Wasserman, Michael L. Dennis, Tisha Wiley, Faye S. Taxman, Carrie B. Oser, Richard Dembo, Angela A. Robertson, Jessica Sales

Sociology Faculty Publications

Overview—Substance use and substance use disorders are highly prevalent among youth under juvenile justice (JJ) supervision, and related to delinquency, psychopathology, social problems, risky sex and sexually transmitted infections, and health problems. However, numerous gaps exist in the identification of behavioral health (BH) problems and in the subsequent referral, initiation and retention in treatment for youth in community justice settings. This reflects both organizational and systems factors, including coordination between justice and BH agencies.

Methods and Results—This paper presents a new framework, the Juvenile Justice Behavioral Health Services Cascade (“Cascade”), for measuring unmet substance use treatment needs to …

Human Migration And Environmental Degradation: The Toll On Vulnerable Women And Children, Catherine Zeman, Mark Grey, Michele Devlin

UNIversitas: Journal of Research, Scholarship, and Creative Activity

The early years of the 21st Century have seen major changes in the world’s demographic profile. The world’s total population is currently just over seven billion. Middle-range projections by the United Nations Population Fund suggest the world’s population will grow to ten billion by about 2050 and about eleven billion at the end of the century. Higher and lower projections for the end of the 21st century are 16.5 billion and 7 billion respectively depending on trends in fertility rates, which in general are projected to decline. Global average fertility rates have also dropped from 4.5 children in 1970 to …

Reining In The Writ: Limiting The Seventh Circuit’S Discretion Under 28 U.S.C. § 2255 In Federal Death Penalty Cases, Jerrod H. Montgomery Mar 2017

Reining In The Writ: Limiting The Seventh Circuit’S Discretion Under 28 U.S.C. § 2255 In Federal Death Penalty Cases, Jerrod H. Montgomery

Southern Illinois University Law Journal

Bruce Webster was convicted in 1994 of the brutal rape and murder of an underage girl, as part of an ongoing drug operation.  Mr. Webster sought to overturn his death sentence under the Supreme Court’s decision in Atkins v. Virginia, which forbids the execution of persons with intellectual disabilities.  The issue of whether Mr. Webster is a person with intellectual disabilities was litigated at trial, and throughout the Fifth Circuit for nearly twenty years.  At every level, Mr. Webster’s contention was denied, and he was transferred to the federal death chamber in Terre Haute, Indiana.  Subsequently, under the jurisdiction …

Lessons From Ferguson On Individual Defense Representation As A Tool Of Systemic Reform, Beth A. Colgan Mar 2017

Lessons From Ferguson On Individual Defense Representation As A Tool Of Systemic Reform, Beth A. Colgan

William & Mary Law Review

This Article investigates the relationship between the decisions by lawmakers to use municipal and criminal systems to generate revenue and the lack of access to individual defense representation by using the Ferguson, Missouri, municipal court as a case study. The Article chronicles the myriad constitutional rights that were violated on a systemic basis in Ferguson’s municipal court and how those violations made the city’s reliance on the court for revenue generation possible. The Article also documents how the introduction of individual defense representation, even on a piecemeal basis, played a role in altering Ferguson’s system of governance. Using this case …

Big Budget Productions With Limited Release: Video Retention Issues With Body-Worn Cameras, Bradley X. Barbour Mar 2017

Big Budget Productions With Limited Release: Video Retention Issues With Body-Worn Cameras, Bradley X. Barbour

Fordham Law Review

Since 2013, there has been growing support for police body-worn cameras in the wake of several high-profile and controversial encounters between citizens and law enforcement. The federal government has justified budgetary measures funding body-worn camera programs as a means to facilitate trust between law enforcement and the public through the objectivity of video footage—a sentiment supported by many lawmakers advocating for implementation of this technology. These policy goals, however, are stymied by a deficiency of police department policies and state statutes regulating the retention of footage and close adherence of states to the precedent of Arizona v. Youngblood, which …

Updating The Social Network: How Outdated And Unclear State Legislation Violates Sex Offenders’ First Amendment Rights, Elizabeth Tolon Mar 2017

Updating The Social Network: How Outdated And Unclear State Legislation Violates Sex Offenders’ First Amendment Rights, Elizabeth Tolon

Fordham Law Review

Readily available on computers, phones, tablets, or television, social media has become a necessary platform of expression for many. But, for others, social media is an inaccessible tool whose very use has criminal repercussions. To protect innocent children, many states have enacted legislation restricting sex offenders’ access to social media. Unfortunately, this legislation is often outdated, overly restrictive, and unconstitutional under the First Amendment. North Carolina has recently attracted national attention, as its statute highlights the potential constitutional issues states face in drafting such legislation. To avoid the constitutional concerns that North Carolina faces, state legislators must draft statutes narrowly …

Engineering Cell-Free Protein Synthesis Technology For Codon Reassignment, Biotherapeutics Production Using Just-Add-Water System, And Biosensing Endocrine Disrupting Compounds, Sayed Mohammad Salehi

