Debating Expert Authority In Corruption Cases: The Challenge Of Interpreting State Financial Losses Under The 2023 Indonesian Criminal Code, Wendy Kenafiana Assanti, Hendry Julian Noor

The 2023 Indonesian Criminal Code revises the formulation of corruption offenses, including rules on proving state financial losses; however, the elucidation of Article 603 raises questions regarding the competent institution and the evidentiary weight of audit results. This study examines how the provision may perpetuate ongoing debates over experts’ authority to determine state financial losses, which are often perceived as affecting legal certainty, and proposes a reformulation to provide clearer legal guidance. This doctrinal study employs statutory and case law approaches, utilizes qualitative methods, and applies Gustav Radbruch’s perspective as an analytical lens. Gender-based and sexual violence (GBSV) remains a pervasive problem in higher education, disproportionately affecting marginalized students and undermining their safety, well-being, and academic success. Post-secondary institutions (PSIs) increasingly rely on peer educators (PeerEds) to deliver prevention and response programs, leveraging their shared student experience to foster trust and engagement. This study explores the motivations and experiences of GBSV PeerEds in Canada and the United States, revealing how personal trauma, institutional critique, and allyship drive their involvement. Findings highlight the emotional labour, secondary trauma, and systemic constraints PeerEds face, alongside their contributions to campus culture and advocacy. The study critiques institutional …

Constitutional Court Decision Number 2-3/PUU-V/2007 states that the death penalty does not conflict with the 1945 Constitution of the Republic of Indonesia. However, the decision provides a kind of guideline that suggests that efforts should be made to moderate the death penalty, including by removing the death penalty from the main criminal system and by formulating provisions for postponing the implementation of the death penalty (conditional capital punishment). In accordance with the Weberian tradition of classical public administration, the core responsibility of the Philippine Public Administration is the efficient delivery of public services to its constituents. In the case of the Judicial branch of the government, this responsibility manifests in the form of a quick disposition of cases filed before its courts. Introduction: People experiencing homelessness are medically vulnerable and suffer disproportionately from chronic physical and mental health conditions. Evidence-based standards to inform decisions surrounding care would be valuable for this population. Studies exploring how homeless individuals in Appalachia perceive their interactions with the healthcare system remain limited, however.
Purpose: The purpose of this study is to assess perceptions of the healthcare system among homeless individuals served by temporary housing shelters in an Appalachian city.

การรอการกำหนดโทษหรือรอการลงโทษ ตามประมวลกฎหมายอาญา มาตรา 56 เป็นมาตรการที่มีความสำคัญในกระบวนการยุติธรรมทางอาญา ซึ่งเป็นมาตรการที่บัญญัติขึ้นโดยมีวัตถุประสงค์ให้ศาลใช้ดุลพินิจรอการกำหนดโทษหรือรอการลงโทษสำหรับคดีที่มีอัตราโทษจำคุกระยะสั้นหรือโทษปรับ ตามทฤษฎีการลงโทษเพื่อแก้ไขพฤติกรรมของผู้กระทำความผิด กล่าวคือ ในคดีความผิดอาญาที่มีโทษจำคุกหรือปรับ และศาลจะลงโทษจำคุกไม่เกิน 5 ปี ทั้งนี้ เพื่อมิให้ผู้กระทำความผิดเล็กน้อยนั้นเข้าไปปะปนกับผู้กระทำความผิดเป็นอาจิณและเลียนแบบพฤติกรรมนั้นจนกลับมากระทำความผิดซ้ำอีก และเพื่อให้โอกาสผู้กระทำความผิดได้รู้สำนึกถึงสิ่งที่ได้กระทำลงไป รวมถึงสามารถกลับมาดำเนินชีวิตในสังคมได้อย่างเป็นปกติ แต่ในทางกลับกันเมื่อพิจารณาจากการบังคับใช้ประมวลกฎหมายอาญา มาตรา 56 ศาลสามารถใช้ดุลพินิจได้กับทุกฐานความผิด แม้ลักษณะของฐานความผิดนั้นจะกระทบกระเทือนต่อความปลอดภัยของสังคมมากเพียงใด แต่หากโทษจำคุกที่ศาลลงมีกำหนดไม่เกิน 5 ปี ศาลก็สามารถสั่งรอการกำหนดโทษหรือรอการลงโทษได้กับทุกกรณี ซึ่งอาจจะขัดหรือแย้งกับทฤษฎีการลงโทษทางอาญาประการอื่น กล่าวคือ ทฤษฎีการลงโทษเพื่อแก้แค้น การลงโทษเพื่อข่มขู่ยับยั้ง การลงโทษเพื่อตัดผู้กระทำผิดออกจากสังคมรวมถึงการลงโทษเพื่อป้องกันอาชญากรรม อันส่งผลกระทบต่อความรู้สึกและการได้รับความยุติธรรมของผู้เสียหาย หรือเหยื่อในคดีอาญารวมทั้งประชาชนในสังคม เนื่องจากในบางกรณีเป็นฐานความผิดที่มีความร้ายแรง และเป็นอันตรายต่อสังคม แต่ผู้กระทำความผิดกลับไม่ถูกลงโทษ ยิ่งไปกว่านั้นอาจทำให้ผู้เสียหายไม่ได้รับความยุติธรรม และบุคคลทั่วไปย่อมเข้าใจว่าการกระทำร้ายแรงเช่นนั้นสามารถกระทำได้โดยไม่ต้องรับผลใด ๆ จากการกระทำดังกล่าว ฉะนั้นจึงควรปรับปรุงแก้ไข และจัดทำคำแนะนำเกี่ยวกับวิธีการรอการลงโทษหรือรอการกำหนดโทษให้มีความชัดเจนยิ่งขึ้น โดยการกำหนดแนวทาง หรือข้อพิจารณาที่ผู้ใช้กฎหมายควรให้การคำนึง และให้ความสำคัญยิ่งขึ้นเกี่ยวกับฐานความผิดร้ายแรงที่ไม่ควรรอการกำหนดโทษหรือรอการลงโทษ เพื่อให้การลงโทษเป็นไปตามสัดส่วนของการกระทำความผิด และตรงตามทฤษฎีวัตถุประสงค์ของการลงโทษ

