Beyond The Metatheoretical: Implicit Bias In Law Review Article Selection, Michael J. Higdon Jan 2016

Beyond The Metatheoretical: Implicit Bias In Law Review Article Selection, Michael J. Higdon

Scholarly Works

Every year, law review editors around the country are forced to select the authors, out of the hundreds who annually submit articles, to whom they will extend offers of publication. For law review editors, these are stressful times given 1) the short time frame they have for reading and assessing this ever growing number of submissions and 2) the fear that a poor selection on their part could potentially embarrass both themselves and their law schools. Although legal scholars sometimes forget about article selection from the perspective of the hurried, stressed law review editor, everyone in the academy should be …

A Comparison Between The American Markets For Medical And Legal Services, Benjamin H. Barton Jan 2016

A Comparison Between The American Markets For Medical And Legal Services, Benjamin H. Barton

Scholarly Works

America’s access to justice woes are paradoxical in a number of ways. We have more lawyers than every country, except for India, and more lawyers per capita than every country, except for Israel. We spend more on law as an absolute amount or as a percentage of GDP than any other country. At the high end, our so-called “Big Law,” we provide the best and most lucrative services in the world. Yet, we barely provide any legal services to the very poor, and American lawyers cost too much for the working poor or even the middle class. We graduate so …

The New Diversity Crisis In The Federal Judiciary, Jason Iuliano, Avery Stewart Jan 2016

The New Diversity Crisis In The Federal Judiciary, Jason Iuliano, Avery Stewart

Tennessee Law Review

For much of its history, the federal judiciary was characterized by a complete lack of surface-level (i.e., demographic) diversity. Over the past fifty years, efforts to promote surface-level diversity have yielded significant gains and the modern judiciary now looks more like the citizenry it serves than it has at any other point in history. Although this particular diversity crisis has abated, a new one has taken shape.

Today, deep-level diversity is at an all-time low. This type of diversity denotes those attributes that are non-demographic in nature. It includes characteristics such as work experience, values, attitudes, and educational background. Given …

Incarceration Memoirs And The Captivity Genre, Vincent James Carafano Iv Jan 2016

Incarceration Memoirs And The Captivity Genre, Vincent James Carafano Iv

Electronic Theses and Dissertations

The captivity genre has a rich history in fiction and memoir. In this work, I argue that the expansive parameters of the captivity genre should include an additional subset of texts: incarceration memoirs. Working with two canonized Indian captivity narratives - Mary Rowlandson's Sovereignty and the Goodness of God and Sarah Wakefield's Six Weeks in the Sioux Teepees - and two contemporary incarceration memoirs - Stanley Tookie Williams' Blue Rage, Black Redemption and Sanyika Shakur's Monster - I suggest that, across a range of thematic and contextual metrics, incarceration memoirs participate in the captivity genre. These equivalences include: the abduction …

Examining The Reasons For Student Responses To Threatening Behaviors On A College Campus, Heath J. Hodges, Elizabeth C. Low, M. Rosa Viñas-Racionero, Brandon A. Hollister, Mario Scalora Jan 2016

Examining The Reasons For Student Responses To Threatening Behaviors On A College Campus, Heath J. Hodges, Elizabeth C. Low, M. Rosa Viñas-Racionero, Brandon A. Hollister, Mario Scalora

Department of Psychology: Faculty Publications

Underreporting criminal activity to authorities can pose significant challenges, particularly within college campuses. Crime prevention teams have recognized the importance of reporting potentially concerning behaviors that may precede violent acts. However, reasons for reporting preincident behaviors have been understudied among college samples and failed to account for informal responses, such as talking to third parties or changing personal security features. The present study surveyed 1,075 students from a midwestern state university and evaluated their awareness of threatening or concerning behaviors on campus, response behaviors, and reasons for either acting on or failing to report preincident behaviors. Findings reflected reporting rates …

Methodology On Trial: The Rhetorical Function Of Toulminian Warrants In Expert Testimony, Luke Redington Jan 2016

Methodology On Trial: The Rhetorical Function Of Toulminian Warrants In Expert Testimony, Luke Redington

Open Access Dissertations

While providing expert testimony in jury trials, scientists face an array of conflicting legal requirements. Expert witnesses must demonstrate the soundness of their scientific methodology, but they must do so with little or no reference to the literature of their field. They must explain advanced scientific concepts while phrasing their explanations as a direct response to a lawyer's question. This project examines the rhetorical strategies expert witnesses utilize as they negotiate these conflicting requirements. Previous studies have examined persuasive discourse created for and by members of an scientific academic discipline, but my study examines how scientists defend their knowledge making …

Access To Recreational Open Space In Patterson, Ca: A Geospatial Analysis Utilizing Geographic Information Systems, Leanne S. Lynch Jan 2016

Access To Recreational Open Space In Patterson, Ca: A Geospatial Analysis Utilizing Geographic Information Systems, Leanne S. Lynch

Projects

Many cities throughout California have experienced land use shifts from prime agricultural land to developed industrial and residential areas without considering access to recreational open space. Access to recreation through open space or parks is beneficial for the health and well-being of the community while providing aesthetic value and potential preservation of local ecosystems. Since 2002 the City of Patterson, located in California’s Central Valley, has rezoned over 800 acres of agricultural land for urban and industrial use while developers reserved recreational open space (parkland) at locations inconvenient to existing neighborhoods. Although several acres of parkland have been added to …

Hb 828: Tanf Eligibility; Drug-Related Felonies, Grace E. Harris Leadership Institute, Virginia Commonwealth University, Greg Hopkins, Carla Jackson, Rana Wilson, Ramunda Young

L. Douglas Wilder School of Government and Public Affairs Publications

House Bill 828 (HB828) was proposed in 2016 to remove the ban on Temporary Assistance for Needy Families (TANF) for individuals with felony-related drug convictions who are otherwise eligible to receive benefits. The TANF program is designed to help low income families achieve self-sufficiency. States receive block grants to design and operate programs that accomplish one of the purposes of the TANF program: 1) Provide assistance to needy families so children can be cared for in their own homes; 2) Reduce the dependency of parents by promoting job preparation, work, and marriage; 3) Prevent and reduce the incidence of out-of-wedlock …

Incarceration Incentives In The Decarceration Era, Avlana Eisenberg Jan 2016

Incarceration Incentives In The Decarceration Era, Avlana Eisenberg

Scholarly Publications

After forty years of skyrocketing incarceration rates, there are signs that a new “decarceration era” may be dawning; the prison population has leveled off and even slightly declined. Yet, while each branch of government has taken steps to reduce the prison population, the preceding decades of mass incarceration have empowered interest groups that contributed to the expansion of the prison industry and are now invested in its continued growth. These groups, which include public correctional officers and private prison management, resist decarceration-era policies, and they remain a substantial obstacle to reform.

This Article scrutinizes the incentives of these industry stakeholders …
