Antitrust As Disruptive Innovation In Health Care: Can Limiting State Action Immunity Help Save A Trillion Dollars?, William M. Sage, David A. Hyman

Loyola University Chicago Law Journal

On February 25, 2015, the United States Supreme Court ruled in North Carolina State Board of Dental Examiners v. FTC that state licensing boards controlled by market participants are subject to federal antitrust law unless they are “actively supervised” by the state itself. The ruling may sound narrow and technical, but the significance of the case can be inferred from the number and prominence of the amici curiae who lined up to support the North Carolina State Board of Dental Examiners (“North Carolina Board”)—first when the Federal Trade Commission’s (“FTC”) internal enforcement action was appealed to the United States Court …

The Evolving Emancipator: An Analysis Of Abraham Lincoln And The Progression And Development Of His Emancipationist Impulse, Sharon N. Rodriguez

Honors Undergraduate Theses

This research looks at the narrative of Abraham Lincoln as the Great Emancipator versus the Evolving Emancipator. The goal of this thesis is to contribute to the narrative of the Evolving Emancipator and show an imperfect man who achieved this action after trials and tribulations. This has been achieved by examining letters and other primary sources to fully understand the scope of Lincoln’s sentiments regarding slavery. My research shows a man who acknowledged slavery because it was sanctioned by the law. He recognized the rights of slave owners, both to retain their slaves and to have fugitive slaves returned, as they …

Me The People, Jason Mazzone Jan 2017

Me The People, Jason Mazzone

Constitutional Commentary, Vols 1–36 (1984–2022)

This essay is a contribution to a symposium on Randy Barnett’s book, Our Republican Constitution: Securing the Liberty and Sovereignty of We the People (2016). The essay focuses on Barnett’s treatment of courts. On the one hand, Barnett complains, judicial decisions of the past produced a dangerous consolidation of governmental power and truncated rights. On the other hand, fixing the problem — restoring a “republican” constitution — requires highly motivated judges to keep power in check and promote rights. These two impulses are in tension and, at least without additional work on both the diagnostic and remedial sides, appear incompatible. …

Protest Escalation: A Comparative Case Study Exploring Tools For Police For Successful Protest Engagement, Keziah Richards Jan 2017

Protest Escalation: A Comparative Case Study Exploring Tools For Police For Successful Protest Engagement, Keziah Richards

MA IDS Thesis Projects

Civil order is an important aspect of a healthy democratic society, however the right to express dissatisfaction at the state of affairs is also important to a democracy. These two points come into conflict when protests escalate out of control or turn into riots. Utilizing a comparative case study methodology with a grounded theory framework, this study seeks to understand how different police actions in protests can escalate the event into a riot, what factors are present when this occurs, what are the situations which necessitate that police make turning point choices, and what tools or concepts can police apply …

Not All Quiet On The Western Frontier: Examining The Sources Of Violent Unrest Among China’S Uyghur Minority, 2008-2015, Jazzlyn Monique O'Reilly Jan 2017

Not All Quiet On The Western Frontier: Examining The Sources Of Violent Unrest Among China’S Uyghur Minority, 2008-2015, Jazzlyn Monique O'Reilly

Theses & ETDs

Xinjiang, home to China’s Muslim Uyghur minority, has long been a site of active resistance to unjust rule under Han Chinese leaders. Unrest in Xinjiang, especially violent unrest involving acts such as bombings or mass stabbings, has become notably more frequent in the past few decades. Since late 2001, these incidents have more often than not been officially labeled as acts of terrorism, perpetrated by Uyghur separatists and religious extremists, many of whom are allegedly supported by foreign terrorist organizations. By examining all reported incidents of violent unrest committed by Uyghurs in China during the most recent period of unrest, …

Fundamentally Unfair: Databases, Deportation, And The Crimmigrant Gang Member, Katherine Conway Jan 2017

Fundamentally Unfair: Databases, Deportation, And The Crimmigrant Gang Member, Katherine Conway

American University Law Review

Provocative language painting immigrants as dangerous criminals and promises of increased immigration enforcement were cornerstones of Donald j Trump's presidential candidacy. As president, he has maintained this rhetoric and made good on many of his promises by broadening the definition of "criminal conduct" for immigration enforcement purposes, touting a renewed focus on immigrant gangs and cartels, and conducting several nation-wide anti-gang sweeps that placed an estimated 1095 "known" gang members in Immigration and Customs Enforcement (ICE) custody. But the Trump Administration did not create the specter of the criminal immigrant, or "crimmigrant," gang member, nor did it create the detection …

Democratic States Of Unexception: Towards A New Genealogy Of The American Political, William J. Novak, Stephen W. Sawyer, James T. Sparrow Jan 2017

Democratic States Of Unexception: Towards A New Genealogy Of The American Political, William J. Novak, Stephen W. Sawyer, James T. Sparrow

Book Chapters

This chapter takes issue with the history and theory of exception along these three lines. The first section offers a critique of the idea of law at the heart of the theory of exception. By taking a closer look at the history and theory of law in early nineteenth-century America, it offers an alternative reading of the role of exception in Emerson’s America – a place and time in which the exception in law was anything but exceptional. The second section offers a critique of the idea of state and sovereignty at the heart of the theory of exception in …

Ready, Print, Fire! Regulating The 3d-Printing Revolution, Joseph J. Pantella Iv Jan 2017

Ready, Print, Fire! Regulating The 3d-Printing Revolution, Joseph J. Pantella Iv

Journal of Law, Technology, & the Internet

"This Article argues that governments ought to proactively consider preemptive legislative or regulatory actions regarding 3D printing. To accomplish this objective this Article looks at the concepts of “permissionless innovation” and the “precautionary principle.” These concepts represent opposing ends of the regulatory spectrum; the former promoting a “wait-and-see” approach while the latter promotes a preemptive or preventative approach to government regulation. After defining these terms the Article will describe the characteristics of technologies that lend themselves either to permissionless innovation or to the precautionary principle. It will provide a few specific areas where policies of each type have been employed, …
