Alchemistic Metaphors In Comparative Law: Mixed Legal Systems, Reception Of Laws And Legal Transplants, Andreas Rahmatian Dec 2018

Alchemistic Metaphors In Comparative Law: Mixed Legal Systems, Reception Of Laws And Legal Transplants, Andreas Rahmatian

Journal of Civil Law Studies

The terms “mixed legal systems” and “legal transplants” are used frequently in comparative law. What they denote exactly, is difficult to ascertain: what does the mixité consist of, what are its ingredients or building blocks; which types of mixité exist, how are legal transplants transformed in the receiving legal system? Comparative lawyers often resort to metaphors when they try to describe and explain these complex phenomena: metaphors from cooking, music, horticulture or biology. Whenever there are mixtures, trans-formations, or transmutations, metaphors from the philosophical concepts of alchemy are at least equally illuminating. This article discusses the different problems of conceptualising …

Quantitative data were collected from over 1,500 students who had enrolled in 59 different service-learning classes. In addition, interviews were conducted with 13 students of color who had participated in service-learning. Findings indicated that students’ service-learning experiences paralleled study participants’ descriptions of how they learned most effectively. Furthermore, the findings suggest that service-learning may resonate for students of color …

A Novella In Technicolor: The Artistic Connections To Theme And Prose In "The Hour Of The Star", Abby Thatcher Dec 2018

A Novella In Technicolor: The Artistic Connections To Theme And Prose In "The Hour Of The Star", Abby Thatcher

Student Works

Brazilian author-painter Clarice Lispector's work, especially her prose in her last published novella The Hour of the Star, is rich with deliberate color use; her abstracted prose style, including abstraction of punctuation, deliberate mention of specific colors during her narrative, and fragmented sentence structure all create an rich word-painting of the main character Macabea. This word painting creates an opportunity for Lispector to color her work with sharply pointed satire, convey political and social agendas of awareness, and ultimately places Macabea in an image-rich and meaning-driven view to the reader. This view is aided by further analysis of Lispector's little-known …

Chancing The Arm To Save The Face: The Fight For Irish Gaelic Recognition And Ending The Stormont Deadlock, Samantha F. Sigelakis-Minski Dec 2018

Chancing The Arm To Save The Face: The Fight For Irish Gaelic Recognition And Ending The Stormont Deadlock, Samantha F. Sigelakis-Minski

Brooklyn Journal of International Law

Since January 2017, the Northern Irish government has been shut down, with both the Executive and Assembly collapsed and the two major political coalitions deadlocked. Since then, civil servants with no major decision-making power have largely run the government. One of the deadlock’s major battlegrounds is whether there should be legislation in Northern Ireland mandating that Gaeilge, or Irish Gaelic, be treated as a language of equal status to that of English. This Note explores this issue and argues that the right to equal language protections is founded in the right to one’s cultural identity, and as such should be …

Twilight Histories: The Waverley Novels And George Eliot’S Fictions Of The Recent Past, Camilla Cassidy

Studies in Scottish Literature

Discusses the influence of Scott's Waverley novels on George Eliot, as novels set in recent history, drawing on Eric Hobsbawm's idea of a "twilight zone between history and memory" to examine Eliot's Adam Bede and The Mill on the Floss, and to argue that Eliot in reworking Scott's reimagining of this recent-historical "time-lapse" articulates a psychological experience of historical transition and modernisation.

