Who Let The Dogs Out—And While We’Re At It, Who Said They Could Sniff Me?: How The Unregulated Street Sniff Threatens Pedestrians’ Privacy Rights, Jacey Lara Gottlieb

Brooklyn Law Review

The Fourth Amendment affords United States citizens the right “to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures.” Throughout the last two centuries, the Supreme Court has developed extensive case law that has created a somewhat formulaic approach to determining whether one’s Fourth Amendment rights have been violated—namely, the “reasonable expectation of privacy” test. The Court has applied this test to afford the home, vehicle, airport, and the pedestrian all varying levels of privacy rights, and has upheld most of these respective levels of privacy in the context of the police canine sniff. The …

Conflict Recurrence In Rwanda And Burundi, Kellan H. Ritter Jan 2017

Conflict Recurrence In Rwanda And Burundi, Kellan H. Ritter

Honors Undergraduate Theses

This thesis argues that the different reactions of the population and rival elites to executive attempts to extend term limits in Rwanda and Burundi reflect the different ways civil wars ended in these two countries. In Rwanda, a military victory resulted in institutions that placed less constraint on the ruling party, while in Burundi, a negotiated settlement placed comparatively greater constraints on the ruling party. As a result, the major party in Rwanda was more powerful than the major power in Burundi, and thus more capable to co-opt or coerce the opposition. This paper uses a most-similar case design to …

Development And Application Of Microelectrodes To Study In Situ Disinfectant Loss And Corrosion On Metal Surface, Xiangmeng Ma

Electronic Theses and Dissertations

The primary objective of this research was to develop, fabricate, evaluate and utilize microelectrodes to metal coupons in artificial water system. In the brass experiment, it presented profiles of direct measurements of free chlorine/monochloramine, oxygen and pH to brass and cement based coupons. In monochloraminated water, brass showed a much faster corrosion process under observation. Profiles showed a less monochloramine consumption with as high as 7% greater oxygen utilization comparing to the brass in free chlorine solution, reflecting oxygen could be a major part of the corrosion initiation process. While cement showed less reactive characteristics to disinfectants and oxygen compared …

The Trolley And The Pinto: Cost-Benefit Analysis In Automated Driving And Other Cyber-Physical Systems, Bryant Walker Smith Jan 2017

The Trolley And The Pinto: Cost-Benefit Analysis In Automated Driving And Other Cyber-Physical Systems, Bryant Walker Smith

Faculty Publications

Automated driving has attracted substantial public and scholarly attention. This brief Article describes how that attention has brought new fame to a classic philosophical thought experiment (the “trolley problem”), critiques how this thought experiment has been applied in that context, proposes a more practical extension of that experiment based on risk rather than harm, notes that this extension may still involve programming value judgments, argues with reference to the Ford Pinto debacle that these judgments could inflame juries or the public at large, and emphasizes the need for appropriately focused public discussion of these issues. The Article may be especially …

Comparing Cmaq Forecasts With A Neural Network Forecast Model For Pm2.5 In New York, Samuel D. Lightstone, Fred Moshary, Barry Gross Jan 2017

Comparing Cmaq Forecasts With A Neural Network Forecast Model For Pm2.5 In New York, Samuel D. Lightstone, Fred Moshary, Barry Gross

Publications and Research

Human health is strongly affected by the concentration of fine particulate matter (PM2.5). The need to forecast unhealthy conditions has driven the development of Chemical Transport Models such as Community Multi-Scale Air Quality (CMAQ). These models attempt to simulate the complex dynamics of chemical transport by combined meteorology, emission inventories (EI’s), and gas/particle chemistry and dynamics. Ultimately, the goal is to establish useful forecasts that could provide vulnerable members of the population with warnings. In the simplest utilization, any forecast should focus on next day pollution levels, and should be provided by the end of the business day (5 p.m. …

A Withering Instrumentality: The Negative Implications Of R. V. Safarzadeh-Markali And Other Recent Section 7 Jurisprudence, Andrew Menchynski, Jill R. Presser

