Early Data From The Maine Ombudsman’S Hospital Advocacy Program: A Deeper Look At Difficult To Place Patients, Joseph Zamboni Jul 2018

Early Data From The Maine Ombudsman’S Hospital Advocacy Program: A Deeper Look At Difficult To Place Patients, Joseph Zamboni

Muskie School Capstones and Dissertations

There is little data available on the complex cause and effect of delayed hospital discharge; however, some evidence suggests that long-stay patients tend to be complex, older, and sicker. In Maine, a 2014 Maine Health Association report found complex hospital patients were waiting weeks, months and sometimes over a year in Maine Hospitals before accessing long-term services and supports. In response to these concerns around delayed discharge from hospitals, the First Regular Session of the 127th Maine Legislature created the Commission to study Difficult to Place Patients. The Commission ultimately passed Legislation that gave the Maine Long- Term Care Ombudsman …

Nurturing A More Just And Sustainable Food System: The First Year Of Pace Law's Food And Beverage Law Clinic, Jonathan Brown Jul 2018

Nurturing A More Just And Sustainable Food System: The First Year Of Pace Law's Food And Beverage Law Clinic, Jonathan Brown

Elisabeth Haub School of Law Faculty Publications

This article looks back at the Clinic's first year and explores lessons learned in putting the theory behind the Clinic's model into practice. Launching the Clinic required a leap of faith. Was there in fact a client demand for its services? Was there sufficient interest from law students in the intersection of transactional law and food systems? Was the scope of legal matters too broad? Was the client focus too narrow? The early returns from the first year have given us valuable insights and experience from which to draw. First, this article discusses the unmet legal need the Clinic seeks …

Bureaucratization Of Transgender Rights: Perspective From The Ground, Dipika Jain, Gauri Pillai Jul 2018

Bureaucratization Of Transgender Rights: Perspective From The Ground, Dipika Jain, Gauri Pillai

Socio-Legal Review

The Supreme Court directive in National Legal Services Authority v. Union of India brought in a transformative change by granting legal recognition to transgender1 persons. The Court issued several dicta, aiming to provide rights to transgender people and protect them from discrimination. The case marked a landmark shift in the legal regime, previously often characterized by the constant persecution and denial of rights to transgender persons. Yet, there have been multiple records indicating that the Supreme Court orders have not been adequately implemented by the states in India. To monitor and record the progress in various states, the Centre for …

Lawyers In Africa: Brokers Of The State, Intermediaries Of Globalization - A Case Study Of The "Africa" Bar In Paris, Sara Dezalay Jul 2018

Lawyers In Africa: Brokers Of The State, Intermediaries Of Globalization - A Case Study Of The "Africa" Bar In Paris, Sara Dezalay

Indiana Journal of Global Legal Studies

Africa is the "Global Economy's Last Frontier"! Images of the African continent as a boon of mineral riches, and a new legal Far West pervade media and scholarly accounts. Yet, these images tend to reflect the protracted political and development dependency of African states, with lawyers involved in corporate dealings on the continent either denounced as mercenaries at the service of neo-colonial "looting" or idealized as missionaries of the rule of law. This article suggests a research strategy that moves away from these ideological and political accounts. It uses lawyers' trajectories and professional strategies as an entry-point to reglobalize the …

Federal Student Aid: Can We Solve A Problem We Do Not Understand?, Deanne Loonin, Julie Margetta Morgan Jul 2018

Federal Student Aid: Can We Solve A Problem We Do Not Understand?, Deanne Loonin, Julie Margetta Morgan

Utah Law Review

At over $1 trillion, with more than 8 million borrowers in default, the federal student loan program is in trouble. There is no question that policymakers will do their best to fix it in the coming years. The only question is whether they will have the evidence they need to make informed judgments about what ails our student loan program, and what can cure it.

In the coming years, advocates, policymakers, and researchers should focus on gathering data and information on all possible causes of the failures in the student loan program. As the previous Part describes, the public has …

Legal Deserts: A Multi-State Perspective On Rural Access To Justice, Lauren Sudeall, Lise R. Pruitt, Danielle M. Conway, Michele Statz, Hannah Haksgaard, Amanda L. Kool

Vanderbilt Law School Faculty Publications

Rural America faces an increasingly dire access-to-justice crisis, which serves to exacerbate the already disproportionate share of social problems afflicting rural areas. One critical aspect of the crisis is the dearth of information and research regarding the extent of the problem and its impacts. This Article begins to fill that gap by providing surveys of rural access to justice in six geographically, demographically, and economically varied states: California, Georgia, Maine, Minnesota, South Dakota, and Wisconsin. In addition to providing insights about the distinct rural challenges confronting each of these states, the legal resources available, and existing policy responses, the Article …

