3d Printing The Road Ahead: The Digitization Of Products When Public Safety Meets Intellectual Property Rights-A New Model, Shlomit Yanisky-Ravid, Kenneth S. Kwan

Cardozo Law Review

This Article addresses the threats of 3D printing to both the physical and legal world. Not only does 3D printing impact products protected by intellectual property rights, it also poses risk, threats, and challenges to many other regimes, including products governed by product liability and criminal laws, which consequently threatens public safety. 3D printing virtually possesses threats to medical devices and products, threats to legal and illegal drugs, threats to human organs, threats to the food industry, and to the transportation industry, including cars, trains, and aircrafts. Ultimately, 3D printing also threatens environmental protection, workplace protections, households, and even the …

Beyond Inclusion: Critical Race Theory And Participatory Budgeting, Celina Su Feb 2017

Beyond Inclusion: Critical Race Theory And Participatory Budgeting, Celina Su

Publications and Research

Critical Race Theory (CRT) researchers maintain that mainstream liberal discourses of neutrality and colorblindness inherently reify existing patterns of inequality, and that privileging the voices of people of color and the marginalized is essential to addressing issues of equity and equality. Participatory budgeting (PB) aims, too, to include the voices of the marginalized in substantive policy-making. Through a CRT lens, I examine the ways in which the New York City PB process has thus far worked to simultaneously disrupt and maintain racial hierarchies. I pay particular attention to how social constructions of the “good project” shape the discourses around community …

The Practical Dilemma And Improvement Path Of The Criminal Law Regulation Of Food Safety, Liu Xiaodan

Food and Machinery

At present, the crime of food producers is the main one in the food safety regulation system, and some crimes in food safety regulators as well as in transport and storage. However, There are still a series of dilemma about it, including the contrary to the trend of whole food safety process control, ignoring the public security character of food safety crime, and the neglect of its economic attribute of food safety crime. Therefore, we should increase the penalties according to the crime of endangering public safety and enforce the criminal law regulation. Furthermore, a severe fine penalty should be …

On Your First Day, President Trump, Please Repeal The Immunization Of Gun Sellers Act, Frank J. Vandall Jan 2017

On Your First Day, President Trump, Please Repeal The Immunization Of Gun Sellers Act, Frank J. Vandall

Emory Business Law Review

The purpose of this edition of the Emory Corporate Governance and Accountability Review is to suggest what needs to be done during the first few days of President Trump's new administration. The first act should be the repeal of the Protection in Lawful Commerce in Arms Act (PLCA) (2005). In essence this is a ban on suits against corporations that manufacture guns. Gun manufacturers are the experts and need to be brought into the gun safety debate. When at fault, they should be held liable.

Arbitrary Detention? The Immigration Detention Bed Quota, Anita Sinha Jan 2017

Arbitrary Detention? The Immigration Detention Bed Quota, Anita Sinha

Duke Journal of Constitutional Law & Public Policy

When President Obama took office in 2009, Congress through appropriations linked the U.S. Department of Homeland Security’s (DHS) funding to “maintaining” 33,400 immigration detention beds a day. This provision, what this Article refers to as the bed quota, remains in effect, except now the mandate is 34,000 beds a day. Since 2009, DHS detentions of non-citizens have gone up by nearly 25 percent. To accommodate for this significant spike over a relatively short period of time, the federal government has relied considerably on private prison corporations to build and operate immigration detention facilities.

This Article takes a comprehensive look at …
