Second Looks For Sentencing Equality, Joshua D. Weiss

This Article challenges a persistent assumption about the relationship between so-called “second look” laws and sentencing disparities. Courts, the United States Sentencing Commission, and scholars tend to assume that increasing judicial discretion to reduce previously imposed sentences on an individualized basis results in increased sentencing disparities. But this assumption is based on a limited focus on disparities caused by judges and fails to account for disparities caused by other institutional actors, especially prosecutors.

Barriers Behind Bars: The Prison Litigation Reform Act And Prisoner Litigants' Struggle For Access To Justice, Brooke Stivers

Access to the courts is a constitutionally recognized right; however, prisoner litigants seeking to pursue this right through 42 U.S.C. § 1983 actions are significantly constrained by the procedural barriers imposed by the Prison Litigation Reform Act. Congress enacted the PLRA in response to a surge in prisoner litigation in the federal courts, and in effect established stringent procedural requirements that prisoner litigants must satisfy before filing a claim. This comment focuses on the requirements that a prisoner litigant must exhaust all administrative remedies and plead a plausible claim. Research has shown that attainment of higher education reduces the likelihood of recidivism, which is also known as reoffending (National Institute of Justice, n.d.). Based upon the research, formerly incarcerated individuals with higher levels of education tend to exhibited lower rates of recidivism upon re-entry into the community. This suggests that educational opportunities are crucial for successful reintegration into the community and for reducing recidivism (Appleby, 2023). It is time to reorient the debate over the right to a human decision. Within that debate, the strongest arguments in favor of human decisionmakers are Arguments from Explanation: AI technology is increasingly and necessarily opaque, and so machines should not replace human decisionmakers because machines cannot give the required explanations. Or so the humanist argument goes. Meanwhile, machinists argue that most humanist principles have been deflated by the Better Decision Argument, which reframes such principles as grounding not a right to a human decision, but merely to a “better” decision— whether by human or machine.

บทความชิ้นนี้ศึกษากลไกการปรับตัวทางเศรษฐกิจและการเมืองของสาธารณรัฐประชาธิปไตยประชาชนลาวภายหลังยุคสังคมนิยม โดยมุ่งเน้นการอธิบาย “ภาคแสดงของกลไกการปรับตัว” ผ่านแนวคิดการประกอบร่วม (Assemblage) การอธิบายกลไกดังกล่าวศึกษาด้วยวิธีการเชิงชาติพันธุ์วรรณนา (Ethnography) จากการเดินทางร่วมกับรถบรรทุกน้ำมันเชื้อเพลิงข้ามพรมแดนไทย-ลาว ผ่านสะพานมิตรภาพไทย-ลาวแห่งที่ 1 และ 2 เพื่อสำรวจกลไกที่ประกอบร่วมกันในการดำรงอยู่ของรัฐสังคมนิยมลาว ระยะเวลาการเก็บข้อมูลเริ่มตั้งแต่เดือนมกราคม 2567 จนถึงเดือนเดือนกุมภาพันธ์ 2567 รวมระยะเวลาทั้งสิ้น 2 เดือน ผลการศึกษาชี้ให้เห็นว่า น้ำมันเชื้อเพลิงและสะพานมิตรภาพไทย-ลาวเป็นผู้กระทำ (Actant) สำคัญในภาคแสดงของกลไกการปรับตัวต่อความเป็นรัฐสังคมนิยม งานศึกษานี้เสนอว่า การเข้าใจกลไกการปรับตัวต่อความเป็นรัฐสังคมนิยมจำเป็นต้องพิจารณาการประกอบร่วมจากผู้กระทำอื่นนอกเหนือจากรัฐ ซึ่งช่วยอธิบายความต่อเนื่องของการคงความเป็นสังคมนิยมของสาธารณรัฐประชาธิปไตยประชาชนลาว

Thailand’S Alignment Strategy Amidst The Us-China Rivalry : A Role Theory Perspective, Wen Chou Han

