Justice Kennedy's Big New Idea, Sandra F. Sperino
Justice Kennedy's Big New Idea, Sandra F. Sperino
Faculty Articles and Other Publications
In a 2015 case, the Supreme Court held that plaintiffs could bring disparate impact claims under the Fair Housing Act (the "FHA"). In the majority opinion, Justice Kennedy relied heavily on the text and supporting case law interpreting Title VII of the Civil Rights Act ("Title VII") and the Age Discrimination in Employment Act (the "ADEA '). Without explicitly recognizing the powerful new idea he was advocating, Justice Kennedy's majority opinion radically reconceptualized federal employment discrimination jurisprudence. This new reading of Title VII and the ADEA changes both the theoretical framing of the discrimination statutes and greatly expands their scope. …

Assessing Probation Officers’ Knowledge Of Offenders With Intellectual Disabilities: A Pilot Study, Paige Dunlap
Assessing Probation Officers’ Knowledge Of Offenders With Intellectual Disabilities: A Pilot Study, Paige Dunlap
Faculty Publications
The prevalence of offenders with intellectual disabilities (ID) is increasing. Studies have shown that although most probation officers will have offenders with ID on their caseload, these officers have received minimal training to effectively interact with this population. Additionally, no studies have assessed probation officers' knowledge of people with ID. This study has two aims: to pilot test the Probation Officer Knowledge of Intellectual Disabilities Assessment, and to evaluate the instrument's reliability and validity. Test-retest, internal consistency, item-total correlation, Cronbach's alpha, item difficulty, and construct validity were assessed for the instrument. Descriptive statistics and reliability coefficients analysis were conducted. The …

Talking About Writing Across The Secondary And College Community, Michelle Cox, Phyllis Gimbel
Secondary Education and Professional Programs Faculty Publications
Many have commented that higher education is becoming increasingly fragmented, leading to the overspecialization of scholars, disciplinary discourses that are opaque to those outside the field, and lack of cross-pollination among disciplines (Kerr). WAC has long been seen as a movement that creates connections among disciplines. In fact, these connections are often created through the workshop, the quintessential WAC experience, as it “bring[s] faculty together around the same table”—bringing together people who may work at the same institution but, in practice, work worlds apart (Cox 317). More recently, this movement to bring people around the same table has come to …
Is The American Criminal Jury System In Criminal Trials Worthy Of Export To Iraq?, Mohammed J. Ailan
Is The American Criminal Jury System In Criminal Trials Worthy Of Export To Iraq?, Mohammed J. Ailan
Law Student Scholarship
The American criminal jury system has a long, ancient history. It went through several stages throughout history until it became a sophisticated institution for educating the American people about the law in their country. Jury duty is one of the privileges of U.S. citizenship. This thesis shows how the criminal justice system currently works in the United States. This paper discusses issues such as the hung jury, the capital jury, checking abuses of power, and jury nullification. This thesis focuses on other countries that have recently adopted the criminal jury system, such as Spain and Russia, after they adopted democracy. …

Local Perspectives On Environmental Insecurity And Its Influence On Illegal Biodiversity Exploitation, Meredith L. Gore, Michelle L. Lute, Jonah H. Ratsimbazafy, Andry Rajaonson
Local Perspectives On Environmental Insecurity And Its Influence On Illegal Biodiversity Exploitation, Meredith L. Gore, Michelle L. Lute, Jonah H. Ratsimbazafy, Andry Rajaonson
School of Natural Resources: Faculty Publications
Environmental insecurity is a source and outcome of biodiversity declines and social conflict. One challenge to scaling insecurity reduction policies is that empirical evidence about local attitudes is overwhelmingly missing. We set three objectives: determine how local people rank risk associated with different sources of environmental insecurity; assess perceptions of environmental insecurity, biodiversity exploitation, myths of nature and risk management preferences; and explore relationships between perceptions and biodiversity exploitation. We conducted interviews (N = 88) with residents of Madagascar’s Torotorofotsy Protected Area, 2014. Risk perceptions had a moderate effect on perceptions of environmental insecurity. We found no effects of environmental …
