Illiberal Immigration Inconsistencies: Finding Unifying Principles On The Left, Sheldon Evans

Saint Louis University Law Journal

Immigration is one of the most important issues on the minds of Americans. While conservative lawmakers have rallied around the exclusionary principles of Donald Trump’s vision for America, liberal politicians have struggled to provide a unified ideological and pragmatic policy alternative. This Essay challenges that lack of identity from the political Left. By studying several inconsistencies among Democrats, I argue for realignment strategies to unify the Party to return to its traditional principles on immigration policy. These include addressing the underlying social problems causing migration, rethinking border control, providing legal pathways for immigrants, and moving towards global citizenship.

During both its first and second terms, the Trump Administration has taken aim at so-called “sanctuary” jurisdictions to try to encourage or force cooperation with federal immigration law enforcement. In addition to targeted immigration enforcement efforts, the Administration has waged a legal and public media campaign against states, counties, and cities that the Administration views as sanctuary jurisdictions and has attempted to withhold a wide variety of federal funds from those jurisdictions to pressure them to change their policies. Background/Significance

Out-of-hospital cardiac arrest (OHCA) is a sudden, life-threatening emergency that can occur anywhere and to anyone. In 2023, the American Heart Association identified OHCA as a public health crisis, with survival rates around 10%. Outcomes depend heavily on rapid intervention, as each minute without cardiopulmonary resuscitation (CPR) significantly reduces survival. Mobile phone–based alert systems help bridge the gap between collapse and emergency medical services (EMS) arrival by notifying nearby trained responders. In a county in the Northeast, PulsePoint Respond serves this role. However, despite 1,302 registered responders as of November 2025, only 7 registered nurses were enrolled, highlighting an …

In 2021, James and Jennifer Crumbley became the first parents in the United States to be found guilty of involuntary manslaughter in connection with their son’s school shooting that killed four people and injured multiple others. As school shootings continue to devastate communities across the country, prosecutors are increasingly holding parents criminally liable for their children’s actions. This development raises fundamental questions about justice, accountability, and the limits of criminal liability. While these laws aim to curb gun violence by enforcing parental accountability, they will disproportionately affect marginalized communities, particularly along gender, racial, and socioeconomic lines. Kalief Browder’s name endures as a chilling reminder of the human cost of pre-trial solitary confinement. His story reveals the constitutional paradox and moral failure at the heart of this practice: Individuals who remain legally innocent are subjected to one of the harshest punishments the state can impose. This practice strips people of their liberty twice over, first through incarceration itself, and again through prolonged isolation that inflicts devastating psychological harm. Artificial Intelligence (AI) is being used by governments across the world to enforce regulatory mandates, adjudicate benefits and privileges, predict and analyze risks, and much more. Although this has significant potential to increase efficiency and responsiveness, it also comes with several risks of transparency, government accountability, and the amplification of discrimination and bias. For nearly thirty years, the legal framework for analyzing liability for claims of tortious wrongdoing on the Internet has been governed by Section 230 of the Communications Decency Act (“CDA”). However, much has changed since the Act’s inception. Since Congress enacted the CDA, courts have interpreted its provisions far beyond their original meaning, creating a regime that ultimately destroys a prospective plaintiff’s ability to recover the equitable remedies once available to those seeking redress for online invasions of privacy and reputational harms.

This article explores the challenges of regulating AI and ML clinical decision support tools intended to assist trained health care professionals in delivering clinical care. Two old, twentieth-century regulatory models have dominated discussions of medical AI policy since 2013. Thinking inside these old regulatory boxes has not produced effective regulatory solutions to address the novel risks AI poses in clinical care. The White House recently announced its vision of artificial intelligence (AI) policy: AI development is a race and America must win it. To that end, a new America’s AI Action Plan directs federal agencies and states to remove regulatory barriers to AI development and accelerate innovation. This approach leaves limited room for regulatory measures that would address the safety risks of powerful AI systems: their behavior in novel domains remains unpredictable, their decision-making opaqueness, and their alignment with human values is uncertain.
