The Carnival Mirror And Institutional Forms Of Deviance: A Reflexive Paper Assignment, Jose A. Munoz Jan 2016

The Carnival Mirror And Institutional Forms Of Deviance: A Reflexive Paper Assignment, Jose A. Munoz

Sociology Faculty Publications

The reflexive paper assignment presented here calls on students to reflect on their own family and/or personal experiences in order to answer the question, “From where does the greatest harm arise?” In The Rich Get Richer and the Poor Get Prison: Ideology, Class and Criminal Justice, Reiman and Leighton (2010) make the case that the criminal justice system presents to us a carnival mirror-like image of what causes the greatest harm to society. The criminal justice system, through its policies and procedures, leads the public to conceive of a typical sort of crime committed by the typical criminal. The …

Distinctions With A Difference: Why Proper Rule 59(E) Motions Should Not Be Subject To "Second Or Successive" Habeas Analysis, Imad S. Matini Jan 2016

Distinctions With A Difference: Why Proper Rule 59(E) Motions Should Not Be Subject To "Second Or Successive" Habeas Analysis, Imad S. Matini

Tennessee Law Review

Motions to reconsider-filed under either Rule 59(e) or 60(b) of the Federal Rules of Civil Procedure--are often considered one in the same, whether due to imprudent labeling by a litigant or due to the belief that little distinction exists between the two. In the context of habeas corpus petitions filed by pro se prisoners, motions under Rule 59(e) and Rule 60(b) are often interchangeably filed. Within this context, however, the following issue persists: whether a motion filed under either rule is subject to the "second or successive" restriction under the Antiterrorism and Effective Death Penalty Act (AEDPA). The Supreme Court …

Process Evaluation On Crisis Services In Northern Idaho, Claudia G. Miewald Jan 2016

Process Evaluation On Crisis Services In Northern Idaho, Claudia G. Miewald

Doctor of Nursing Practice Projects

Background: Idaho ranks last of all states for per capita spending on mental health treatment (Kaiser Family Foundation, 2014). In Idaho, individuals in crisis who suffer from mental illness or Substance Use Disorder (SUD) have few options for care. They often utilize the most expensive treatment through the emergency department, inpatient services, or by going to jail. Idaho has the 7th highest suicide rate in the nation (Suicide Prevention Action Network of Idaho, 2015), while Region 1 of Idaho has the second highest suicide rate in the state from 2010-2014 (Suicide Prevention Action Network of Idaho, 2015).

Methods: This …

The Antidemocratic Sixth Amendment, Janet Moore Jan 2016

The Antidemocratic Sixth Amendment, Janet Moore

Faculty Articles and Other Publications

Criminal procedure experts often claim that poor people have no Sixth Amendment right to choose their criminal defense lawyers. These experts insist that the Supreme Court has reserved the Sixth Amendment right to choose for the small minority of defendants who can afford to hire counsel. This Article upends that conventional wisdom with new doctrinal, theoretical, and practical arguments supporting a Sixth Amendment right to choose for all defendants, including the overwhelming majority who are indigent. The Article’s fresh case analysis shows the Supreme Court’s “no-choice” statements are dicta, which the Court’s own reasoning and rulings refute. The Article’s new …

Victims Who Victimise, Mark A. Drumbl Jan 2016

Victims Who Victimise, Mark A. Drumbl

Scholarly Articles

How to speak of the agency of the oppressed to harm others in times of atrocity? This article juxtaposes Holocaust literature (Levi, Frankl, Kertesz, Ka-Tzetnik) with Holocaust judging (the Kapo collaborator trials in Israel). It does so didactically to interrogate international criminal law’s interaction with former child soldier Dominic Ongwen, currently awaiting trial at the International Criminal Court.

[Preprint] Examining The Correlates Of Sex Offender Residence Restriction Violation Rates, Jason Rydberg, Eric Grommon, Beth Huebner, Breanne Pleggenkuhle Jan 2016

[Preprint] Examining The Correlates Of Sex Offender Residence Restriction Violation Rates, Jason Rydberg, Eric Grommon, Beth Huebner, Breanne Pleggenkuhle

Criminology and Criminal Justice Faculty Works

Objectives This research examines the contribution of social ecological factors to the variation in sex offender residence restriction (SORR) violation rates, operationalized as a sex offender residing within a buffer zone around a school or a day care. Methods Drawing on data from two Midwestern states, we utilize a quasi-experimental cohort-control group design to examine the correlates of county-level SORR violation rates among a cohort of post-SORR sex offender parolees, and three counterfactual cohorts (pre-SORR sex offenders, pre- and post-SORR non-sex offender parolees). We model the violation rate using a series of fractional logit regressions, examining the contribution of housing …

Would United States Judges Benefit From More Graduate Training?, Nancy Joseph Jan 2016

Would United States Judges Benefit From More Graduate Training?, Nancy Joseph

Duke Law Master of Judicial Studies Theses

In the United States, there is no degree or training required to become a judge. On-the-job education primarily consists of orientation programs and updates on substantive and procedural law. Although these programs serve an important need, they are generally of limited duration and scope, taught by fellow judges, and are not degree programs. Two notable exceptions are the now-defunct University of Virginia Graduate Program for Judges, which offered an LL.M. in judicial process for sitting appellate judges and the Duke University School of Law’s LL.M. in judicial studies—also for sitting judges. Do judges benefit from such degree programs? There has …

Research Brief One-Sheet No.7: Police Integrity Lost: Introducing A Study Of Law Enforcement Officers Arrested, Philip M. Stinson, John Liederbach

Criminal Justice Faculty Publications

There are no comprehensive statistics available on problems with police integrity, and no government entity collects data on all criminal arrests of law enforcement officers in the United States. Police crimes are those crimes committed by sworn law enforcement officers with the general powers of arrest. These crimes can occur while the officer is either on‐ or off‐duty and include offenses committed by officers employed by state and local law enforcement agencies. This study provides a wealth of data on a phenomena that relates directly to police integrity—data that previously did not exist in any useable format.