This paper seeks to analyze how Thailand, as a middle power, navigates its alignment choices amid an intensifying US-China rivalry in the Asia-Pacific region through the lens of role theory. This paper also proposes several original mechanisms to operationalize the role theory in the analysis of Thailand’s strategy. To this end, Thailand’s foreign policy from the past decade (2012 to mid-2025) will be reviewed. The central argument is that Thailand is adopting a “soft hedging” strategy marked by opportunism and driven by its key goal of development, but is, at the same time, complicated by domestic political dysfunction (“fragmented centralism”). …

กระบวนการเรียนรู้โดยชุมชนท้องถิ่นเป็นฐานเพื่อการยกระดับและสร้างคุณค่าทางเศรษฐกิจ จากฐานทุนในพื้นที่ : กรณีศึกษาเทศบาลเมืองสิงหนคร จังหวัดสงขลา, เธียรชัย พันธ์คง, ฟาริดา ซาชา, ธนากร พฤกษ์รัตนนภา, จักรกฤษณ์ หมั่นวิชา

งานวิจัยนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาบริบทฐานทุนและเศรษฐกิจชุมชนในสิงหนคร 2) วิเคราะห์และสังเคราะห์กระบวนการเรียนรู้โดยชุมชนท้องถิ่นเป็นฐาน (Community-based learning : CBL) และ 3) สังเคราะห์ผลลัพธ์ของกระบวนการเรียนรู้และจัดทำข้อเสนอแนะเชิงนโยบายและแบบจำลองการพัฒนาเพื่อยกระดับและสร้างคุณค่าทางเศรษฐกิจจากฐานทุนในพื้นที่อย่างยั่งยืน โดยศึกษาพื้นที่ชุมชนเทศบาลเมืองสิงหนคร จังหวัดสงขลา ใช้วิธีวิจัยเชิงคุณภาพ (Qualitative research) แบบการวิจัยเชิงปฏิบัติการแบบมีส่วนร่วม (Participatory action research : PAR) กลุ่มผู้ให้ข้อมูลสำคัญ ได้แก่ เทศบาลเมืองสิงหนคร กรมศิลปากร สำนักศิลปากรที่ 11 สงขลา เครือข่ายการศึกษาในพื้นที่ กลุ่มสตรี ผู้สูงอายุ กลุ่มวิสาหกิจชุมชน เกษตรกร ชาวประมง ผู้ประกอบการธุรกิจรายย่อยในพื้นที่ และกลุ่มภาคีต่าง ๆ
ผลการวิจัยพบว่า ทุนทางทรัพยากรและเศรษฐกิจที่สำคัญ ได้แก่ ผลิตภัณฑ์สิ่งบ่งชี้ทางภูมิศาสตร์ (GI) 3 รายการ คือ ปลากะพงสามน้ำ มะม่วงเบาสงขลา และไข่ครอบสงขลา ทรัพยากรในทะเลสาบสงขลา การรวมกลุ่มของวิสาหกิจชุมชน เช่น กลุ่มขนมโบราณ กลุ่มผ้ามัดย้อม กลุ่มมะม่วงเบา กลุ่มปลากรอบ ทุนทางวัฒนธรรมและประวัติศาสตร์ที่สำคัญ คือ ประวัติศาสตร์เมืองเก่าสิงหนคร (ซิงกอรา) และทุนทางสังคม คือ วิถีชีวิตคนพุทธ-มุสลิมที่กลมกลืน มีเครือข่ายการศึกษาและกลุ่มอนุรักษ์ทรัพยากรชายฝั่ง กระบวนการเรียนรู้ของชุมชนเพื่อการพัฒนาทางเศรษฐกิจและสังคมในพื้นที่ เกิดจากความเชื่อมโยงระหว่างภูมิปัญญาท้องถิ่นกับการได้รับความรู้จากภาครัฐ สถาบันการศึกษา ภาคเอกชน และอาศัยเทคโนโลยีดิจิทัลในการอัปเดตองค์ความรู้ ผลลัพธ์ของกระบวนการเรียนรู้ ได้แก่ การพัฒนาผลิตภัณฑ์ใหม่ 6 ชนิด จำนวนกลุ่มเปราะบางที่ได้รับการพัฒนาทักษะอาชีพ 93 คน กลุ่มวิสาหกิจจำนวน 19 กลุ่ม ที่มีรายได้เพิ่มขึ้นร้อยละ 10 และพัฒนาพื้นที่การเรียนรู้ จำนวน 5 แห่ง สำหรับข้อเสนอแนะ การวิจัยควรมีการพัฒนาอาชีพเสริม เช่น การทำขนมและการแปรรูปอาหารทะเลที่เชื่อมโยงเรื่องราวประวัติศาสตร์และวิถีชีวิตเข้ากับการออกแบบผลิตภัณฑ์ใหม่ และใช้การตลาดดิจิทัล เพื่อเชื่อมโยงเส้นทางท่องเที่ยวชุมชน ผ่านกลไกการเรียนรู้โดยใช้ฐานทุนในพื้นที่เป็นหลัก

