Consumer Litigation Funding: Just Another Form Of Payday Lending?, Paige Marta Skiba, Jean Xiao Jun 2017

Consumer Litigation Funding: Just Another Form Of Payday Lending?, Paige Marta Skiba, Jean Xiao

Vanderbilt Law School Faculty Publications

This article provides a side-by-side comparison of payday lending and consumer litigation funding in order to aid policymakers. Funding has similarities with payday lending because they are both alternative financial services, involve high interest rates, and cater to customers who need money for living expenses. However, they differ in ways that regulators should recognize. Many justify bans on payday lending by pointing to the fact that millions of borrowers every year are getting stuck in an inescapable cycle of interest payments. While legal finance has real costs, funding’s nonrecourse nature prevents consumers from getting stuck in a cyclical repayment of …

Post-Adoptive Services' Impact On Adoption Outcomes, Sarah E. Cantino

Electronic Theses, Projects, and Dissertations

Adoption is a common occurrence within the field of social work, yet adoptees and their adoptive parents grapple with a multitude of challenges unique to this population. The needs of these children and families are continually scrutinized by social service professionals prior to adoption, but less is known of the needs and services available to this population after adoption is finalized. This study addressed the question: Does adoptive families’ use of post-adoptive resources increase positive adoption outcomes? Ten adoptive parents participated in semi-structured interviews as part of this study. Most participants felt they had access to adequate services, and struggled …

Class Action Settlements, Cy Pres Awards, And The Erie Doctrine, Andrew Rodheim Jun 2017

Class Action Settlements, Cy Pres Awards, And The Erie Doctrine, Andrew Rodheim

Northwestern University Law Review

As class action settlement funds become more and more prevalent, cy pres awards have become a more common means of providing relief to absent class members. The primary purpose of cy pres awards is to provide a second-best form of relief when it is deemed impossible to directly compensate individual plaintiffs. Most often, these cy pres awards are given to some kind of charitable organization. Under federal law, class action settlements and cy pres awards are governed by Federal Rule of Civil Procedure 23(e). Rule 23(e)(2) requires all class action settlements to be “fair, reasonable, and adequate,” but provides no …

Injustice Under Law: Perpetuating And Criminalizing Poverty Through The Courts, Judge Lisa Foster May 2017

Injustice Under Law: Perpetuating And Criminalizing Poverty Through The Courts, Judge Lisa Foster

Georgia State University Law Review

Money matters in the justice system. If you can afford to purchase your freedom pretrial, if you can afford to immediately pay fines and fees for minor traffic offenses and municipal code violations, if you can afford to hire an attorney, your experience of the justice system both procedurally and substantively will be qualitatively different than the experience of someone who is poor. More disturbingly, through a variety of policies and practices—some of them blatantly unconstitutional—our courts are perpetuating and criminalizing poverty. And when we talk about poverty in the United States, we are still talking about race, ethnicity, and …

Forty-Eight States Are Probably Not Wrong: An Argument For Modernizing Georgia’S Legal Malpractice Statute Of Limitations, Ben Rosichan May 2017

Forty-Eight States Are Probably Not Wrong: An Argument For Modernizing Georgia’S Legal Malpractice Statute Of Limitations, Ben Rosichan

Georgia State University Law Review

The legal profession is largely self-regulated, and each state has a bar association charged with creating and enforcing basic standards of professionalism and competence for attorneys. Unfortunately, attorneys do not always adhere to these standards. In Georgia, the State Bar can address attorney misconduct through remedial measures up to and including disbarment. The State Bar cannot, however, compensate wronged clients through monetary damages. Thus, some wronged clients must resort to a lawsuit for legal malpractice where a financial recovery is necessary to make the client whole again.

The statute of limitations for legal malpractice claims should not be so restrictive that …

The Impact Of Housing Insecurity On Community Health Outcomes: Exploring Collective Community Solutions And Housing Models In The Western Addition, Jacqueline V. Brown, Jacqueline Victoria Brown May 2017

The Impact Of Housing Insecurity On Community Health Outcomes: Exploring Collective Community Solutions And Housing Models In The Western Addition, Jacqueline V. Brown, Jacqueline Victoria Brown

Master's Projects and Capstones

In a city where housing is scarce and prices continue to rise, the lower income residents of the Western Addition are in panic. Historically, the Western Addition/Fillmore is ground zero for Urban Renewal. This community is still bouncing back from the negative effects of the out migration of Black residents, Japanese internment, and rapid gentrification. For twenty years, this part of the city was known as Harlem of the West due to its world-renowned Jazz and Blues composers, and is informally known as “Tha ‘Mo”. San Francisco has set the tone nationally for public, mixed income, and private housing that …

Schools In Rural Alaska With Higher Rates Of Student Achievement: A Search For Positive Deviance In Education, Melissa M. Hill

Interdisciplinary Studies

This study sought to identify schools in rural Alaska with higher rates of student achievement and study what factors contribute to that success. Alaska Native students make up a large majority of the students attending school in small remote villages across the state. Data, however, have shown that Alaska Native students constantly perform lower than any other demographic group on every subject level and lower at every grade level when tested using state assessments. This study begins with a journey to understand the complexity of the problems that affect schooling in rural Alaska, ranging from teacher turnover to school district …

General Counsel Characteristics And Financial Reporting Quality, John R. Sparger May 2017

General Counsel Characteristics And Financial Reporting Quality, John R. Sparger

Doctor of Business Administration Dissertations

The general counsel (GC) plays a key role in a firm’s financial reporting system as a participant and governance monitor. As a participant in various disclosure and filing processes and advisor in transactional activities reflected in the firm’s reported results, the GC directly influences a firm’s reported results and disclosures. As a governance monitor, the GC holds a position of public trust and duty to investors based on various laws, rulings and regulations. Accordingly, accounting literature has begun to examine the role of the GC in financial reporting quality. The results of this research have produced conflicting results which indicate …
