Lawyers Going Bare And Clients Going Blind, Leslie C. Levin
Lawyers Going Bare And Clients Going Blind, Leslie C. Levin
Florida Law Review
Many U.S. lawyers “go bare” and represent clients without maintaining malpractice insurance. Efforts to require these lawyers to carry lawyer professional liability (LPL) insurance have mostly foundered, due to bar opposition and concerns about the cost of insurance. As a compromise between protecting the public and protecting lawyers’ interests, many states now require lawyers to disclose whether they carry LPL insurance to clients, regulators, or both. This Article draws on survey data from Arizona, Connecticut and New Mexico lawyers that shed light on which lawyers go bare and the reasons why they do so. The Article then looks at states’ …
The Rise Of Systematic Pre-Exclusion Delay: Proposing A Solution To Decades On Death Row, Krista Mackay
The Rise Of Systematic Pre-Exclusion Delay: Proposing A Solution To Decades On Death Row, Krista Mackay
Florida Law Review
Although the claim that death row inmates’ pre-execution delays violate the Eighth Amendment has been historically unsuccessful, the decision in Jones v. Chappell paved a new path to its success. In Jones, despite the Ninth Circuit’s disagreement, a federal judge in California became the first to rule that systematic delay has rendered California’s death penalty system unconstitutional. The court in Jones defined systematic delay as delay inherent to the state’s dysfunctional administration of the death penalty. Due to increasing pre-execution delays nationwide and recent initiatives to examine and repeal state death penalty systems, other state courts may soon come …

Procedural Justice For Youth: Discrepancies In The Provision Of Defense Counsel For Youth In The Juvenile Justice System, Emily K. Pelletier
Procedural Justice For Youth: Discrepancies In The Provision Of Defense Counsel For Youth In The Juvenile Justice System, Emily K. Pelletier
Dissertations, Theses, and Capstone Projects
Youth in the juvenile justice system experience racially disparate outcomes at all contact points throughout the system process, despite race-neutral state policies governing the juvenile justice system. States provide defense counsel for indigent youth in the juvenile justice system through policies containing race-neutral language; however, each state maintains different policies protecting youth rights to defense counsel. This study questions the relationships among state policies protecting youth rights to defense counsel, racially disparate outcomes for youth in the juvenile justice system, and state socioeconomic and racial composition. The study relies on content analysis to transform qualitative state policies into quantitative data …

Why Can't We Be Friends? A Business Finance Lawyer's Plaintive Plea To Entrepreneurs, Joan Macleod Heminway
Scholarly Works
Entrepreneurs have the capacity to add value to the economy and the community. Business lawyers — including business finance lawyers — want to help entrepreneurs achieve their objectives. Despite incentives to a symbiotic relationship, however, entrepreneurs and business finance lawyers are not always the best of friends. This symposium piece offers several approaches to bridging this gap between entrepreneurs and business finance lawyers.

The Criminal Mind: Neuroscientific Evidence As A Mitigating Factor In Sentencing In New South Wales, Australia, Ellie A. Page
The Criminal Mind: Neuroscientific Evidence As A Mitigating Factor In Sentencing In New South Wales, Australia, Ellie A. Page
Washington International Law Journal
“Neurolaw” is the emerging field of Law and Neuroscience that has the potential to lend insight into an offender’s mental state and influence criminal responsibility. In New South Wales, Australia, courts allow neuroscientific evidence of an offender’s cognitive impairment as a consideration in sentencing proceedings. In this comment, I discuss the discretionary nature of New South Wales’ sentencing regime and the limitations of how neuroscience may be utilized within that regime. Although neuroscientists can address the association of an offender’s cognitive impairment with the commission of a crime, they cannot identify, with certainty, a causal relationship. I analyze an original …

A Case Against Collaboration, Rachel Rebouché
A Case Against Collaboration, Rachel Rebouché
Maryland Law Review
In family law, as in other legal disciplines, the use of alternative dispute resolution has dramatically increased. In a process called collaborative divorce, separating spouses hire attorneys who agree to work together—almost entirely outside of the court system—to reach a settlement ending the marriage. A team of experts, including mental health professionals, financial neutrals, and parenting coordinators, helps the parties resolve conflicts and settle property, support, and custody disputes. For divorcing couples, the collaborative process promises emotional healing and avoidance of contentious litigation. Advocates for collaborative divorce describe the transformational effects of the process in an evangelical tone.
But collaborative …
Lessons Learned From Community-Based Participatory Research: Establishing A Partnership To Support Lesbian, Gay, Bisexual And Transgender Aging-In-Place., Diane King
Reports
BACKGROUND: Due to a history of oppression and lack of culturally competent services, lesbian, gay, bisexual and transgender (LGBT) seniors experience barriers to accessing social services. Tailoring an evidence-based ageing in place intervention to address the unique needs of LGBT seniors may decrease the isolation often faced by this population. OBJECTIVE: To describe practices used in the formation of a community-based participatory research (CBPR), partnership involving social workers, health services providers, researchers and community members who engaged to establish a LGBT ageing in place model called Seniors Using Supports To Age In Neighborhoods (SUSTAIN). METHODS: A case study approach was …

Precarious employment is increasing in Ontario. A growing share of Ontario’s private sector employees earns low wages while a shrinking portion belongs to unions. These trends are fueled by changes in the structure of Ontario’s labour force. In many industries, including accommodation and food services, administrative services, and cleaning, workplaces are being transformed through greater use of contracting out, franchising, and extended supply chains. These ways of structuring work contribute to driving working conditions downward.
Anything But Common: New York's "Pending Or Anticipated Litigation" Limitation To The Common Interest Doctrine Creates More Problems Than It Solves, Eric A. Franz
Washington Law Review
New York’s highest court recently handed down Ambac v. Countrywide, a decision that has major ramifications in the mergers and acquisitions (M&A) world. Once parties sign a merger or acquisition agreement, they share a common interest in ensuring that both parties comply with applicable laws, a process that requires legal communications with each other’s attorneys. Under the common interest doctrine, Delaware and the majority of federal circuits apply the attorney-client privilege to shield many of these communications from discovery. However, Ambac upset M&A attorneys’ reliance on the common interest doctrine by holding that parties to a merger waive their …
