Youthful Offenders And The Eighth Amendment Right To Rehabilitation: Limitations On The Punishment Of Juveniles, Martin R. Gardner
Youthful Offenders And The Eighth Amendment Right To Rehabilitation: Limitations On The Punishment Of Juveniles, Martin R. Gardner
Nebraska College of Law: Faculty Publications
To understand the potential scope of the Court's implicit conclusion that the punishment of adolescents is unconstitutional unless a meaningful opportunity for rehabilitation is afforded, it is necessary to carefully distinguish and clarify the distinction between the conflicting concepts of punishment and rehabilitation. I therefore begin Part I by analyzing this distinction. Since the logic of the Court's decisions impacts the punishment of adolescents in both the juvenile and criminal justice contexts, I contrast the two systems in Part II by tracing the development of the juvenile court movement from its original rehabilitative origins towards an increasingly punitive model, dispensing …

We live in an era of learning convergence in which both the digital and the physical play critical roles (Leander & Hollett, 2013). In these hybrid spaces, boundaries are permeable and students are simultaneously involved in many settings; communications and other forms of digital and physical production alternate between the virtual and the physical rather than residing in one. This means that teaching and learning must address the issue of learning convergence. Meanwhile, research indicates that preparing prospective teachers to be proficient in digital technologies in order to use them to meet the needs of 21st-century learners continues to be …

Child Abuse, Intimate Partner Violence, And Resiliency In Incarcerated Women: Attachment As A Ptsd Moderator, Cassandra Groth
Child Abuse, Intimate Partner Violence, And Resiliency In Incarcerated Women: Attachment As A Ptsd Moderator, Cassandra Groth
Theses and Dissertations
Child abuse (CA) is an epidemic that often leads to mental health outcomes including increased vulnerability to future victimization and intimate partner violence (IPV) (Briere & Elliot, 2003). The purpose of this study was to determine if CA would have more of a psychological impact on IPV survivors who had experienced CA than those who had not. Another purpose of this study was to evaluate secure attachment as a form of resiliency and insecure attachment as a risk factor for developing post-traumatic stress. It was hypothesized that incarcerated female survivors of IPV would have a significantly higher proportion of CA …
The Moderating Role Of Interactional Justice On The Relationship Between Justice And Organizational Citizenship Behavior, Arlene Ramkissoon
The Moderating Role Of Interactional Justice On The Relationship Between Justice And Organizational Citizenship Behavior, Arlene Ramkissoon
All Theses, Dissertations, Capstones, and Applied Clinical Projects
This research was designed to examine the moderating effect of interactional justice on the relationship between justice constructs and organizational citizenship behavior (OCB) with organizational identification as a mediator of the influence of justice perceptions on OCB. This study was based heavily on social exchange, the norm of reciprocity, and psychological contracts between individuals and their supervisors. The study sample was comprised of respondents drawn from a crowd sourcing internet website (N = 250). Niehoff and Moorman’s Organizational Justice Scale was used to measure justice perceptions. Mael and Ashforth’s Organizational Identification Scale was used to measure the degree of the …

Collaboration, Communication And Community-Building
Collaboration, Communication And Community-Building
Buffalo Commons
As the nation strives to improve police-community relations, safeguard the lives of officers and residents, and reduce crime while respecting civil liberties, voices around the country – from President Obama to ordinary citizens – are calling for more community policing. The Buffalo Police Department (BPD) has taken important steps toward embracing community policing, such as hiring community police officers, providing all officers with some community policing training, working collaboratively with community groups like Buffalo Peacemakers, improving language access for refugees and immigrants, and creating a scholarship program to diversify its recruits. Drawing on examples from across the country, this report …

Mediation and other alternative dispute resolution (ADR) processes are now well integrated into the United States judicial system, in both civil and criminal cases. This white paper, drafted for the American Bar Association Commission on the Future of Legal Services, summarizes empirical evidence about the costs and benefits of court-annexed ADR. The first-generation of ADR research found that mediation and other ADR processes resulted in high party satisfaction rates, high settlement rates, cost savings and efficiency, increased long-term cooperation among the parties, and higher compliance rates with the outcome. The paper then examines a ground-breaking study conducted by the Maryland …

This study explores the discourse surrounding an event in the social movement, Black Lives Matter, to gain insights into how digital literacy practices influence and mediate participation in the 21st century civil rights movement for a new generation of activist. This study examines three points of engagement, (1) the experience of the event as it is initially interpreted and shared online, (2) the intermingling of consciousness through social media, and (3) the post social media interpretation and action. Data was collected from Twitter analyzed using discourse analysis.

Animal Cruelty And Elder Abuse, Edward F. Ansello
Director's Editorials from Age in Action
Continuing and expanding the American Psychological Association's guidance that those in counseling roles be alert to and ask questions about care of animals could provide some early warnings, perhaps in time to avoid harm to both animals and people. Encouraging our children to interact with kindness towards animals can’t help but pay dividends over the life course. We need to pay attention to the link of indifference or neglect of pets leading to the same with humans, with those in later life.

"Safer" Harbor: The Impact Of Different Models Of Safe Harbor Laws On The Criminalization Of Commercially Sexually Exploited Children In The United States, Priscila Borges Marques Dos Santos
Theses, Dissertations and Capstones
Commercially sexually exploited children (CSEC) are commonly treated as criminals and punished for offenses committed as a result of being trafficked. Recent state-level legislative efforts have sought to prevent minors from being held criminally liable for being commercially sexually exploited. This study offers an analysis of the effects of such laws on the criminalization of CSEC through the use of ordinary least squares (OLS) regression. Data on the number of child arrests for prostitution (1995-2014) and safe harbor laws were collected from the FBI Uniform Crime Reports, the Polaris Project website, and the 2015 ECPAT report. The findings of the …