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

The Supreme Court of Canada has faced a perennial problem, particularly since the advent of the Canadian Charter of Rights and Freedoms (“Charter”), in its efforts to protect the constitutional rights of individuals without unduly interfering in the domain of the legislative branch of government. A key question has been — to what extent should the courts use section 7 of the Charter to review or police Parliament’s decisions regarding laws that engage an individual’s liberty interests? Indeed, this is an issue brought to the fore in many of the Supreme Court of Canada’s recent decisions that have struck down …

An Analytical Investigation Of Prestressed Beam Bridge Performance Before And After Widening, Chris Oriordan Adjah Jan 2017

An Analytical Investigation Of Prestressed Beam Bridge Performance Before And After Widening, Chris Oriordan Adjah

Electronic Theses and Dissertations

As traffic and congestion increase, so does the likelihood of collisions. The solution to this problem is usually through a rehabilitation process with two primary options: (1) widening/expansion of existing roadway and bridges and (2) complete replacement (new construction) of roadway and bridges. The first option is the most feasible and cost-effective. While roadway widening/expansion pose minimal issues, the same cannot be said of bridge widening. An existing bridge presents a multitude of challenges during the planning and design phases, during construction, and throughout the structure's service life. Special attention is required in both the design and detailing of the …

The Peering Predator: Drone Technology Leaves Children Unprotected From Registered Sex Offenders, Peter N. Borden Jan 2017

The Peering Predator: Drone Technology Leaves Children Unprotected From Registered Sex Offenders, Peter N. Borden

Campbell Law Review

The increased accessibility of drone technology for private operators frustrates the purpose of existing sex offender legislation. Sex offenders who are intent on committing further unlawful acts may use the vast capabilities of modern drone technology to target children. This Comment explores current restrictions imposed on registered sex offenders and discusses how those restrictions are insufficient to protect children from sex offender recidivism. In order to bridge the gap between sex offender legislation and the rise of private drone use, North Carolina needs new legislation that appropriately limits registered sex offenders from obtaining or using drones for the purpose of …

The French Veil Ban: A Transnational Legal Feminist Approach, Sital Kalantry Jan 2017

The French Veil Ban: A Transnational Legal Feminist Approach, Sital Kalantry

University of Baltimore Law Review

After the gruesome terrorist attack that killed eighty-four people in Nice, many beach towns in France began to ban Muslim women from wearing the “burkini” on beaches. The burkini, which was created by an Australian designer, is modest swimwear that covers the body and hair. The Nice attack occurred on the heels of a series of attacks in France. The timing of the French burkini ban suggests it was targeting Muslims due to the anger over the attacks. The argument that burkinis are not hygienic is a fig leaf for other more pernicious justifications. Others argue that religious garb generally …

Beyond Survival: Embodied Rhetoric And Resistance To Campus Sexual Violence, Logan Rae Gomez Jan 2017

Beyond Survival: Embodied Rhetoric And Resistance To Campus Sexual Violence, Logan Rae Gomez

Theses - ALL

Seeking to understand the culture of rape in the U.S., this project centers the stories of women of color on college campuses. In particular, I analyze Emma Sulkowicz’s Mattress Performance and the past, present, and future activist projects of Wagatwe Wanjuki. Positioning Sulkowicz and Wanjuki in the center of the conversation on sexual violence reminds us of the historical reality of rape for women of color. Collectively, Emma Sulkowicz and Wagatwe Wanjuki create discursive spaces for what Lisa Flores calls a “rhetoric of difference” and via Cherríe Moraga’s “theory in the flesh.” Throughout, I argue that we must analyze the …

The Impact Of The Supreme Court Of Canada On The Law Of Bail, Wayne K. Gorman Jan 2017

The Impact Of The Supreme Court Of Canada On The Law Of Bail, Wayne K. Gorman

Court Review: Journal of the American Judges Association

The Supreme Court of Canada, through a series of judgments, has had a significant impact on the law of judicial interim release (or “bail”) in Canada. As will be seen, this impact has occurred in relation to the law of bail at both the trial and appellate level and includes two decisions rendered this year. In this column I intend to examine this impact by briefly reviewing the law of bail in Canada and then illustrating the significant impact of the Supreme Court of Canada’s decisions in this area.

The starting point is that in Canada, bail is entirely a …
