Run-On Sentence: Remedies For Erroneous Career Offender Enhancements, John Patrick Bailey Apr 2016

Run-On Sentence: Remedies For Erroneous Career Offender Enhancements, John Patrick Bailey

Duke Law Journal

Guilty pleas have come to resolve all but a fraction of federal criminal cases. So for most federal defendants, sentencing is the criminal justice process’s most important phase. That phase begins with the calculation of a recommended sentencing range based on the U.S. Sentencing Guidelines. If a defendant has previously committed two violent crimes or drug offenses, the Guidelines designate him a career offender and drastically enhance his recommended sentencing range. The range is only advisory, but judges must consult and account for the range, and it plays an unquestionably significant role in the defendant’s ultimate sentence. What if the …

The 3-week January term incorporates high-impact educational practices to provide students with an integrated learning environment centered on citizenship. Students take courses that focus on a civic issue, or problem, while engaging in experiential learning opportunities and community service work with local, community-based partners. Thematic areas for courses include homelessness, environmental sustainability and urban renewal. The university works with local partner organizations to enhance students understanding of civic engagement. A pre-and-post-test assessment was designed and implemented, based on a prepared survey instrument, and on common essay assignments with common measurements to assess both the knowledge and attitudinal components of citizenship.

A Geographic Distribution Analysis And Examination Of Social-Psychological Factors And Their Lmpact On Death Penalty Support In The United States, Katy Moharter Apr 2016

A Geographic Distribution Analysis And Examination Of Social-Psychological Factors And Their Lmpact On Death Penalty Support In The United States, Katy Moharter

Masters Theses

Since the reinstatement of the death penalty in the United States in 1977, research has focused on shifting attitudes and waning public support for this institution. Support for the death penalty varies between different temporal, geographic, and demographic boundaries. Research also suggests that social-psychological factors such as attributional style and moral disengagement play a significant role in rationalization of death penalty support, as well as the intensity of the support. Aspects of moral disengagement serve as reliable predictors for death penalty support for a limited sample of participants, which this research intends to evaluate at a greater scale. This research …

The specific program material used in this treatment group is The Road to Freedom, by Morin and Levenson (2002). This experimental study utilized a paired-sample t-test to examine the differences between the first measurement and second measurement of three groups: current client, completed clients, and all clients.

The results demonstrated that this particular treatment program had …

Service And Learning For Whom? Toward A Critical Decolonizing Bicultural Service Learning Pedagogy, Kortney Hernandez Apr 2016

Service And Learning For Whom? Toward A Critical Decolonizing Bicultural Service Learning Pedagogy, Kortney Hernandez

LMU Theses and Dissertations

The notion of service has enjoyed historical longevity—rooted deeply within our institutions (i.e., churches, schools, government, military, etc.), reminiscent of indentured servitude, and rarely questioned as a colonizing practice that upholds oppression. Given the relentless insertion of service learning programs into working class communities, the sacrosanctity awarded and commonsensically given to service is challenged and understood within its colonial, historical, philosophical, economic, and ideological machinations. This political confrontation of service learning practices serves to: (a) critique the dominant epistemologies that reproduce social inequalities within the context of service learning theory and practice; and (b) move toward the formulation of a …

Communication And Competence For Self-Representation, E. Lea Johnston Apr 2016

Communication And Competence For Self-Representation, E. Lea Johnston

Fordham Law Review

In Indiana v. Edwards, the U.S. Supreme Court held that states may impose a higher competency standard for self-representation than to stand trial in criminal cases. While the Court articulated a number of interests relevant to representational competence, it left to states the difficult task of formulating an actual competence standard. This Article offers the first examination and assessment of the constitutionality of state standards post-Edwards. It reveals that seven states have endorsed a representational competence standard with a communication component. Additionally, twenty states have embraced vague, capacious standards that could consider communication skills. In applying these standards, states …

Guns And Drugs, Benjamin Levin Apr 2016

Guns And Drugs, Benjamin Levin

Fordham Law Review

This Article argues that the increasingly prevalent critiques of the War on Drugs apply to other areas of criminal law. To highlight the broader relevance of these critiques, this Article uses as its test case the criminal regulation of gun possession. This Article identifies and distills three lines of drug war criticism and argues that they apply to possessory gun crimes in much the same way that they apply to drug crimes. Specifically, this Article focuses on: (1) race- and class-based critiques; (2) concerns about police and prosecutorial power; and (3) worries about the social and economic costs of mass …

Using Rtp (Responsible Thinking Process) As A Lever For Improving School Culture: A Case Study Of An Alternative Secondary School’S Implementation Of Rtp, Andrew D. Rynberg

Dissertations

There is an urgent need to improve our K-12 system. How to implement and sustain educational change, however, is a challenge facing the K-12 arena. This qualitative case study was intended to examine a six-year educational change initiative in one alternative secondary school. The study helped us gain knowledge on implementing and sustaining educational change by addressing the following three research questions:

1. What were the staff members’ descriptions of disciplinary issues before and after the RTP intervention?

2. Based on staff descriptions, what were the factors associated with the successful implementation of the RTP program?

3. Based on staff …

Appraising 9/11: 'Sacred' Value And Heritage In Neoliberal Times, Mateo Taussig-Rubbo Apr 2016

