Sex, Love, And Black Lives, Mack Curry Iv
English Theses & Dissertations
The title of my thesis is Sex, Love, and Black Lives. This title embodies the three prominent aspects of my life: intimacy, relationships, and being black in America. These subjects are important to me because they influence a lot of my writing. They have also made played a key role in shaping me into the person I am today. Section one will focus on my sexual experiences, section two will focus on romantic and platonic relationships I’ve had, and section three will focus on my perspective of being black in America.
Writing about my various thoughts and opinions allowed me …
The Strength Of Weak Social Ties: Social Activism And Facebook, Nichole Akai Giraldi
The Strength Of Weak Social Ties: Social Activism And Facebook, Nichole Akai Giraldi
Sociology & Criminal Justice Theses & Dissertations
The use of Social Networking Sites, Facebook in particular, has become a major avenue of communication; Facebook has become a platform where people can discuss any topic of their choice to include social issues within society. While some argue Facebook is only a disseminator of information, others argue that in addition to being a disseminator of information it is also a motivator of social activism. Facebook profiles consist of one’s social ties, both strong and weak, which have the potential to expose users to different information daily. Using Mark Granovetter’s strength of weak social ties theory as a framework, the …

Governing The "Alien Threat": A Multilevel Analysis Of Punitiveness Toward Non-Citizen Federal Drug Offenders Across Time And Place, Melanie Marie Holland
Sociology & Criminal Justice Theses & Dissertations
Though frequently disadvantaged across a plethora of various institutions throughout history, noncitizens have become increasingly targeted with recent political rhetoric refocusing on immigration as a threat to homeland security. The latent effects of this renewed political platform has been a heightened awareness of the “immigration threat” that has infiltrated the criminal justice system.
Previous research has found that citizenship status is related to sentencing outcomes despite the identification of this variable as extralegal by the USSC, though research remains largely divided on the extent and manifestation of this disparity. Furthermore, only a very few of these studies have examined potential …
Bruton On Balance: Standardizing Redacted Codefendant Confessions Through Federal Rule Of Evidence 403, Margaret Dodson
Bruton On Balance: Standardizing Redacted Codefendant Confessions Through Federal Rule Of Evidence 403, Margaret Dodson
Vanderbilt Law Review
Joint criminal trials are a relatively common practice in the American criminal justice system. When multiple criminal defendants are charged in a single crime-especially in conspiracy cases-courts and prosecutors alike favor joint trials because of their comparable efficiency to individual trials. However, joint trials can raise significant procedural and constitutional concerns for codefendants. One such issue arises when the government seeks to introduce the confession of a non-testifying defendant (hereinafter a "declarantdefendant") that inculpates other codefendants.
When introduced, such confessions raise potential Sixth Amendment issues under Bruton v. United States. A Bruton violation occurs in a joint trial when a …

Finding "Tapia Error": How Circuit Courts Have Misread 'Tapia V. United States' And Shortchanged The Penological Goals Of The Sentencing Reform Act, Matt J. Gornick
Vanderbilt Law Review
The American criminal justice system is called many things; "compassionate" is usually not one of them. Yet in the course of federal criminal proceedings, a sentencing hearing allows a judge to convey compassion toward a defendant, if only to say, "I'm sorry about your situation, but this is how I must apply the law." Likewise, a defendant might throw herself on the mercy of the court in hopes that the judge exercises discretion compassionately. Mitigating factors and downward departures suggest that judges are capable of doing so. But how does a sentencing judge show compassion, as opposed to simply feeling …

Foreword: Innocent Until Proven Poor, Sara Zampierin

One of the core tenets of our criminal justice system is the presumption of innocence until proven guilty. As the title of the Symposium recognizes, we have allowed our justice system to ignore that presumption for people living in poverty in a variety of ways. Instead, it often inflicts additional and harsher punishment on individuals because of their poverty.
Evaluating Restorative Justice: A Guide For Practitioners, Nakee Yalon Holloway
Evaluating Restorative Justice: A Guide For Practitioners, Nakee Yalon Holloway
All Capstone Projects
Restorative Justice (RJ) Programs exist in schools, workplaces, communities, the justice system, and other community and organizational settings and are targeted at various populations. In spite of numerous restorative interventions, there have been few comprehensive evaluations of those interventions that document RJ successes or provide evidence to increase the likelihood of success. RJ is responsive and emergent in nature; it is dynamic and ever changing. It is not a program with a linear path from idea to design to implementation to outcomes. RJ presents challenges to traditional approaches to research, such as process evaluations and long-term outcome studies. This research …

A Model Of Segmenting A High-Cost Crime Prevention Through Environmental Design Initiative, Paul Adams
All Capstone Projects
This project aimed to create a working model worthy to include within Schneider, Walker, and Sprague's description of a five-stage process of parceling out high-cost Crime Prevention Through Environmental Design (CPTED) initiatives. In 2002, the Department of Education and Department of Justice sponsored Schneider as the lead author for introducing and promoting CPTED initiatives for the first time in schools. This project's funding mechanism was created to help assist with the procurement of a highly priced CPTED initiative (key-less card system) for Suburban College.
Suburban College had faced a reoccurring pattern of theft from its classrooms and common areas. The …
Disrupting The Path From Childhood Trauma To Juvenile Justice: An Upstream Health And Justice Approach, Yael Cannon, Andrew Hsi
Disrupting The Path From Childhood Trauma To Juvenile Justice: An Upstream Health And Justice Approach, Yael Cannon, Andrew Hsi
Georgetown Law Faculty Publications and Other Works
A groundbreaking public health study funded by the U.S. Centers for Disease Control and Prevention (CDC) and the Kaiser Foundation found astoundingly high rates of childhood trauma, including experiences like abuse, neglect, parental substance abuse, mental illness, and incarceration. Hundreds of follow-up studies have revealed that multiple traumatic adverse childhood experiences (or “ACEs”) make it far more likely that a person will have poor mental health outcomes in adulthood, such as higher rates of depression, anxiety, suicide attempts, and substance abuse. Interestingly, the original ACE Study examined a largely middle-class adult population living in San Diego, but subsequent follow-up studies …