Resistance To Neocolonialism In Contemporary Chinese Literary Theory, Zeng Jun Dec 2018

Resistance To Neocolonialism In Contemporary Chinese Literary Theory, Zeng Jun

CLCWeb: Comparative Literature and Culture

In his article "Resistance to Neocolonialism in Contemporary Chinese Literary Theory" Jun ZENG claims that the introduction of Western Literary Theory in the past forty years of China's reform and opening up was carried out under the background of neo-colonialism. "Western imagination" in the discourse of contemporary Chinese literary theory was an important aspect of the strategy of cultural resistance under the overwhelming influence of Western neocolonialism. Contemporary Chinese literary theory no longer simply regards Western literary theory in the twentieth century as a bourgeois literary ideology; instead, it adopts a "de-ideological" attitude to return to the issues of literature, …

As one of the most excellent and unique contemporary Chinese writers, Mo Yan has exerted extensive influence on Chinese readers, and his works have also caused various controversies over the past 30 years. His winning of the Nobel Prize in Literature, rather than …

It reviews the internal and external factors of anxiety faced by Chinese during the period of seventeen years since the establishment of the People's Republic of China in 1949. The seventeen years witnessed a stress on and flourishing of the proletarian socialist literature of the people, by the people and for the people. The seventeen-year literature, on its way to smashing the old system, represents the trend of Chinese literature of the time and the extension …

Differential Effects Of Internal And External Constraints On Sustainability Intentions: A Hierarchical Regression Analysis Of Running Event Participants By Market Segment, Galen Trail, Brian P. Mccullough

Journal of Management for Global Sustainability

There are immediate calls to action across all business sectors to address the adverse effects of climate change. The sport industry is not immune to these calls—practitioners have engaged participants to further the environmental initiatives of their events through creative messaging campaigns with mixed success. We examine the differential effects of internal and external constraints on sustainability intentions by market segment of a running event’s participants. This furthers our understanding of how to engage sport participants in sustainable behaviors at a sport event and improves the sustainable behavior outcomes of messaging campaigns. Our results support the principles of constraint theory …

“I’M The Greatest”: Pride, Impression Management, And Denial Of Coercive Control And Physical Abuse By Perpetrators Of Intimate Partner Violence, Benjamin Reissman, Kendra Doychak M.A., Angela Crossman Ph.D., Chitra Raghavan Ph.D.

Student Theses

Coercive control and physical abuse are two prominent forms of intimate partner violence (IPV), often accompanied by with impression management to conceal such behavior. However, intrinsic motives for engaging in impression management by male IPV offenders are not well-known. The present study makes use of archival data from 85 heterosexual men in a batterer treatment program to gauge how pride, shame, and guilt may relate to impression management and reported IPV. Admission to shame and guilt appear to be correlated with and predictive of both forms of reported abuse, along with the absence of impression management. This implies that internalized …

Individual’S Self Awareness Of Mental Illness: The Effects On Implicit Bias, Microaggressions, And Racial Discrimination, Sarah Zoubaa Dec 2018

Individual’S Self Awareness Of Mental Illness: The Effects On Implicit Bias, Microaggressions, And Racial Discrimination, Sarah Zoubaa

Student Theses

The purpose of the current study is to understand the factors that impact how persons experiencing subclinical psychological symptoms or an undiagnosed but clinically significant psychological problem perceive individuals who been diagnosed with mental illness. Previous literature has investigated the experiences of discrimination among those with mental health problems, but not their attitudes and behavior towards individuals among their in-group. It was hypothesized that individuals with an emerging mental health problem will have higher rates of implicit bias and perpetrate more microaggressions towards those with a mental illness in order to remove themselves from a group that is associated with …

Healing From Heterosexism Through Expressive Writing, Kathleen M. Collins Dec 2018

Healing From Heterosexism Through Expressive Writing, Kathleen M. Collins

Graduate Masters Theses

Simply by existing within our society, LGBTQ people encounter widespread exposure to heterosexist attitudes, behaviors, and policies on a daily basis that ignore, invalidate, or outright discriminate against them. This marginalization contributes to myriad psychological consequences such as depression, suicidality, anxiety, and substance abuse. Despite the fact that LGBTQ people experience mental health issues and some subsequently seek treatment, few interventions exist that specifically address LGBTQ minority stressors; those that do exist tend to treat mental health consequences of societal heterosexism, rather than offering ways to heal from heterosexist experiences directly. In the current study, I explored the ability of …