Appraising 9/11: 'Sacred' Value And Heritage In Neoliberal Times, Mateo Taussig-Rubbo

Journal Articles

On September 11, 2001, United Airlines Flight 93 — one of the four airplanes hijacked that day — crashed into a vacant parcel of land in rural Pennsylvania, killing all on board. For many, including family members of those killed in the attack and the Park Service that now manages the national memorial at the site, the former strip mine was transformed into ‘sacred’ ground. Unable to settle on a price with the landowner, in 2009 the government took the property through eminent domain. Focusing on the ongoing effort in United States of America v. 275.81 Acres of Land to …

The Laws Of Agency Lawyering, George M. Cohen Apr 2016

The Laws Of Agency Lawyering, George M. Cohen

Fordham Law Review

The great variety of agency rules governing lawyers raises interesting questions that are worth exploring. This Article begins that exploration. Part I lays the groundwork by briefly examining how the ABA Model Rules treat regulatory lawyering to raise the question of what regulatory gaps the agency rules might be expected to fill. Part II sets forth several possible theories of agency rule variation. Part III compares agency rules along a number of dimensions, examines some similarities and differences across agencies as well as between the agency rules and the Model Rules, and offers speculations about what may be driving the …

Are Campus Sexual Assault Tribunals Fair?: The Need For Judicial Review And Additional Due Process Protections In Light Of New Case Law, Emily D. Safko Apr 2016

Are Campus Sexual Assault Tribunals Fair?: The Need For Judicial Review And Additional Due Process Protections In Light Of New Case Law, Emily D. Safko

Fordham Law Review

The pervasiveness of sexual assault on college and university campuses and the schools’ failures to take sexual assault seriously have resulted in recent reforms to college campus disciplinary proceedings. The federal government has largely prompted this wave of reform through Title IX, requiring schools to employ particular policies and procedures for investigating and adjudicating sexual assault as a condition of receiving federal funds. Although the federal government’s mandates may be properly motivated, these reforms are criticized because they encourage schools to enact procedures that are heavily stacked against those accused of sexual assault. Consequently, students alleging that they have been …

Crossing The Line: Daubert, Dual Roles, And The Admissibility Of Forensic Mental Health Testimony, Sara Gordon Apr 2016

Crossing The Line: Daubert, Dual Roles, And The Admissibility Of Forensic Mental Health Testimony, Sara Gordon

Cardozo Law Review

Psychiatrists and other mental health professionals often testify as forensic experts in civil commitment and criminal competency proceedings. When an individual clinician assumes both a treatment and a forensic role in the context of a single case, however, that clinician forms a dual relationship with the patient - a practice that creates a conflict of interest and violates professional ethical guidelines. The court, the parties, and the patient are all affected by this conflict and the biased testimony that may result from dual relationships. When providing forensic testimony, the mental health professional's primary duty is to the court, not to …

The Long-Term Economic Impact Of Juvenile Criminal Activity, Eric Hyla 16 Apr 2016

The Long-Term Economic Impact Of Juvenile Criminal Activity, Eric Hyla 16

The Park Place Economist

When the juvenile penal system is supposed to be focused on rehabilitation, how does committing crimes and being caught as juveniles affect their future economic success? In 2012, the FBI Arrest Statistics reports an estimated 1,319,700 minors were arrested. Since so many youths interact with the criminal system, it is vital for the strength of the workforce and for the quality of life of the minors to ensure that the system is rehabilitative. Using ordinary least squares regressions, I examine data collected from the National Longitudinal Survey of Youth's 1997 cohort, and examine how interactions with the formal juvenile correctional …

Starting Strong: Talent-Based Branching Of Newly Commissioned U.S. Army Officers, Michael J. Colarusso Dr., Kenneth G. Heckel Lieutenant Colonel, David S. Lyle Colonel, William L. Skimmyhorn Lieutenant Colonel Apr 2016

Starting Strong: Talent-Based Branching Of Newly Commissioned U.S. Army Officers, Michael J. Colarusso Dr., Kenneth G. Heckel Lieutenant Colonel, David S. Lyle Colonel, William L. Skimmyhorn Lieutenant Colonel

Books, Monographs & Collaborative Studies

Because the U.S. military's long-held advantage in physical capital and equipment is waning, cutting-edge human capital management is more critical than ever before. The authors of "Starting Strong" argue that by gathering detailed information on the unique talents possessed by each newly commissioned Army officer, as well as on the unique talent demands of each Army basic branch, the Army can create a "talent market" that identifies and liberates the strengths of every officer, aligning each with the career field where they are most likely to be engaged, productive, and satisfied leaders. Strong evidence demonstrates that this talent-based approach better …

“Just Young Dudes Having Fun”?: Social Media Reactions To The Odu Banner Incident, Ashley Marie Giraldi

Sociology & Criminal Justice Theses & Dissertations

“Rowdy and fun. Hope your baby girl is ready for a good time…” This statement was on the first of three banners hung from a fraternity home’s balcony on freshman move-in day. The second banner stated, “Freshman drop off here” with an arrow pointing to the front door of the home. The final banner suggested, “Go ahead and drop off mom too…” These banners demonstrated the explicit implementation of rape culture in the university setting. Rape culture includes humor that normalizes violence against women, such as the alleged joke that constituted the ODU banner incident. This research explored societal responses …