(Trans)Gressing The Binary: Coalitional Self-Determination For The 'Third Gender' Framework, Akshita Pandit Jul 2018

(Trans)Gressing The Binary: Coalitional Self-Determination For The 'Third Gender' Framework, Akshita Pandit

Socio-Legal Review

In National Legal Services Authority (NALSA) v. Union of India, the Supreme Court of India legally recognized the existence of a 'third gender' identity to protect and promote self-determination for persons identifying as 'transgender'. Although the judgment might seem as a breakthrough for the transgender rights movement, I believe that it has glaring contradictions with regards to the socio-political environment where the 'third gender' is situated. The main argument of my paper is to critique such contradictions in the existing policy approach and suggest an inclusive and self-determinative policy framework for persons identifying as transgender. To substantiate, the first chapter …

Ethical Accountability Of Licensed Professional Counselors: A Comparative Study Of State Regulations And The Effects On Ethical Behavior, Kelly J. Doolan Jul 2018

Ethical Accountability Of Licensed Professional Counselors: A Comparative Study Of State Regulations And The Effects On Ethical Behavior, Kelly J. Doolan

School of Public Service Theses & Dissertations

Accountability is an integral aspect of occupational regulation and professional licensure and helps to promote ethical behavior within professional occupations. States have the autonomy to implement laws and enact sanctions against professionals who are in violation of the regulations and professional norms of the field. This research explores accountability and ethical behavior in the licensed professional counselor occupation. The purpose is twofold, it examines how states vary in their approach to setting legal and professional accountability measures as defined by minimum requirements for education and practice and it explores the relationship between ethical outcomes as defined by disciplinary violations and …

The Development Of The Filipino Coping Strategies Scale, John Robert C. Rilveria Jun 2018

The Development Of The Filipino Coping Strategies Scale, John Robert C. Rilveria

Asia-Pacific Social Science Review

The development of the Filipino Coping Strategies scale was based on the qualitative data on the resilience of Filipinos and the ways by which they cope with stressful life experiences and the quantitative data on foreign measures of coping. Integration of both data led to the formulation of nine coping strategies: cognitive reappraisal (pagsusuri), social support (paghingi ng tulong), problem-solving (pagtugon), religiosity (pagkarelihiyoso), tolerance (pagtitiis), emotional release (paglabas ng saloobin), overactivity (pagmamalabis), relaxation/recreation (paglilibang), and substance use (pagbibisyo). Initially, the scale was composed of 45 items with five items under each domain. This was pilot tested to 627 male and …

Comparative Analysis Of Public And Private Start-Up Incubators (From A Users’ Perspective), Jelena Putarek Jun 2018

Comparative Analysis Of Public And Private Start-Up Incubators (From A Users’ Perspective), Jelena Putarek

Theses

The emergence of technologically oriented small business ventures referred to as start-ups has brought in another global trend, the emergence of start-up incubators. Although business incubators have been present since the 1950’s, their importance has never been greater. Local governments, as well as private entities, have recognized the importance of business incubation as a driving force of innovation and the economy as a whole. This qualitative study is focused on examining experiences of tenants located in two start-up incubators in the city of Zagreb – public Tehnološki Park Zagreb – The Technology Park Zagreb incubator, and privately owned Zagrebački Inkubator …

Is Bar Exam Failure A Harbinger Of Professional Discipline?, Jeffrey S. Kinsler Jun 2018

Is Bar Exam Failure A Harbinger Of Professional Discipline?, Jeffrey S. Kinsler

St. John's Law Review

(Excerpt)

This Article’s theses are premised on two suppositions. First, the primary causes of attorney discipline are nondiligence and incompetence. Similarly, the primary causes of bar exam failure are “poor study habits, weak academic skill development, or low intellectual functioning . . . .” Thus, it is reasonable to assume that lawyers who fail the bar exam are more likely to be disciplined as attorneys. Second, there is statistical and anecdotal evidence linking the failure of entrance exams and subsequent professional discipline in other occupations. It is plausible, therefore, that such a link exists in the legal profession.

Does Trade Trump Law In The Protection Of Human Rights? International Trade, Law, And Human Rights In South Africa And South Korea, Cristina Campo Jun 2018

Does Trade Trump Law In The Protection Of Human Rights? International Trade, Law, And Human Rights In South Africa And South Korea, Cristina Campo

University of Miami International and Comparative Law Review

International relations have become categorically dependent on the sophisticated trading systems that interconnect and empower sovereign states. Thus, a state’s focus on protecting the rights of its individuals comprising and affected by that system would appear to come secondary to the economic decisions involved in conducting trade agreements. This article asks whether the international trade regime can be used to further the protection of human rights or whether such protection should be better left in the hands of legal entities in international bodies and sovereign states. I analyze South Korea and South Africa’s legal and trade regimes—two of the world’s …
