Ethical, Legal, And Social Issues In Homeland Security – What They Are And How To Address Them, Alexander Siedschlag
Ethical, Legal, And Social Issues In Homeland Security – What They Are And How To Address Them, Alexander Siedschlag
Publications
Homeland security is a nationwide effort, including all of government across federal, state, local, territorial and tribal tiers; the public and the private sector, and the whole community, with each single citizen. The overarching homeland security vision comprises safeguarding the American way of life and is embedded into the goals of the National Security Strategy that include respect for universal values at home and abroad. It thus is evident that ethical, legal, and social-or ELSI-issues are important to consider. This chapter discusses the origins and essence of ELSI and explores ELSI integration into everyday homeland security. Two defining debates are …

Considerations For The Next Administration: Criminal Justice Reform And Prisoner Reentry, J. C. Lore Iii, Jason S. Kanterman
Emory Business Law Review
This Article explains the concept of prisoner reentry, which are Reentry programs that are designed to assist incarcerated individuals to successfully transition back into society after being released from prison. One critical component for reforming our system is through enhanced reentry programming and support: ensuring that offenders are provided adequate support and guidance post-incarceration, so that they may re-enter society as a contributing member of the global community. For the next administration, criminal justice reform will present an opportunity to implement rehabilitative justice through an investment of resources. The benefits of doing so appear clear'the community is safer when people …

Safeguarding The Ada’S Antidiscrimination Mandate: Subjecting Arrests To Title Ii Coverage, Shanna Rifkin
Safeguarding The Ada’S Antidiscrimination Mandate: Subjecting Arrests To Title Ii Coverage, Shanna Rifkin
Duke Law Journal
The news has been peppered with tragic stories of individuals with disabilities who have been killed or injured following police encounters. In the aftermath of these incidents, as injured parties seek accountability, a question looms: Can arrest proceedings violate the Americans with Disabilities Act?
The ADA was enacted to prohibit disability discrimination. The law had an ambitious agenda, supported by broad statutory authority, to ensure equality in all areas of public life for individuals with disabilities. But while the ADA has fostered integration into many aspects of modern life, one area remains deeply contested: arrests.
If Congress envisioned that Americans …
A Market For Sovereign Control, Joseph Blocher, Mitu Gulati
A Market For Sovereign Control, Joseph Blocher, Mitu Gulati
Duke Law Journal
Can popular sovereignty and sovereign territory coexist? Can countries exchange sovereign territory consistently with the principle of self-determination? What if countries’ rights to territorial integrity were predicated on corresponding duties to govern well? And can the international system provide mechanisms and incentives to improve the status quo?
These questions are not simply academic. Across the world, many regions are located in the wrong nations—wrong in the sense that the people of these regions believe they would be safer, happier, and wealthier if surrounded by different borders and governed by different leaders. Such people might be able to improve their lot …

Siting Technology, Land-Use Energized, Steven Ferrey
Catholic University Law Review
Jurisdiction for the siting of electric power plants is vested in the fifty states, four territories, and thousands of local governments. Further complicating this scheme is federal government’s exclusive authority over certain transactions originating from these facilities. Against this backdrop of often divergent and conflicting laws, this article compiles a multijurisdictional review of the jurisdictional issues surrounding the regulation of electric power. Employing multiple state by state surveys, this paper compares electric power siting laws, the interactions between federal, state, and municipal authorities, and the mechanics of regulatory structures across the United States.

Tears In Heaven: Religiously And Culturally Sensitive Laws For Preventing The Next Pandemic, Eloisa C. Rodriguez-Dod, Aileen Maria Marty, Elena Maria Marty-Nelson
Catholic University Law Review
This Article argues that laws created to curtail the spread of deadly contagious diseases need to be drafted and implemented in ways that maximize acceptance of an affected communities’ cultural and religious beliefs. When laws are put in place that are inconsistent with community mores, the overall goal of stopping an epidemic is threatened. Communities often distrust government and other relief organizations who mandate rules and regulations that impinge their religious and cultural beliefs; thus, these regulations geared at helping communities can paradoxically undermine the goal of preventing the spread of infectious disease.
This Article focuses on the need for …