Timely and efficient emergency response is essential for public safety, particularly in high- risk urban environments. However, existing dispatch systems often rely on reactive decision- making, leading to delays and inefficient resource allocation. This thesis explores how artificial intelligence (AI) and data modeling can enhance police response times through predictive analytics. A systematic review of 17 peer-reviewed studies identified key predictors such as dispatch behavior, crime history, temporal characteristics, and geographic location. Background: Better understanding factors leading to suicide and prevention opportunities is a global public health priority. This qualitative pilot study tested whether reviewing inquest recordings could generate insights during COVID-19 and inform public health prevention programmes across a predominantly rural and coastal area where there are significant health inequalities. Methods: Fifty-five inquest recordings reached a suicide conclusion between March 2020 and January 2021. Stratified sampling was used to obtain two samples from each month. Brought forth by common rhetoric, Appalachia is often viewed as the closest space to that of an empyrean domain. Separated from the sleepless city, its allure rests in its created identity of a quiet, green escape from the city, which offers serenity on all fronts. Child abuse and neglect are prevalent problems, affecting an estimated one million children worldwide each year. The purpose of this paper is to evaluate and analyze three potential solutions to reduce the rates of child abuse and neglect. The three programs that were suggested were: improving overall access to healthcare, therapy and counseling, and other support services for children and families who need them, implementing more Nurse-Family Partnerships across the United States for first time mothers with visits from a registered nurse, and increasing parent’s access to economic resources and improving families overall financial security. The Controlled Substances Act (CSA) is the primary regulatory and criminal legislation surrounding drugs in the United States. Passed in the 1970s, the CSA established the drug classification scheduling system we use today. Despite being over 50 years old today, the CSA has not achieved its goal of eliminating or even significantly reducing drug use and offenses. The purpose of this paper is to examine the continued concern about substance abuse/misuse and limited access to treatment in rural areas. Rural areas lack the adequate treatment needed to combat substance use disorder (SUD), mainly due to the lack of sufficient providers trained to identify, treat, and support those dealing with SUD. In this qualitative study, the evolving perceptions of law enforcement among child immigrants from Central and South America following their immigration to the United States were investigated. Anchored in social learning theory, the aim was to discern whether interactions with law enforcement in their home countries and the United States influence these perceptions. A phenomenological approach was used to conduct in-depth interviews with six Latino individuals who immigrated between the ages of 7 and 17 and are at least 18 years old at the time of their interview. Jails throughout the United States hold thousands of legally eligible voters who have not been convicted of a crime While those convicted of felonies are often statutorily disenfranchised, pretrial detainees retain their civil rights—including the right to vote. In theory, this should guarantee them a voice. In practice, pretrial detention operates like a legal disqualification. Without meaningful enforcement mechanisms, the right to vote becomes hollow.
This Comment argues that implementing a national standard based on the proactive policies of Massachusetts and Nevada will ensure accessible voting for pretrial detainees. To build that argument, this Comment first explores the low level …

Biometrics is increasingly used by armed forces for a variety of purposes, such as access control, the registration of detainees, and increasingly also targeting. The capabilities of biometric systems are considerably strengthened when they are enabled by artificial intelligence (AI). This article analyzes legal questions that are raised by the military use of such AI-supported biometrics. It argues that relevant legal frameworks are International Humanitarian Law, international human rights law, and the right to privacy in particular, as well as data protection law. Digital technology has expanded women’s opportunities for expression and participation, while simultaneously enabling new and intensified forms of gender-based violence. In India, technology-facilitated violence against women (TFVW) has increased in scale and complexity, yet existing legal frameworks remain inadequately equipped to address its multidimensional harms. This article identifies a significant gap in Indian law, arguing that the Bharatiya Nyaya Sanhita (BNS) and the Information Technology Act (IT Act) insufficiently recognise psychological harm, informational privacy violations, and non-sexual online abuse, while continuing to rely on patriarchal notions of consent, modesty, and public morality. Mobility And Power In Temp Work, Andrew Elmore

Labor mobility is an underdiscussed determinant of temp worker power. Drawing on original interviews with professional and blue-collar workers who work as and alongside temps, this Article shows how businesses use staffing agencies to restrict the labor mobility of contingent workers. Staffing agencies limit worker mobility by imposing user- and worker-side contractual restraints while misrepresenting themselves to temp workers as their sole employer. They also exploit state-imposed mobility limitations by recruiting foreign nationals and people leaving incarceration and channeling them into their most precarious work. Demonstrating standing for injunctive relief in § 1983 police misconduct cases is undisputedly difficult for civil rights plaintiffs. Under City of Los Angeles v. Lyons, plaintiffs seeking injunctions must present more than evidence of past misconduct; they must show a significant ongoing risk that they will experience the same misconduct again. Scholarly attention to Lyons has focused primarily on doctrinal errors in the Court’s legal analysis, and for good reason.
