English Drama For Critical Pedagogy : Adapting Caryl Churchill’S Dramas As A Methodological Tool For Community-Engaged Theatre Workshopping In Post-Umbrella Movement Hong Kong, Hsiao Min Yu
Lingnan Theses
Tertiary-level drama is often condescendingly perceived in Hong Kong as either vocational or leisure-related, and tends to be marginalized in many – though not all – curricula as an activity for extra-curricular inter-university competition. This research aims at re-imagining Drama and Community Theatre as a critical pedagogy in promoting community culture. The aim of the research project is to strengthen the social functions of drama as community experience and as a tool for empowerment in the ‘glocal’ sociopolitical context of today. The study examines the methodology of a semi-scripted, community-engaged, theatre workshopping initiative with scenes adapted from Caryl Churchill’s plays, …

Doctoral Scholarship Examined: A Study Of Strategy Research In Education Settings Conducted By Students Seeking Degrees From Doctoral Programs In Education In The United States, Joseph M. Hearl Jr
Seton Hall University Dissertations and Theses (ETDs)
Abstract
The purpose of this study was to explore and describe strategy-related dissertations in education doctoral programs in the United States. Using content analysis, dissertations published from 2005 to 2014 were classified into two time periods. Time-period 1 ranged from 2005 through 2009. During this period, the EdD degree was differentiated from the PhD degree in doctoral programs in the field of education. Time-period 2 included the years from 2010 through 2014 and was marked by the awarding in 2014 of a grant to the Carnegie Project for Education Doctorate (CPED) Initiative to document the success of a four-year effort …

Identification And Genetic Characterization Of Antimicrobial Activities Of Pseudomonas Mississippiensis, A Novel Bacterial Species Isolated From Soybean Rhizosphere, Jiayuan Jia
Theses and Dissertations
An aerobic, Gram-negative, rod shaped and polarlagellated bacterium, designated strain MS586, was isolated from soybean rhizosphere in Mississippi. The taxonomic position of MS586 was determined using a polyphasic approach. Analysis of the housekeeping genes supported the novel position of MS586. The results were also supported by average nucleotide identity (ANI) values. Based on these data, it is proposed that strain MS586 represents a novel species, Pseudomonas mississippiensis, within the genus Pseudomonas. The type strain is MS586. Strain MS586 showed a broad-spectrum of antimicrobial activity against plant pathogenic bacteria and fungi that are economically important in agriculture. Preliminary studies using transposon-based …

Relationships Between Information Technology Skills And Performance Evaluation Scores Of Mississippi State University Extension Service Agents, James R. Loper
Theses and Dissertations
A study was conducted to see if the level of use, expertise, and problem solving abilities using information technology among Mississippi State University Extension agents was positively correlated with the performance quality of the agent as measured in the Mississippi State University Extension Service agent evaluation system. A second purpose was to examine how well agents self-assess their technology skills. Lastly, the study attempted to determine if there was a set of factors (including information technology skills) that explained a substantial portion of the variation in performance evaluation scores. The results showed that the Mississippi State University Extension agent evaluation …
Spatial And Trophic Niche Specialization In Castor Canadensis, Robert Antonio Francis
Spatial And Trophic Niche Specialization In Castor Canadensis, Robert Antonio Francis
Theses and Dissertations
The Hutchinsonian niche is the n dimensional hyper volume that allows for the persistence of a species. Castor canadensis, a large semi-aquatic rodent, is an ecosystem engineer and often a keystone species for many ecosystems. I examined the effect of multiple spatial scales on hierarchical habitat selection byC. canadensis using presence-only modeling techniques. I also determined individual trophic niche specialization in C. canadensis utilizing stable isotope analysis. I concluded that C. canadensis displayed scale independent habitat selection when comparing landscape and fine spatial scales. Individual trophic niche specialization occurred in colonies of the same resource availability. Also, individual trophic niches …

Controls On The Early Holocene Collapse Of The Bothnian Sea Ice Stream, Cc Clason, Sl Greenwood, N Selmes, Jm Lea, Et Al
School of Geography, Earth and Environmental Sciences
New high‐resolution multibeam data in the Gulf of Bothnia reveal for the first time the subglacial environment of a Bothnian Sea Ice Stream. The geomorphological record suggests that increased meltwater production may have been important in driving rapid retreat of Bothnian Sea Ice during deglaciation. Here we apply a well‐established, one‐dimensional flow line model to simulate ice flow through the Gulf of Bothnia and investigate controls on retreat of the ice stream during the post‐Younger Dryas deglaciation of the Fennoscandian Ice Sheet. The relative influence of atmospheric and marine forcings are investigated, with the modeled ice stream exhibiting much greater …

