provides opportunities for law schools and educators to help non-lawyers better understand the legal system. This article will discuss the Mini-Law School Program, a creative and extremely successful five-week community outreach program focused on demystifying the law. The 2005 amendments to the Bankruptcy Code, Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA) was enacted in order to improve bankruptcy law. However, BAPCPA has made the issue of whether late-filed taxes are dischargeable even murkier than before the amendments. After BAPCPA, some courts continued to analyze claims as they had before the amendment. Others used a “one-day-late rule” that prevented late-filed taxes from being dischargeable—even if the taxes were filed only one day late. This Article suggests a different approach. It argues that the legislature intended tax debt associated with late-filed income tax returns be dischargeable if the …

The brutalization of Black people at the hands of the police is not new, but many are being introduced to the concept of police brutality through the channels of social media. Diapause Disruption In Cirina Butyrospermi Vuillet (Lepidoptera, Attacidae), The Shea Caterpillar, In Burkina Faso, H. B. Bama, R. A. Dabire, D. Ouattara, S. Niassy, M. N. Ba, D. Dakouo

The shea caterpillar Cirina butyrospermi is an important insect, highly valued as a human food item in Burkina Faso. However, its appearance is seasonal due to its univoltine cycle. This study therefore investigated the possibilities of breaking the nymphal diapause by changing the environmental factors and through the hormonal treatment of prepupae and pupae using bovine insulin and 20-hydroxyecdysone. Changes in humidity and temperature did not result in emergence, suggesting a mandatory nature of the diapause in C. butyrospermi. Injection of 20-hydroxyecdysone between 20 and 40 ng on 20 C. butyrospermi pupae resulted in 15.24 and 47.5% emergence, respectively. The …

Introduction: Microorganisms are a preferred source of enzyme production due to their high production capability and low cost of production. Bacterial endophytes occupy unexplored sites hence they represent a new source of enzymes with diverse applications. Background: Animal trypanosomosis is a major cause of economic loss in livestock production in Africa. A suggested control measure is to use breeds with traits of trypanotolerance. The study examines the effect of natural Trypanosoma vivax challenge on haematological parameters in two trypanotolerant cattle [N’Dama and West African Shorthorn (WASH)] herds.