Gender Disparities In Weight Gain Among Offenders Who Are Obese Upon Entering Correctional Facilities, Madison L. Gates, Nancy C. Webb, Rebecca Stone, Darra Ballance, Wonsuk Yoo
Journal of the Georgia Public Health Association
Background: Obesity is a significant health issue for offenders, who have a higher prevalence of obesity-related conditions, such as diabetes, compared to non-incarcerated populations. Within incarcerated populations, there are obesity disparities in terms of race, gender, and age, as well as excess weight gain during incarceration.
Methods: This longitudinal study was conducted for 2005 – 2010 in collaboration with a Department of Corrections in the east south central region of the United States. From electronic health records of 10,841 offenders, weight, height, and demographic data were extracted. As determined from these data, 2,622 offenders met the inclusion criteria (two or …
Quality Rated Childcare Programs And Social Determinants Of Health In Rural And Non-Rural Georgia, Nancy C. Webb, Madison L. Gates
Quality Rated Childcare Programs And Social Determinants Of Health In Rural And Non-Rural Georgia, Nancy C. Webb, Madison L. Gates
Journal of the Georgia Public Health Association
Background: Early childhood is linked to school readiness and early school achievement. Through its Quality Rated (QR) program, which was designed to improve the quality of care in early childhood programs, the state of Georgia has been a trailblazer in funding universal preschool and in improving the quality of childcare programs. We have assessed differences in the availability of QR childcare programs in Georgia to learn if, in rural versus non-rural counties, there is a relationship between QR childcare programs and health-related outcomes.
Methods: This cross-sectional study evaluated county-level data to evaluate the relationship between QR childcare programs and social …

The Big Data Jury, Andrew Guthrie Ferguson
Notre Dame Law Review
Big data technologies now exist to create algorithmically perfect jury pools matching the demographic realities of a community. Big data technologies also exist to provide litigants a wealth of personal information about potential jurors. The question remains whether these technological innovations benefit the jury system. This Article addresses the disruptive impact of big data on jury selection and the dilemma it presents to courts, lawyers, and citizens.

Back To One City: The 1973 Memphis State Tigers And Myths Of Race And Sport, Aram Goudsouzian
Study the South
In 1973, the then-Memphis State (now University of Memphis) Tigers’ Men's Basketball team reached the NCAA tournament final. In the history of college basketball, Memphis State’s season is just a footnote, as the Tigers lost the title game to UCLA, which captured its seventh consecutive NCAA championship. But in Memphis, this team became a civic mythic legend. With each victory, the city’s enthusiasm ballooned, inspiring more paeans to players Larry Finch and Ronnie Robinson, coach Gene Bartow, and budding superstar Larry Kenon. Politicians and journalists upheld the team as a vehicle of interracial unity, healing the scars of the 1968 …

The Social Maladjustment Exclusion: Leaving A Category Of Students Behind And The Problem With State And Judicial Interpretation Of Congressional Intent, Carolyn Mason
University of the District of Columbia Law Review
Since its inception in 1975, controversy surrounding the Social Maladjustment Exclusion has plagued its understnding. This paper delves deeper into the controversy and explores jurisdictional and nationwide patterns in the judicial interpretation of the social maladjustment exclusion. This analysis further demonstrates how the evolving interpretation of social maladjustment is out of touch with the needs of vulnerable youth in our schools and society, and may be based, in large measure, on a small group of non-representative plaintiffs.

Behavioral Genetics & Criminal Culpability: Addressing The Problem Of Free Will In The Context Of The Modern American Justice System, Tufik Y. Shayeb
University of the District of Columbia Law Review
More important than the insensitivity of certain criminal offenders to changes and benefits is the impropriety of casting the crime problem wholy in terms of a utilitarian calculus. The most serious offenses are crimes not simply because society finds them inconvenient, but because it regards them with moral horror. To steal, to rape, to rob, to assault - these acts are destructive of the very possibility of society and affronts to the humanity of their victims.

Regulating Identity: Medical Regulation As Social Control, Matt Lamkin
Regulating Identity: Medical Regulation As Social Control, Matt Lamkin
BYU Law Review
New biomedical technologies offer growing opportunities not only to prevent and treat illnesses, but also to change how healthy people think, feel, behave, and appear to others. Controversies over these nontherapeutic practices are a pervasive feature of contemporary American culture, from students on “study drugs” and cops on steroids to skin-lightening by black celebrities and the over-prescription of antidepressants. Yet the diversity of these controversies often masks their common root—namely, disputes about the propriety of using medical technologies as tools for shaping one’s identity.
Some observers believe these so-called “enhancement” practices threaten important values, offering unfair advantages to users and …
