Montana Environmental Information Center v. Montana Department of Public Service Regulation provides insight into the discretion of the Public Service Commission and its impact on renewable energy development in Montana, especially in the wake of the repeal of the Renewable Power Production and Rural Economic Development Act. This case evaluates the Commission’s decisions to grant waivers to NorthWestern Energy for its 2015 and 2016 renewable energy purchase obligations under the Act. The Court found the Commission’s decisions were arbitrary and unsupported by substantial evidence and appropriate reasoning. In United States v. Harper, the Tenth Circuit reversed a conviction for violent crimes committed in Indian Country because the government failed to provide admissible evidence proving that the defendant was an “Indian” under federal law. At first glance, the ruling appears to turn on a technical evidentiary issue concerning the exclusion of a tribal membership verification letter under the business records exception. Yet the case reveals something deeper: a jurisdictional framework that conditions the recognition of tribal identity on federal evidentiary norms, and in doing so, limits the functional sovereignty of tribal governments in federal courts. Friends of the Inyo v. United States Forest Service provides necessary guidance for categorical exclusion analysis under the National Environmental Policy Act. The Ninth Circuit Court of Appeals held that the United States Forest Service wrongfully construed NEPA as permissive of applying different categorical exclusions to various components of the same mining project until the project was excluded in its entirety from further environmental review. Radio Detection and Ranging (radar) is a core application of RF engineering, traditionally implemented through active systems that transmit high-power signals and process their reflections to estimate target range and velocity. However, active radar systems require significant power, cost, and regulatory overhead. This thesis explores the design and implementation of a passive radar system as a low-power, cost-effective alternative for real-time aircraft tracking.

The system capitalizes on existing ultra-high frequency (UHF) television broadcast signals as illuminators of opportunity. These signals, along with their reflected signals from airborne targets, are received using Yagi-Uda directional antennas and captured using a USRP B210 …

The landlord incorrectly predicated the holdover on RPAPL § 713(1) and § 713(7), arguing the former proprietary lessee was a licensee. The court reaffirmed that these sections do not apply to former proprietary lessees; rather, RPAPL § 711(1) for holdover tenants is the proper vehicle. The court emphasized that cooperative shares are considered personal property for these purposes, preventing the application of "real property" sale provisions under RPAPL § 713(1).

This article examines the ways in which language and conceptions of neurodivergent conditions, autism and ADHD, are connected in a Danish context. As in other Western countries, there are significant increases in diagnoses, and particularly women are being diagnosed in adulthood. The article focuses on how these conditions are perceived and talked about, utilizing concepts such as othering, labeling, and performativity. The analysis suggests that when individuals feel othered and stigmatized by diagnostic labels, it has less to do with the labels themselves and more to do with the connotations and pathologization connected with the labels. Caves represent an important type of shelter for many species of bats, particularly in karstic regions. In Mexico, about 60 bat species regularly use caves as roosts. The microclimate of a cave is a key component of the overall cave ecosystem. As expected, the Supreme Court declared, in Loper Bright Enterprises. v. Raimondo, that "Chevron is overruled." But the Court did not understand the decision that it claimed to overrule. It focused its criticisms on Chevron's notorious two-step test, but failed to recognize that the decision is a major conceptual advance – the first clear judicial recognition that statutory interpretation is the initial and invariably necessary stage in the process by which administrative agencies enforce the law. Sepsis is a general diagnosis related to a dysregulated immune response to a source of infection that, if left untreated, will most likely result in organ failure and eventual death. Sepsis affects 49 million people annually, and is responsible for 11 million annual deaths, according to Jarczak 1. A recent study has shown that over 80% of sepsis deaths may be preventable with earlier diagnosis and treatment, and that the risk of mortality increases by 8% for every hour that sepsis goes untreated 5. Thus, our team identified that the timeliness of sepsis diagnosis is a paramount healthcare need.

This paper aims to analyze the 2018 Netflix miniseries adaptation of Richard Adams's classic novel, Watership Down, using Critical Animal Studies and a Cinematographic lens. The analysis focuses on its visual storytelling through the camera angles, lighting, and character representation. Adams’ novel was adapted three times. The first two animated versions were horrifying to the extent that one of them was banned. The most recent version used Computer-Generated Imagery (CGI) technology to be more friendly. Stanford (2006, 2009) has offered an antirealist argument (the “problem of unconceived alternatives”, PUA) based on the argument that scientists are not able to grasp alternatives to a current scientific theory T. According to PUA, the mere existence of some epistemically inaccessible alternatives (T’, T”, …) weakens our trust in T and shakes the foundations of mainstream scientific realism. The public policy underlying at-will employment—and particularly our collective interest in freedom of choice in the employment relationship—weighs in favor of allowing employers to regulate their employees' political activities and thus align personnel decisions with organizational values.

Beginning with an exploration of the laws that somewhat limit employers' ability to regulate their employees' political activities, this Essay considers the National Labor Relations Act, Title VII of the Civil Rights Act, state anti-discrimination laws, state laws governing captive audience meetings, and state employment protections for political activity.

Abstract

This qualitative content analysis investigated the intrinsic and extrinsic motivation necessary for male and female colleges students to engage in physical activity, including spiritual aspects. Survey questions were used to collect data from 80 college students from the suburbs of Chicago, ages 18-24, 43 males and 37 females. Data analysis included coding of the student comments and results showed that males are motivated by the extrinsic motivators of competition and social engagement and the intrinsic motivators of enjoyment and stress relief while females are motivated by the extrinsic motivator of appearance and the intrinsic motivators of spirituality, enjoyment and …
