Co-Creation With Vulnerable Consumers – An Action Research Case Study Of Designing A Pictorial Language For Logistics, S. Schmitt-Rüth, M. Simon, A. Demuth, A. Kornacher, M. Isakovic, M. Krupp, M. Stoll
ServDes Conference Series
Within the context of Universal Design and User Centered Design, vulnerable consumers, especially immigrants, still represent a fringe group when it comes to co-creation processes. Therefore, the aim of our study was to find ways to integrate immigrants into a co-creation process, namely the development and testing phase of a pictorial language for warehouse jobs. Within an action research case study consisting of a four-part storyline settled in a warehouse context, we identified and specified four key success factors that contribute to a successful co-creation project with vulnerable consumers: (1) integration at the very beginning of the co-creation project, (2) …

A Longitudinal Analysis Of The Effect Of The Starting Right, Now Program On Unaccompanied Homeless Adolescents' Well-Being, Emily E. Esposito
USF Tampa Graduate Theses and Dissertations
To date, few multicomponent interventions focused on meeting the complex needs of unaccompanied homeless youth (UHY) have been developed. One intervention, called Starting Right, Now (SRN), provides unaccompanied homeless adolescents with a broad range of home-, school-, and community-based services and supports to meet the unique needs of each individual. Previous qualitative research has supported the effectiveness of SRN on student outcomes; there has not yet been an examination of the program using quantitative methods. Thus, the current study investigated the impact of Starting Right, Now on students’ well-being through the examination of longitudinal data collected over a 12-month period. …

Supporting Lgbtq+ Survivors On Campus, Ethan Levine, Molly Sapia
Title IX Summit
Title IX protections have provided a much-needed resource for addressing sexual violence on campus. However, the benefits of Title IX may not apply equally to all students in practice. This workshop will explore strategies for addressing sexual violence in lesbian, gay, bisexual, trans, and queer (LGBTQ+) communities. How can we improve support for LGBTQ+ students? How effectively does Title IX address same-sex violence – and might this shift under the current administration? What other policy and programmatic options would support students in these communities? Workshop participants will discuss and strategize around these and other contemporary challenges for supporting LGBTQ+ survivors …
“Who Will Judge The Many When The Game Isthrough?”: Considering The Profound Differencesbetween Mental Health Courts And “Traditional”Involuntary Civil Commitment Courts, Michael L. Perlin
“Who Will Judge The Many When The Game Isthrough?”: Considering The Profound Differencesbetween Mental Health Courts And “Traditional”Involuntary Civil Commitment Courts, Michael L. Perlin
Seattle University Law Review
For forty years, we have known that involuntary civil commitment hearings are—in most jurisdictions—“charades.” When the Supreme Court noted, in Parham v. J.R., that the average length of a civil commitment hearing ranged from 3.8 to 9.2 minutes, the reaction of many who had done these cases was, “What? So long?!” The characterization of such hearings as being a “greased runway” to a state institution has never been disputed. Lawyers representing these individuals were bored or contemptuous; judges simply wanted to get cases moving; opposing counsel looked at their wrist watches to see when the cases would be done. This …

An Analysis Of The Bizx Commercial Trade Exchange: The Attitudes And Motivations Behind Its Use, Ján André Montoya
Dissertations and Theses
The Global Financial Crisis underscored both the complexity and brittleness of the global financial system, especially for small to medium enterprises dependent on the current banking regime for credit. More than ever, we have also begun to see the disentanglement of small businesses from traditional banks at the local and regional level in the form of CDFIs, fintech alternative lending, and now complementary currencies. Through interviews with the management and members of the BizX complementary currency this study asks what the attitudes and motivations are behind its offering and use. In addition, it inquires into the economic and psychological benefits …

Access To Justice: Impact Of Twombly & Iqbal On State Court Systems, Danielle Lusardo Schantz
Access To Justice: Impact Of Twombly & Iqbal On State Court Systems, Danielle Lusardo Schantz
Akron Law Review
Approximately a decade ago, the Supreme Court of the United States unexpectedly changed the pleading standard for federal cases with the Twombly and Iqbal decisions. Plausibility pleading replaced the more liberal notice pleading standard endorsed by the Federal Rules of Civil Procedure. Since then, state courts have been faced with a choice to either mirror this change in pleading standards or maintain their commitment to notice pleading. Plausibility pleading has begun to creep into the state court system. Several states have formally changed their pleading standards, while others have declared their commitment to notice pleading. This Article considers the impact …

