Legal Censure Of Unconventional Expressions Of Love And Sexuality; Finding A Place In The Law For Bdsm, Anne Onoma Jan 2017

Legal Censure Of Unconventional Expressions Of Love And Sexuality; Finding A Place In The Law For Bdsm, Anne Onoma

UC Law SF Journal on Gender and Justice

The laws against assault and battery do not provide an exception for consensual BDSM. Consequently, a BDSM practitioner may be charged with criminally assaulting or battering a sexual partner despite having engaged in an activity that was completely consensual and not harmful in any meaningful way. Consent is the legal difference between sex and rape, and so consent should also be the difference between BDSM and criminal assault or battery. However, courts remain unwilling to even consider a defense of consent in assault and battery cases that include alleged BDSM activities. This note will explore the multiple ways in which …

What The Black Lives Matter Movement Demands Of Ethnic Studies Scholars, Melina Abdullah Jan 2017

What The Black Lives Matter Movement Demands Of Ethnic Studies Scholars, Melina Abdullah

Ethnic Studies Review

“Come in. Sit down. Close your eyes. Be silent and listen.” Melody engulfed the room. Our bodies unwittingly swayed softly to rhythms that conjured Ancestral memories. The bald, brown-skinned, goateed, dashiki-wearing man in front of the room exuded both warmth and strength. As a fourteen year-old ninth grader, the constancy of my giggle was interrupted by the sanctity of the space. Squeaks of the crotchety wooden desks that formed a large circle joined the music that hummed from the old record player at the front of the room. Minutes felt like days. Sound transported us through time and space and …

Johnson V. United States: The Impact On Texas' Habitual Offender Statute, Emily Frances Lynch Jan 2017

Johnson V. United States: The Impact On Texas' Habitual Offender Statute, Emily Frances Lynch

UC Law Constitutional Quarterly

In 2015, the Supreme Court struck down the residual clause of a major federal "habitual offender" statute in Johnson v. United States. The Court determined that combining the ambiguously worded "residual clause" with a pure "categorical approach" for interpreting qualifying crimes violated the notice provision of the Due Process Clause. Additionally, the Court identified an inability to create a clear and consistent standard of application for applying the residual clause as a second independent ground for holding the residual clause unconstitutional. Although the Court's holding specifically applied to a federal sentencing enhancement scheme, the holding is undoubtedly applicable to state …

The Complexity Of Public Attitudes Toward Sex Crimes, Laura L. King, Jennifer R. Roberts Jan 2017

The Complexity Of Public Attitudes Toward Sex Crimes, Laura L. King, Jennifer R. Roberts

Criminal Justice Faculty Publications and Presentations

Previous research suggests that public opinion about crime is nuanced as it has been found to vary greatly depending upon the type of questions asked and the amount of information provided. Few have similarly examined the complexity of public attitudes specifically about sex crimes. A survey was administered to a sample of U. S. residents utilizing the factorial survey method. The results suggested that specific details about the offense, offender, and victim had a significant effect on perceptions. The findings point to discrepancies between policy and public opinion, as well as to the importance of educating the public about the …

Idaho: Carefully And Cautiously Progressing, Elizabeth D. Fredericksen, John Riggins Jan 2017

Idaho: Carefully And Cautiously Progressing, Elizabeth D. Fredericksen, John Riggins

Public Policy and Administration Faculty Publications and Presentations

In Idaho, the FY18 budget drew upon the usual agency requests, executive recommendation, and legislative appropriation activities. However, less business-as-usual was the judicial branch involvement due to the post-sine die transmittal, and subsequent veto, of a bill to eliminate the sales tax on food. Citing the implications for General Fund revenue and fiscal challenges from extreme weather conditions in early 2017, Governor Otter vetoed the sales tax repeal sparking a legal challenge from legislators. The Idaho Supreme Court upheld the executive veto in a 4‒1 decision.

The robust individual income and sales tax collections reported at close of FY17 …

Everything Radiates: Does The Fourth Amendment Regulate Side-Channel Cryptanalysis, Riana Pfefferkorn Jan 2017

Everything Radiates: Does The Fourth Amendment Regulate Side-Channel Cryptanalysis, Riana Pfefferkorn

Connecticut Law Review

Encryption shields private information from malicious eavesdroppers. After years of slow adoption, encryption is finally becoming widespread in consumeroriented electronic devices and communications services. Consumer-oriented encryption software is now more user-friendly, and much of it turns on encryption by default. These advances enhance privacy and security for millions of people. However, encryption also poses an impediment to law enforcement’s ability to gather electronic evidence. Law enforcement calls this the “going dark” problem. U.S. law enforcement agencies have responded through both legal and technological means to encryption’s perceived threat to their capabilities. The scope of encryption’s impact on those capabilities is …

Protein Found At The Scene Of The Crime: The Potential For Using Proteomics For Identification, Gavin R. Tisdale Jan 2017

Protein Found At The Scene Of The Crime: The Potential For Using Proteomics For Identification, Gavin R. Tisdale

Dissertations and Honors Papers

Hair has long been collected from crime scenes as part of trace evidence. Originally, hair was used for some exclusionary purposes—only general qualities about an unknown source could be determined. Eventually, DNA was used to help identify the source but only if the root was still attached. Within the last two years, however, two major studies have used proteomics—the study of human protein sequences—to extract and identify protein sequences in an unknown source in order to match it to a known source. These two studies support the same hypothesis: proteomics is currently a viable method for narrowing down the source …

The Equivalence Of Religion And Conscience, Lucien J. Dhooge Jan 2017

The Equivalence Of Religion And Conscience, Lucien J. Dhooge

Notre Dame Journal of Law, Ethics & Public Policy

This Article examines issues posed by the equation of religious liberty with secular conscience, utilizing federal law and the law in those states which have adopted religious freedom restoration acts (RFRAs). The Article initially addresses the definition of religion through an examination of applicable literature and federal and state case law. The same approach is utilized to define conscience. The Article then examines similarities between the two concepts and the implications of their equivalence. The Article concludes that religion and conscience are moral equivalents that require equal legal treatment. However, equal treatment should proceed with caution in order to address …

Family Violence And Evolving Judicial Roles: Judges As Equality Guardians In Family Law Cases, Donna Martinson, Margaret Jackson Jan 2017

Family Violence And Evolving Judicial Roles: Judges As Equality Guardians In Family Law Cases, Donna Martinson, Margaret Jackson

Canadian Journal of Family Law

Access-to-justice studies initiated by Canadian lawyers and judges in the past four years have described the urgent need for family law reform. Reports from the studies discuss the need for a cultural shift—a fresh approach and a new way of thinking—in the reform process. A Roadmap for Change, the final report of the National Action Committee on Access to Justice, emphasizes the importance of providing justice, not just access: "Providing justice—not just in the form of fair and just process, but also in the form of fair and just outcomes—must be our primary concern." This article deals with the need …
