Minor Protections: Best Practices For Representing Child Migrants, Laila L. Hlass
Minor Protections: Best Practices For Representing Child Migrants, Laila L. Hlass
New Mexico Law Review
In recent years, the number of Central American children fleeing violence and seeking protection in the United States has surged, and these children’s cases have flooded the immigration courts. Children are treated virtually the same as adults in immigration court, and, because they are not provided government-appointed counsel, many must defend themselves from deportation pro se. In 2014, 80% of children—roughly 34,130—were unrepresented, and this lack of representation often has profound consequences: many of these children are eligible for protection from deportation, but, without access to attorneys, most will be deported anyway. Governments, nonprofits, and child advocates have taken action …
Between A Rock And An Ethical Duty: Attorney Obligations Under The Reporting Requirement Of New Mexico’S Abuse And Neglect Act, Kirsten Dick
Between A Rock And An Ethical Duty: Attorney Obligations Under The Reporting Requirement Of New Mexico’S Abuse And Neglect Act, Kirsten Dick
New Mexico Law Review
Every person in New Mexico has a statutory duty to report known or suspected child abuse or neglect to the proper authorities. Does this duty extend to attorneys who have their own set of ethical rules prohibiting disclosure of confidential client information? In State v. Strauch, the New Mexico Supreme Court held that the “every person” language of the Abuse and Neglect Act extends the mandatory duty to report to all persons, not just those professionals who work most frequently with children and are enumerated in the statute. This interpretation spurs an analysis of the interplay among the attorney-client privilege, …
To Discipline Or Not To Discipline: A Framework For New Mexico To Analyze The Ethics Of Medical Marijuana Representation, Jesse Montoya
To Discipline Or Not To Discipline: A Framework For New Mexico To Analyze The Ethics Of Medical Marijuana Representation, Jesse Montoya
New Mexico Law Review
What are lawyers to do when their obligations to clients conflict with their obligations to the law? How are state ethics systems expected to manage conflicting obligations to state and federal law? This article explores the ethical conundrum of medical marijuana representation in New Mexico. The New Mexico advisory ethics opinion counseled lawyers to avoid “assisting” medical marijuana businesses, but did not clarify what type of conduct qualified as “assistance.” In addition, the New Mexico Supreme Court refused to adopt Rule 16-102(E), which would have carved an exception in the New Mexico Rules of Professional Conduct for assistance of medical …

Deepening Lawyer Role Education To Serve Students And Society, Deborah Weimer
UC Law SF International Law Review
The last decade has seen an increase in focus on the plight of the unrepresented, as well as a recognition that these needs are growing dramatically. In 2006, the American Bar Association formally adopted a resolution calling for the provision of counsel to low income individuals in cases involving shelter, sustenance, safety, health and child custody. The ABA recognized the social costs in each of these areas when counsel is not available.
The Impact Of Global Developments On U.S. Legal Ethics During The Past Thirty Years, Laurel S. Terry
The Impact Of Global Developments On U.S. Legal Ethics During The Past Thirty Years, Laurel S. Terry
Faculty Scholarly Works
This Essay is written to commemorate the thirtieth anniversary of the Georgetown Journal of Legal Ethics. After exploring what the world of legal ethics looked like thirty years ago, this Essay analyzes how global developments have affected U.S. lawyer regulation and legal ethics dialogue since that time. It does so in several different ways. It begins by analyzing the growth pattern of articles publised in the Georgetown Journal of Legal Ethics that have addressed or been influenced by global developments. The Essay continues by identifying global societal developments, global legal developments, and global dialogue that have contributed to the …

We will never have enough lawyers to serve the civil legal needs of all low- and moderate-income (LMI) individuals who must navigate civil legal problems. A significant part of the access-to-justice toolkit must include self-help materials. That much is not new; indeed, the legal aid community has been actively developing pro se guides and forms for decades. But the community has hamstrung its creations in two major ways: first, by focusing these materials almost exclusively on educating LMI individuals about formal law, and second, by considering the task complete once the materials have been made available to self-represented individuals. In …

Do You Believe In Magic?: Self-Determination And Procedural Justice Meet Inequality In Court-Connected Mediation, Nancy A. Welsh
Do You Believe In Magic?: Self-Determination And Procedural Justice Meet Inequality In Court-Connected Mediation, Nancy A. Welsh
Faculty Scholarship
Proponents of the “contemporary mediation movement” promised that parties would be able to exercise self-determination as they participated in mediation. When courts began to mandate the use of mediation, commentators raised doubts about the vitality of self-determination. Though these commentators also suggested a wide variety of reforms, few of their proposals have gained widespread adoption in the courts.
Ensuring the procedural justice of mediation represents another means to ensure self-determination. If mediation provides parties with the opportunity to exercise voice, helps them demonstrate that they have considered what each other had to say, and treats them in an even-handed and …

