Bringing Counsel In From The Cold: Reconciling Ethical Rules With The Quagmire Of Insurance Defense Practice, Joseph Regalia, V. Andrew Cass Jun 2018

Bringing Counsel In From The Cold: Reconciling Ethical Rules With The Quagmire Of Insurance Defense Practice, Joseph Regalia, V. Andrew Cass

New Mexico Law Review

Litigators have a tough job: demanding clients, relentless deadlines, and constant pressure to get everything just right. But insurance defense attorneys deal with this and more. Being an insurance-defense attorney means serving two masters: the insurance company that pays the bills, and the insured who stands to lose if the case turns out badly. Not to mention that the sorts of complicated liability cases for which insurers provide coverage often spawn twisted webs of attorney expectations and obligations--particularly ethical ones. And this ethical morass comes with costs: Costs for parties, costs for attorneys, and costs for the public. Much of …

The New Welfare Rights, Susannah Camic Tahk Jun 2018

The New Welfare Rights, Susannah Camic Tahk

Brooklyn Law Review

Participating in the tax system gives rise to what could be enormously powerful rights for poor people. The tax system has become one of the main tools the United States uses to fight poverty. A thick bundle of tax rights accompanies the many tax antipoverty programs. This paper is the first to recognize the potentially substantial rights that poor people have through the tax code. For decades, poverty law advocates and scholars have lamented the decline of the “welfare rights” that poor people once had in their benefits. No one has yet recognized that in fact poor people still have …

Sexual Violence And Legal Advocacy: Psychometric Evaluation Of The Legal Advocacy Services Satisfaction Survey, Joanne K. Sparrow Jun 2018

Sexual Violence And Legal Advocacy: Psychometric Evaluation Of The Legal Advocacy Services Satisfaction Survey, Joanne K. Sparrow

Clinical Psychology Dissertations

The Legal Advocacy Services Satisfaction Survey (LASSS; Gibbs, Agatonovic, & Bikos, 2011) is a nine-item self-report inventory developed to evaluate both the quality of the information provided by the legal advocate as well as the quality of the relationship the advocate has established with the client. This dissertation sought to address an important gap in the literature on sexual violence and the provision of legal advocacy services by examining survey data collected from adult (i.e., age 18 and over) female survivors working with legal advocates at an urban-based agency that provides multiple types of services to survivors of sexual violence …

Service Contracts And The Cisg, Ingeborg Schwenzer, Julian Ranetunge, Fernando Tafur Jun 2018

Service Contracts And The Cisg, Ingeborg Schwenzer, Julian Ranetunge, Fernando Tafur

Indian Journal of International Economic Law

This article deals with the potential application of CISG on international supply of services by emphasising the theoretical and practical rationales. It takes on a different approach than the existing literature on the topic by not focusing upon the suitability of CISG on supply but rather by undertaking comparative analysis of domestic legal systems in their attempt to grapple with the distinction between sales and services, and by providing an account of how the most contentious provisions of the CISG can be applied to service contracts.

Vulnerability, Access To Justice, And The Fragmented State, Elizabeth L. Macdowell Jun 2018

Vulnerability, Access To Justice, And The Fragmented State, Elizabeth L. Macdowell

Michigan Journal of Race and Law

This Article builds on theories of the fragmented state and of human and institutional vulnerability to create a new, structural theory of “functional fragmentation” and its role in access to justice work. Expanding on previous concepts of fragmentation in access to justice scholarship, fragmentation is understood in the Article as a complex phenomenon existing within as well as between state institutions like courts. Further, it is examined in terms of its relationship to the state’s coercive power over poor people in legal systems. In this view, fragmentation in state operations creates not only challenges for access, but also opportunities for …

Implementing Online Dispute Resolution In Mo Healthnet Appeals: Increasing Access To Remedies While Decreasing State Spending, Jane Rose Jun 2018

Implementing Online Dispute Resolution In Mo Healthnet Appeals: Increasing Access To Remedies While Decreasing State Spending, Jane Rose

Missouri Law Review

The distress associated with filing a civil lawsuit can leave an individual with a range of emotions, including despondency, humiliation, frustration, loss of self-confidence, and anxiety. Generally, an individual will only file suit if they suffer a serious harm. Subsequently, the individual must relive the injury at each step of the litigation. Repeatedly revisiting the injury disrupts the individual’s life and often leaves them feeling isolated and helpless. Now, picture an individual having to go through the entire process without the guidance of a lawyer, which is called pro se representation. This only adds to the individual’s stress levels. Representing …

Child Protection In Pakistan: Legislation & Implementation, Sana Younus, Aisha S Chachar, Ayesha Mian

Pakistan Journal of Neurological Sciences (PJNS)

Children are an integral part of any society. Their dependency on others for the fulfilment of their basic needs like food, shelter, education, safety and security makes them a vulnerable group. Society is judged on its ability to provide for the needs of the vulnerable. Provision of each of these needs is the responsibility of primary caregivers but requires assistance from multiple agencies working at the national level to ensure an effective delivery. Children’s rights can be defined as “the rights, which are concerned both with the protection of the individual child and with the creation of the conditions in …

550 E 182 Llc V. Quattlebaum

All Decisions

Landlord brought a nonpayment case against rent-stabilized tenant. Landlord's attorney would not accept amended answer from counsel, now tenant moves the court to amend the answer under CPLR 3025 (b). Motion granted to amend the answer. The proposed amended answer provides greater notice of respondent's breach of habitability defense and counterclaims, and such amplification has not been articulated to be prejudicial to landlord. The other defenses are standard in nonpayment proceedings and arise out of documents, copies of which are attached to the motion papers, which were in landlord's possession or easily accessible to landlord. Accordingly, landlord cannot claim to …