How Understanding The Nature Of Corporate Norms Can Prevent Their Destruction By Settlements, James D. Cox
How Understanding The Nature Of Corporate Norms Can Prevent Their Destruction By Settlements, James D. Cox
Duke Law Journal
Scholars have long celebrated the importance of norms in corporate law. Indeed, norms likely guide corporate actors more than the omnipresent threat of shareholder suits. This Article divides corporate norms into two distinct groups: aspirational norms and arbiter norms. Aspirational norms announce socially desirable objectives for corporate managers and encourage certain disclosure practices; arbiter norms identify distinct transactions for closer scrutiny by an independent body, the court. This Article shows that even though aspirational norms and arbiter norms serve different objectives, they share a common characteristic—overbreadth. This feature exists whether the norm is set forth by statute or found in …
Adaptive Financial Regulation And Regtech: A Concept Article On Realistic Protection For Victims Of Bank Failures, Lawrence G. Baxter
Adaptive Financial Regulation And Regtech: A Concept Article On Realistic Protection For Victims Of Bank Failures, Lawrence G. Baxter
Duke Law Journal
Frustrated by the seeming inability of regulators and prosecutors to hold bank executives to account for losses inflicted by their companies before, during, and since the financial crisis of 2008, some scholars have suggested that private-attorney-general suits such as class action and shareholder derivative suits might achieve better results. While a few isolated suits might be successful in cases where there is provable fraud, such remedies are no general panacea for preventing large-scale bank-inflicted losses. Large losses are nearly always the result of unforeseeable or suddenly changing economic conditions, poor business judgment, or inadequate regulatory supervision—usually a combination of all …
The Role Of Blue Sky Laws After Nsmia And The Jobs Act, Rutheford B. Campbell Jr.
The Role Of Blue Sky Laws After Nsmia And The Jobs Act, Rutheford B. Campbell Jr.
Duke Law Journal
State securities laws—in particular, state laws requiring that securities offered by issuers be registered with the states—have been an impediment to the efficient movement of capital to its highest and best use. The pernicious effects of these laws—generally referred to as “blue sky laws”—have been felt most acutely by small businesses, a vital component of our national economy.
It has been difficult to remedy this problem. States and state regulators have been tenacious in protecting their registration authority from federal preemption. The Securities and Exchange Commission, on the other hand, has been reluctant to advocate for preemption and unwilling to …
The Knowledge Gap In Workplace Retirement Investing And The Role Of Professional Advisors, Jill E. Fisch, Tess Wilkinson-Ryan, Kristin Firth
The Knowledge Gap In Workplace Retirement Investing And The Role Of Professional Advisors, Jill E. Fisch, Tess Wilkinson-Ryan, Kristin Firth
Duke Law Journal
The dramatic shift from traditional pension plans to participant-directed 401(k) plans has increased the obligation of individual investors to take responsibility for their own retirement planning. With this shift comes increasing evidence that investors are making poor investment decisions.
This Article seeks to uncover the reasons for poor investment decisions. We use a simulated retirement investing task and a new financial literacy index to evaluate the role of financial literacy in retirement investment decisionmaking in a group of nonexpert participants. Our results suggest that individual employees often lack the skills necessary to support the current model of participant-directed investing. We …

Detecting Good Public Policy Rationales For The American Rule: A Response To The Ill-Conceived Calls For “Loser Pays” Rules, Peter Karsten, Oliver Bateman
Duke Law Journal
Several critiques have been leveled at the American Rule—that is, the rule that each party to a lawsuit should pay for its attorneys. Some claim that there were no principled justifications offered by the nineteenth-century jurists who authored the opinions marking the rule’s origins. Instead, these jurists only cited their states’ “taxable costs” statutes. Others claim that the American Rule—as well as its close relative, the contingency-fee contract—contributed to a “liability explosion” in that century. This Article offers a comprehensive examination of the origins of, rationales given for, and impact of the American Rule; then it evaluates instances in which …

Department of Pathology, Anatomy, and Cell Biology Faculty Papers
The relevance of mitochondrial phosphate carrier (PiC), encoded by SLC25A3, in bioenergetics is well accepted. However, little is known about the mechanisms mediating the cellular impairments induced by pathological SLC25A3 variants. To this end, we investigated the pathogenicity of a novel compound heterozygous mutation in SLC25A3 First, each variant was modeled in yeast, revealing that substituting GSSAS for QIP within the fifth matrix loop is incompatible with survival on non-fermentable substrate, whereas the L200W variant is functionally neutral. Next, using skin fibroblasts from an individual expressing these variants and HeLa cells with varying degrees of PiC depletion, PiC loss of …

