Digging Deeper: Uncovering The Aftermath Of Kristin Smart’S Disappearance, Kailyn Pope Mar 2017

Digging Deeper: Uncovering The Aftermath Of Kristin Smart’S Disappearance, Kailyn Pope

Cal Poly's History: Student Research Reports

This paper will discuss two major components of past crimes at Cal Poly: the attentive student response to Kristin Smart’s 1996 disappearance in light of possible shortcomings of authorities, and how events such as these have shaped campus safety policies and regulations since the 1990s. Kristin Smart’s disappearance, as well as other criminal acts against students in the 1990s and beyond, brought the Cal Poly student community together in solidarity year after year with programs such as Take Back the Night. Even though the red handprints, indicators of areas in which someone had been sexually assaulted, have been removed from …

Terrorist Speech On Social Media, Alexander Tsesis Mar 2017

Terrorist Speech On Social Media, Alexander Tsesis

Vanderbilt Law Review

The presence of terrorist speech on the internet tests the limits of the First Amendment. Widely available cyber terrorist sermons, instructional videos, blogs, and interactive websites raise complex expressive concerns. On the one hand, statements that support nefarious and even violent movements are constitutionally protected against totalitarian-like repressions of civil liberties. The Supreme Court has erected a bulwark of associational and communicative protections to curtail government from stifling debate through overbroad regulations. On the other hand, the protection of free speech has never been an absolute bar against the regulation of low value expressions, such as calls to violence and …

The Federal Anti-Corruption Enterprise After Mcdonnell-Lessons From The Symposium, George D. Brown Mar 2017

The Federal Anti-Corruption Enterprise After Mcdonnell-Lessons From The Symposium, George D. Brown

Dickinson Law Review (1908-2003)

This article was presented at the Penn State Law Review's Symposium, Breach of the Public (Dis)Trust. The article examines the potential impact of the Supreme Court's unanimous decision in McDonnell v. United States. The analysis first focuses on a narrow reading of McDonnell, treating it as part of the Court's general approach to issues of statutory construction. However, there is a possible broader reading of McDonnell, which has the potential to be highly significant as applied to anticorruption prosecutions, federalism concerns, and the "criminalization of politics" critique. After examining a broader view of McDonnell, the article delves into whether the …

Preclusion And Criminal Judgment, Lee Kovarsky Mar 2017

Preclusion And Criminal Judgment, Lee Kovarsky

Notre Dame Law Review

The defining question in modern habeas corpus law involves the finality

of a state conviction: What preclusive effect does (and should) a criminal

judgment have? Res judicata and collateral estoppel —the famous preclusion

rules for civil judgments—accommodate basic legal interests in fairness,

certitude, and sovereignty. Legal institutions carefully calibrate the preclusive

effect of civil judgments because judicial resources are scarce, because

the reliability and legitimacy of prior process can vary, and because courts

wield the authority of a repeat-playing sovereign that will find its own civil

judgments attacked in foreign litigation. In stark contrast to the legal sophistication

lavished on …

Navigating Institutional Complexity: The Production Of Risk Culture In The Financial Sector, T Palermo, M Power, S Ashby Mar 2017

Navigating Institutional Complexity: The Production Of Risk Culture In The Financial Sector, T Palermo, M Power, S Ashby

Plymouth Business School

Following the financial crisis, financial sector organizations faced increased pressures to reform their ‘risk cultures’. In this paper, we argue that the emergence of regulatory and managerial attention to risk culture is symptomatic of pressures to redefine the fundamental ends of financial institutions and to rebalance the pre-crisis emphasis on a logic of opportunity and risk-taking with a logic of precaution and risk control. Based on the analysis of normative practitioner texts and on extended contact with regulators, advisers and corporate actors in the UK financial sector over four years, we show how this initial complexity of ends is translated …

The Case For State Attorney General Enforcement Of The Voting Rights Act Against Local Governments, Perry Grossman Mar 2017

The Case For State Attorney General Enforcement Of The Voting Rights Act Against Local Governments, Perry Grossman

University of Michigan Journal of Law Reform

The summer of 2016 showed that racial discrimination in voting is alive and well, as federal courts across the country struck down state statutes that disproportionately disenfranchise minority voters, including voter ID laws, restrictions on early voting, and racially gerrymandered legislative districts. However, at the local level, discriminatory practices in the nation’s approximately 89,000 political subdivisions have gone largely uninvestigated and challenged. Recent conflicts between communities of color and law enforcement have highlighted the failure of local governments in places like Ferguson, Missouri to adequately represent the interests of minority voters. These failures of representation, which occur in progressive states …

Analysis Of Autonomous Vehicle Policies, Bryan Gibson Mar 2017

Analysis Of Autonomous Vehicle Policies, Bryan Gibson

Kentucky Transportation Center Research Report

The rapid development and adoption of connected and autonomous vehicles will transform the U.S. transportation system over the next 30 years. Although the widespread use of fully connected and autonomous vehicles is still several years away, it is nonetheless critical that legislators, policymakers, and regulators understand how the presence of these vehicles will restructure the operation of roadway networks. Without a doubt, lawmakers and policymakers will need to develop new laws — and revise existing ones — to account for the presence of connected and autonomous vehicles. This report provides an overview of connected and autonomous vehicles — their positives …

"Clientless" Lawyers, Russell M. Gold Mar 2017

"Clientless" Lawyers, Russell M. Gold

Washington Law Review

Class counsel and prosecutors have a lot more in common than scholars realize. These lawyers have clients, but their clients are diffuse and lack a formal decisionmaking structure. Because of the nature of their clients, class counsel and prosecutors have to make decisions for their clients that one would ordinarily expect clients to make—and indeed that legal ethics rules would expressly require clients to make in other contexts—such as decisions concerning objectives of representation or whether to settle or plead guilty. Both complex litigation and criminal law scholars recognize that these lawyers’ self-interests diverge from their clients’ interests. But the …

Antitrust As Disruptive Innovation In Health Care: Can Limiting State Action Immunity Help Save A Trillion Dollars?, William M. Sage, David A. Hyman

On February 25, 2015, the United States Supreme Court ruled in North Carolina State Board of Dental Examiners v. FTC that state licensing boards controlled by market participants are subject to federal antitrust law unless they are “actively supervised” by the state itself. The ruling may sound narrow and technical, but the significance of the case can be inferred from the number and prominence of the amici curiae who lined up to support the North Carolina State Board of Dental Examiners (“North Carolina Board”)—first when the Federal Trade Commission’s (“FTC”) internal enforcement action was appealed to the United States Court …