Theses and Dissertations

Cell-free protein synthesis is an emerging technology that has many applications. The open nature of this system makes it a compelling technology that can be manipulated to answer many needs that are unavailable in other systems. This dissertation reports on engineering this technology for: 1) sense codon emancipation for incorporation of multiple unnatural amino acids; 2) expressing a hard-to-express anticancer biotherapeutic and introducing a just-add-water system; 3) a biosensing ligand that interacts with nuclear hormone receptors. Emancipating sense codons toward a minimized genetic code is of significant interest to science and engineering. A promising approach to sense codon emancipation is …

Bellesiles’S Arming America Redux: Does The Gunning Of America Rewrite American History To Suit Modern Sensibilities?, Clayton E. Cramer Mar 2017

Bellesiles’S Arming America Redux: Does The Gunning Of America Rewrite American History To Suit Modern Sensibilities?, Clayton E. Cramer

Southern Illinois University Law Journal

Fifteen years ago, Michael Bellesiles’s Arming America was the darling of antigun intellectuals because it created an entirely new perception of the American relationship to guns.  It implicitly argued for a much narrower reading of the Second Amendment that was compliant with an America (then) that hated guns and did not own them.  Questions were soon raised about the accuracy of the statistics in Bellesiles’s articles and book, his honesty about where he researched documents, his widespread alteration of quotes, and his citations to documents that directly refuted his claims.  He rapidly went from tenured professor of history at Emory …

You’Ve Got Mail: Analyzing The Constitutionality Of Speeding Cameras In City Of Moline Acres V. Brennan, 470 S.W.3d 367 (Mo. 2015), Jennifer M. Lancaster

Southern Illinois University Law Journal

Municipalities are finding new ways to penalize drivers for violating traffic laws.  Throughout the United States, municipalities have increasingly used red light cameras and speeding cameras to issue citations.  Municipalities’ use of red light and speeding cameras has sparked litigation, resulting in countless plaintiffs filing suits to challenge the constitutionality of the ordinances.  The Missouri Court of Appeals previously addressed the constitutionality of red light cameras, but neither the Missouri Court of Appeals nor the Missouri Supreme Court has issued an opinion on a municipality’s use of speeding cameras.

This Note discusses the 2015 Missouri Supreme Court case, City of …

The Regulatory Framework For Aerial Imaging By Recreational Users Of "Drones" In Singapore: Old And Emerging Issues And Some Possible Solutions, Siyuan Chen Mar 2017

The Regulatory Framework For Aerial Imaging By Recreational Users Of "Drones" In Singapore: Old And Emerging Issues And Some Possible Solutions, Siyuan Chen

Research Collection Yong Pung How School Of Law

In response to the sudden proliferation of hobbyist unmanned aerial vehicles used for digital imaging – or “drones”, as they are popularly, but rather inaccurately, labelled – the Singapore government enacted the Unmanned Aircraft (Public Safety and Security) Act in 2015 and also amended various existing laws relating to air navigation. However, in view of the rapid evolution in drone technology and the ever-expanding range of useful applications brought about by drones, what are some of the challenges that would be faced when enforcing the law against recreational users of aerial imaging in particular, and what are some of the …

Unambiguous Deterrence: Ambiguity Attitudes In The Juvenile Justice System And The Case For A Right To Counsel During Intake Proceedings, Hannah Frank Mar 2017

Unambiguous Deterrence: Ambiguity Attitudes In The Juvenile Justice System And The Case For A Right To Counsel During Intake Proceedings, Hannah Frank

Vanderbilt Law Review

According to the traditional rational choice theory of criminal behavior, people choose to commit crimes in a rational manner.' They weigh the costs and benefits and make informed decisions to maximize their utility. Under this framework, the state can deter crime through two main avenues: increasing the probability of detection and increasing the punishment if caught, both of which increase the total cost of committing a crime. Recently, however, behavioral insights have begun to cast doubt on traditional rationality assumptions. Lab experiments and empirical studies using real-world data have shown that people exhibit bounded rationality. For example, individuals have limited …

Bail Nullification, Jocelyn Simonson Mar 2017

Bail Nullification, Jocelyn Simonson

Michigan Law Review

This Article explores the possibility of community nullification beyond the jury by analyzing the growing and unstudied phenomenon of community bail funds, which post bail for strangers based on broader beliefs regarding the overuse of pretrial detention. When a community bail fund posts bail, it can serve the function of nullifying a judge’s determination that a certain amount of the defendant’s personal or family money was necessary to ensure public safety and prevent flight. This growing practice—what this Article calls “bail nullification”—is powerful because it exposes publicly what many within the system already know to be true: that although bail …

Guns, Bird Feathers, And Overcriminalization: Why Courts Should Take The Second Amendment Seriously, George A. Mocsary, Gwu Law Rps Submitter, Robert J. Cottrol

Faculty Articles

Who should the state punish Why Should punishment be proportional This article surveys in the context of these fundamental criminallaw questions the Second Amendment's constitutional history and jurisprudence A vast body of evidence shows that the framers of both the Second and Fourteenth Amendments intended to protect the individual's right to keep and carry arms for protection against both governmental and private aggressionYet courts unwilling to allow disfavored groups the means of selfdefense or fearing being blamed for criminal firearm activity have failed to enforce the right to bear arms to any meaningful extent After the Civil War the US …