This Article explores the historical development of the academic analysis of corporate law over the past forty years through the scholarship of one of its most influential commentators, Professor James D. Cox of the Duke University School of Law. It traces the ways in which corporate law scholarship changed from the 1970s to the present, including the rise of economic theory and empirical work in the study of corporate law. It shows how Professor Cox’s early scholarship shaped and challenged economic orthodoxy, while his later work used empirical analysis to help corporate law become a more dynamic and richer field. …
Using The False Claims Act To Remedy Tax-Expenditure Fraud, Ian Ayres, Robert Mcguire
Using The False Claims Act To Remedy Tax-Expenditure Fraud, Ian Ayres, Robert Mcguire
Duke Law Journal
The federal False Claims Act (FCA) may be a tool for combating fraudulent claims regarding tax expenditures. The FCA has been used to protect the public fisc by imposing liability upon anyone who makes a false or fraudulent claim relating to an expenditure of federal funds. A substantial share of government spending is implemented through tax credits and deductions granted to individuals and entities for taking particular actions promoted by the tax code—so-called “tax expenditures.” Funds subsidized by such tax expenditures can themselves be the objects of fraud. For example, a taxpayer could be defrauded of retirement funds that the …
Regulating Public Offerings Of Truly New Securities: First Principles, Merritt B. Fox
Regulating Public Offerings Of Truly New Securities: First Principles, Merritt B. Fox
Duke Law Journal
The public offering of truly new securities involves purchases by investors in sufficient number and in small enough blocks that each purchaser’s shares can reasonably be expected to be freely tradable in a secondary market that did not exist before the offering. Increasing the ability of small and medium-sized enterprises (SMEs) to make such offerings has been the subject of much recent discussion.
At the time that a firm initially contemplates such an offering, unusually large information asymmetries exist between its insiders and potential investors. These can lead to severe adverse-selection problems that prevent a substantial portion of worthy offerings …

“We Believe”: Omnicare, Legal Risk Disclosure And Corporate Governance, Hillary A. Sale, Donald C. Langevoort
Duke Law Journal
The Supreme Court’s decision in Omnicare Inc. v. Laborers District Council Construction Industry Pension Fund presents new challenges for boards of directors. The opinion speaks to whether and when an issuer’s statement of belief can be false or misleading other than by proof that the issuer’s genuine opinion was different from what it stated. Statements of opinion imply something about how the belief was formed, and that process implicates the role of directors as fiduciaries.
This Article uses Omnicare as a starting point for exploring and developing the interplay between disclosure, discourse, and fiduciary duties. Using the lens of corporate-discourse …

Co-Infection Dynamics Of The Tick-Borne Bacteria: Rickettsia Parkeri And "Candidatus Rickettsia Andeanae", Jung Keun Lee
Theses and Dissertations
Amblyomma maculatum Koch (Acari: Ixodidae) is the primary vector for Rickettsia parkeri which is a causative agent of American Boutonneuse fever. Infection rates of R. parkeri in A. maculatum populations from the United States are approximately 0-56%. The first human clinical case of Rickettsia parkeri infection was reported in 2014 and the patient presented with a febrile illness similar to Rocky Mountain spotted fever but showing milder clinical symptoms. Through 2016, approximately 40 human clinical cases of R. parkeri infection have been reported within southern United States. Amblyomma maculatum may also be infected with a rickettsia of unknown pathogenicity “Candidatus …
Development Of Oscillating Heat Pipe For Waste Heat Recovery, Govinda Mahajan
Development Of Oscillating Heat Pipe For Waste Heat Recovery, Govinda Mahajan
Theses and Dissertations
The development and implementation of technologies that improves Heating Ventilation & Air Conditioning (HVAC) system efficiency, including unique waste heat recovery methods, are sought while considering financial constraints and benefits. Recent studies have found that through the use of advanced waste heat recovery systems, it is possible to reduce building’s energy consumption by 30%. Oscillating heat pipes (OHP) exists as a serpentine-arranged capillary tube, possesses a desirable aerodynamic form factor, and provides for relatively high heat transfer rates via cyclic evaporation and condensation of an encapsulated working fluid with no internal wicking structure required. In last two decade, it has …

Domestic Use Of Space In An Iron Age House From Tell Halif, Israel, Jared Brian Wilson
Theses and Dissertations
Although household archaeology has been around for a number of years now, it has been slow to truly catch on as a way to learn something about the people of ancient Israel as a whole. Many archaeologists historically were only interested in the monumental architecture like: “palatial and storage complexes, cultic complexes, cemeteries, and fortification systems” (Hardin 2011:12). Archaeologists have realized that studying the basic housing and activity areas of the people that inhabit cities and the outlying areas lead them to have a greater understanding of what is really happening on a day-to-day basis. Understanding what is happening in …