The Sedona Principles (Third Edition): Continuity, Innovation, And Course Corrections, Thomas Y. Allman
Akron Law Review
The Sedona Principles and Commentaries in the Third Edition (2018) are worthy successors to those of the Second Edition (2007) and, in many respects, a substantial improvement. Principles 2, 5 and 8 build on the 2015 amendments to Federal Civil Rules, including amended Rule 26(b)(1), in advocating an increased emphasis on proportionality across the full spectrum of e-discovery activity. They also reflect a more nuanced view of Rule 26(b)(2)(B), added by the 2006 Amendments to deal with undue burden or costs, as does Principle 13 in regard to cost allocation, which recommends use of amended Rule 26(c) to the exclusion …
Still A Failure: Broad Pretrial Discovery And The Superficial 2015 Amendments, George Shepherd
Still A Failure: Broad Pretrial Discovery And The Superficial 2015 Amendments, George Shepherd
Akron Law Review
Ever since broad discovery was permitted in 1938 in the Federal Rules of Civil Procedure, the system has been a failure. It has dramatically increased litigation’s cost and pain, with few balancing benefits. Broad discovery should be eliminated, returning the United States to the sensible approach of the rest of the world. In Twombly and Iqbal, the Supreme Court went part of the way towards doing exactly that; the decisions eliminate discovery in many cases. The 2015 amendments to the Federal Rules do little to cure the remaining major problems. Instead, broad discovery should be eliminated for all cases.
Asymmetry And Adequacy In Discovery Incentives: The Discouraging Implications Of Haeger V. Goodyear, Jeffrey W. Stempel
Asymmetry And Adequacy In Discovery Incentives: The Discouraging Implications Of Haeger V. Goodyear, Jeffrey W. Stempel
Akron Law Review
In 2017, the U.S. Supreme Court unanimously vacated a $2.7 million fee-shifting award imposed on Goodyear Tire & Rubber Co. in response to rather egregious concealment of key testing documents concerning a failing tire blamed for a serious accident. Although the Court’s opinion does not foreclose imposition of substantial sanctions on remand, Haeger v. Goodyear stands as a rather stark illustration of the potential for discovery cheating to have comparatively little consequence—at least for the litigant if not counsel—if the cheating is not discovered until after conclusion of the matter. Although the perceived problem of excessive or overbroad discovery—“expansive discovery …
Attorney Negligence And Negligent Spoliation: The Need For New Tools To Prompt Attorney Competence In Preservation, Paula Schaefer
Attorney Negligence And Negligent Spoliation: The Need For New Tools To Prompt Attorney Competence In Preservation, Paula Schaefer
Akron Law Review
Though case law typically suggests otherwise, attorney negligence is the primary cause of negligent spoliation of evidence. With the advent of ediscovery, it became markedly more difficult for attorneys to competently guide their clients through the steps necessary to preserve evidence¾particularly the categories of evidence most likely to help an opponent in a case. Unlike intentional spoliation instigated by an attorney, negligent spoliation is not the product of calculation. If an attorney were to undertake a cost-benefit analysis, negligent spoliation would not be a rational choice. The field of behavioral legal ethics provides insight into other reasons attorneys fail to …

For A Better Normal : Fostering The Informal Sector In Post-Hurricane Puerto Rico, As A Pathway For Economic Stabilization, Jonathan W. Melendez Davidson
Masters Theses
For a Better Normal is a proposal to aid informal produce vendors in post-hurricane Puerto Rico. The project takes the shape of a toolkit that facilitates the creation of a cooperative buyer’s club. This cooperative not only provides vendors with the opportunity to create sustainable businesses, but also acts as a pathway to formalization. The outcome of this thesis becomes a case study for how to re-think the potential of the informal economy in relation to the Island’s economic crisis.

Enemies Of The Nation: Understanding The Hungarian State’S Relationship To Humanitarian Ngos, Andria D. Timmer Ph.D., Danielle Docka-Filipek Ph.D.
Journal of International and Global Studies
Nongovernmental organizations (NGOs) occupy a very ambiguous role in society. Historically, NGOs have been both heralded as democracy in action and criticized for being complicit supporters of neoliberalism. Now, in certain contexts, they are rendered as enemies of the nation. In this article, we examine the evolution of nongovernmental organizations in Hungary, a nation where this transformation is exceedingly clear. Hungary provides a pertinent case example to explore the manner in which civil society as an amorphous, ill-defined category becomes a stand-in for whatever the state needs to protect its interests. The current discourse on NGOs in Hungary plays out …
