"Safer" Harbor: The Impact Of Different Models Of Safe Harbor Laws On The Criminalization Of Commercially Sexually Exploited Children In The United States, Priscila Borges Marques Dos Santos Jan 2016

"Safer" Harbor: The Impact Of Different Models Of Safe Harbor Laws On The Criminalization Of Commercially Sexually Exploited Children In The United States, Priscila Borges Marques Dos Santos

Theses, Dissertations and Capstones

Commercially sexually exploited children (CSEC) are commonly treated as criminals and punished for offenses committed as a result of being trafficked. Recent state-level legislative efforts have sought to prevent minors from being held criminally liable for being commercially sexually exploited. This study offers an analysis of the effects of such laws on the criminalization of CSEC through the use of ordinary least squares (OLS) regression. Data on the number of child arrests for prostitution (1995-2014) and safe harbor laws were collected from the FBI Uniform Crime Reports, the Polaris Project website, and the 2015 ECPAT report. The findings of the …

Are Strong States Key To Reducing Violence? A Test Of Pinker, Ryan Murphy Jan 2016

Are Strong States Key To Reducing Violence? A Test Of Pinker, Ryan Murphy

Bridwell Institute for Economic Freedom Research

STEVEN PINKER CLAIMS in The Better Angels of Our Nature (2011) that nearly all social-scientific evidence tells us violence is declining. This paper makes no claims against Pinker’s main argument; criticisms of it having been addressed elsewhere (Pinker 2015). However, one secondary hypothesis Pinker puts forward is that the development of strong states was a key factor in the decline of violence (2011, 42). Summarizing his reading of the evidence, Pinker writes, “[t]he reduction of homicide by government control is so obvious to anthropologists that they seldom document it with numbers… It goes without saying that people that have been …

Flipping The Script: Newspaper Reporting Of The Trayvon Martin Shooting, Chad Painter, Erin Willis Jan 2016

Flipping The Script: Newspaper Reporting Of The Trayvon Martin Shooting, Chad Painter, Erin Willis

Communication Faculty Publications

The purpose of this chapter is to examine newspaper coverage of the George Zimmerman-Trayvon Martin shooting and the frames of race and crime used in the context of newsworthiness. The researchers analyzed 1,177 articles in one local, six statewide, and three national newspapers. The local paper focused on the shooting and the ensuing police investigation instead of social and political issues, and local-interest stories instead of national events. There was virtually no mention of race. Coverage in the six Florida papers was mixed between details of the case and social issues such as Florida's Stand Your Ground law. There were …

Empirical Assessment Of Cyber Harassment Victimization Via Cyber-Routine Activities Theory, Sinchul Back Jan 2016

Empirical Assessment Of Cyber Harassment Victimization Via Cyber-Routine Activities Theory, Sinchul Back

Master’s Theses and Projects

Over the decades, the advance of the social networking sites and computer-mediated communication tools has facilitated cybercriminals to expand their scope of criminal activities from the physical world to the virtual realm. Cybercriminals can easily leverage the Internet to operate sexual crime such as cyber-harassment. This study aims to empirically assess cyber-harassment victimization in South Korea via Cyber-Routine Activities Theory (2008). Cyber-Routine Activities Theory includes five major tenets: 1) digital capable guardianship, 2) motivated offender online, 3) suitable target online, 4) online risky behavior, and 5) online vocational and leisure activities. Data were derived from the 2013 Korean Institute of …

Ransomware Against Police: Diagnosis Of Risk Factors Via Application Of Cyber-Routine Activities Theory, Kyung-Shick Choi, T. M. Scott, Daniel P. Leclair

Criminal Justice Faculty Publications

Technologically advanced hackers are able to commit a crime and leave undiscovered by the authorities. Recent increases in cyber-attacks utilizing technology known as ransomware are leaving police departments and other institutions in the serious situation of having to pay ransom to cybercriminals. The present study employs a Cyber-Routine Theoretical approach in explaining why ransomware victimization has become a viral phenomenon. Data were derived from the recent reported cases of ransomware attacks towards police departments in the U.S. and analyzed in order to build a victim profile. This study shows that online lifestyle and cybersecurity are the salient factors that contribute …