Supporting Mothers With Mental Illness: Postpartum Mental Health Service Linkage As A Matter Of Public Health And Child Welfare Policy, Jesse Krohn, Msed, Jd, Meredith Matone, Drph, Mhs
Journal of Law and Health
Through our work in youth advocacy as, respectively, legal and public health professionals, we are all too aware of the high levels of health care fragmentation experienced during pregnancy and postpartum by poor, young mothers of color. Meredith Matone’s research highlights the heightened risk of fragmentation for girls with histories of child welfare involvement. For example, she found that 66.7% of young mothers who had resided in out-of-home placements and who had taken antipsychotic medication prior to becoming pregnant failed to fill prescriptions for antipsychotics in their first postpartum year. Put another way, two-thirds of these vulnerable young mothers—a far …
“We Like Mexican Laborers Better”: Citizenship And Immigration Policies In The Formation Of Puerto Rican Farm Labor In The United States, Ismael Garcia-Colon
“We Like Mexican Laborers Better”: Citizenship And Immigration Policies In The Formation Of Puerto Rican Farm Labor In The United States, Ismael Garcia-Colon
Publications and Research
This paper examines how colonialism and immigration policies define the citizenship of Puerto Rican farmworkers in relation to the immigration policies of guestwork. The Jones Act created in practice an ambiguous status for Puerto Rican migrants by granting U.S. citizenship to colonial subjects in a time when citizenship still meant being White and Anglophone. In addition, the importation of Mexican braceros tended to shape people’s perceptions of farmworkers as “foreign.” Puerto Ricans were and are constantly asked, challenged, and suspected by mainstream society of being “illegal aliens.” These perceptions had a lasting effect through World War II, the H-2 Program, …

Current Patterns Of Ownership And Usage Of Mobile Technology In Older Adults, Karen E. Cottle
Current Patterns Of Ownership And Usage Of Mobile Technology In Older Adults, Karen E. Cottle
Theses and Dissertations
The older generation is growing at a rate surpassed only by the speed at which mobile technology is advancing. Technology has become so ubiquitous in daily life, that most older people have done their best to adopt it. The purpose of this study was to explore the older adult (>50 yrs.) learner's everyday approach to and regard for mobile technology. Paper surveys were distributed by hand to four geographically diverse audiences. Each audience was composed of a minimum of 20 adult learners of each gender across three age groups, accounting for 160 individual older adults in all. Returned survey …

Joint And Several Liability Of Competition Law Infringers In The Legislation Of Central And Eastern European Member States, Péter Miskolczi Bodnár, Robert Szuchy
Yearbook of Antitrust and Regulatory Studies
The study reviews the provisions of the Directive by, first, presenting its general rule – joint and several liability – and then its two exceptions, pointing out that albeit they contain similar solutions, these have different reasons in the case of leniency applicants obtained immunity from fines and small and medium-sized enterprises. The study examines whether the 11 CEE Member States prescribe joint and several liability, in principle, to cases where multiple persons cause harm jointly by an infringement of competition law. The study also analyses the position of an immunity recipient in national laws. During the examination, the study …

Creative businesses are one of the models of economic development and one of the main drivers of local and regional development. The core of this model is entrepreneurial activity. This article attempts to draw attention to the need for creating a model of the creative sector and the cultural sector for rural areas (suburban, intermediate, peripheral areas) in the light of an intensifying tendency of population migration from cities to the countryside and changes in the awareness about the quality of life and work. This model has its specific features, as opposed to the model preferred for cities. This is …

Cross-Border E-Commerce – Myth Or Reality. Review Of Major Harmonisation Efforts, Bartosz Targański, Anna Mokrysz-Olszyńska
Studia i Materiały Wydział Zarządzania Uniwersytet Warszawski
The goal of the article is to review selected initiatives on harmonising the legal framework for international e-commerce. The article focuses on the achievements of two institutions with the greatest achievements in the field of harmonisation of the rules of international trade, i.e. the United Nations Commission on International Trade Law (UNCITRAL) (global dimension) and the European Commission (regional level of the European Union). Taking up this issue is justified by the fact that in spite of the dynamic increase in the absolute number of e-commerce transactions, a vast majority of them are domestic transactions within particular countries. In order …