Black, White, & Blue: An Analysis Of Implicit Racial Bias & The Fourth Amendment In The Criminal Justice System, Michael A. Baugh

Political Science: Student Scholarship & Creative Works

Just two score and seven years ago, Dr. Martin Luther King, Jr. rose to leadership in a fight for racial justice and civil rights in America. As Dr. King famously remarked from the confines of a jail cell in Birmingham, Alabama, “injustice anywhere is a threat to justice everywhere.” Dr. King’s powerful words hold true today. Controversies, such as the deaths of Michael Brown, Tamir Rice, Freddie Gray, and Eric Garner at the hands of officers tasked to protect them, seems to indicate that while progress has been made since the days of Dr. King, racial prejudice and discrimination remain …

Enhancing Judicial Institutions: Enhancing Economic Development, Stephane Alia Haisley Jan 2016

Enhancing Judicial Institutions: Enhancing Economic Development, Stephane Alia Haisley

Duke Law Master of Judicial Studies Theses

Since the 1980s, scholars and development banks have recognized the link between judicial institutions and economic growth. This thesis proposes to explore the role of judicial institutions in the performance of economies and questions whether enhancing judicial institutions can result in enhancing economic development in developing countries. Since the 1990s development banks have explored the role of judicial institutions in the quest for economic development. Both the World Bank and the International Monetary Fund (IMF) have done this through the pursuit of judicial reform efforts in countries with ailing economies. The focus has been on improving the efficiency of the …

On The Influence Of Trust In Predicting Rural Land Owner Cooperation With Natural Resource Management Institutions, Joseph A. Hamm, Lesa R. Hoffman, Alan Tomkins, Brian H. Bornstein Jan 2016

On The Influence Of Trust In Predicting Rural Land Owner Cooperation With Natural Resource Management Institutions, Joseph A. Hamm, Lesa R. Hoffman, Alan Tomkins, Brian H. Bornstein

University of Nebraska Public Policy Center: Publications

Contemporary natural resource management (NRM) emphasizes the role of the public in general and land owners in particular as voluntary participants in the process. Understanding the role of trust in voluntary cooperation is therefore critical, but the current state of the relevant literature is such that it fails to systematically address a few important issues. This inquiry sought to address these issues by presenting and testing a model of land owners’ trust in and cooperation with a NRM institution. The model hypothesizes that the six major drivers of trust in this context (dispositional trust, care, competence, confidence, procedural fairness and …

Hull, Alana Merkow, Laura K Stephens, Karli R Hochstatter, Heidi K Olson-Streed, Lisa M Baker, Timothy M Hess

Prevention and Community Health Faculty Publications

BACKGROUND: Hepatitis C virus (HCV) infection is a growing problem among people who inject drugs. Strategies to reduce disease transmission (eg, syringe exchange programs) and facilitate HCV screening and linkage are available but are under-utilized in many communities affected by injection drug use. Novel approaches to increasing the use of these strategies are needed.

OBJECTIVE: The goals of this project are to (1) develop and pilot test a computerized tailored intervention for increasing HCV screening and decreasing risky drug use behavior among people who inject drugs and (2) determine the feasibility of disseminating such an intervention using peer-based referrals in …

The Exceptional Circumstances Of Johnson V. United States, Leah M. Litman Jan 2016

The Exceptional Circumstances Of Johnson V. United States, Leah M. Litman

Michigan Law Review First Impressions

Johnson v. United States held that the “residual clause” of the Armed Career Criminal Act (ACCA) is unconstitutionally vague. Since Johnson was decided six months ago, courts have been sorting out which of the currently incarcerated defendants who were sentenced under ACCA’s residual clause may be resentenced. Determining who can be resentenced in light of Johnson requires courts to answer several questions. For example, does the rule in Johnson apply retroactively to convictions that have already become final? And can prisoners who have already filed one petition for postconviction review—review that occurs after a defendant’s conviction has become final— file …