ในปัจจุบัน สถานการณ์อาชญากรรมรุนแรงที่กระทำโดยเด็กและเยาวชนมีแนวโน้มทวีความรุนแรงและเพิ่มสูงขึ้นอย่างต่อเนื่อง โดยเฉพาะอย่างยิ่งในเขตกรุงเทพมหานคร ซึ่งนับเป็นพื้นที่ที่มีอัตราการก่ออาชญากรรมในระดับสูง การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษาบทบาทและหน้าที่ของเจ้าหน้าที่ตำรวจในกระบวนการบังคับใช้กฎหมาย รวมถึงปัญหาและอุปสรรคที่เกิดขึ้นในการปฏิบัติงาน ตลอดจนแนวทางการเพิ่มประสิทธิภาพการบังคับใช้กฎหมายต่อกลุ่มเด็กและเยาวชนผู้กระทำความผิดในคดีอาชญากรรมรุนแรง การวิจัยครั้งนี้ใช้ระเบียบวิธีวิจัยเชิงคุณภาพ (Qualitative research) โดยมีเครื่องมือหลักในการเก็บรวบรวมข้อมูล ได้แก่ การสัมภาษณ์เชิงลึก (In-depth interview) กับผู้ให้ข้อมูลสำคัญ (Key informants) จำนวนทั้งสิ้น 13 คน ประกอบด้วย เจ้าหน้าที่ตำรวจ นักจิตวิทยา นักสังคมสงเคราะห์ และพนักงานอัยการ
ผลการวิจัยพบว่า เจ้าหน้าที่ตำรวจมีบทบาทครอบคลุมกระบวนการทุกขั้นตอน ได้แก่ การป้องกันการกระทำความผิดผ่านโครงการและกิจกรรมเชิงรุก การจับกุมโดยใช้มาตรการที่เหมาะสมกับสภาพจิตใจและพัฒนาการของเด็ก การควบคุมตัวในสถานที่แยกจากผู้กระทำความผิดที่เป็นผู้ใหญ่ และการสอบสวนแบบสหวิชาชีพร่วมกับนักจิตวิทยา นักสังคมสงเคราะห์ และพนักงานอัยการ อย่างไรก็ตาม การวิจัยพบปัญหาสำคัญหลายประการ อาทิ ช่องว่างของบทบัญญัติทางกฎหมายที่เปิดโอกาสให้ผู้ใหญ่แสวงหาประโยชน์จากเด็กและเยาวชน ความซับซ้อนของกระบวนการและข้อจำกัดด้านระยะเวลา การขาดสมรรถนะและความเชี่ยวชาญของบุคลากร ภาวะการขาดแคลนกำลังพลเฉพาะทาง เป็นต้น

บทความวิจัยนี้มีวัตถุประสงค์เพื่อศึกษารูปแบบและกลยุทธ์การสื่อสารทางการเมืองของนายกเทศมนตรีนครยะลาในการบริหารจัดการอุทกภัย และวิเคราะห์ประสิทธิผลของกลยุทธ์การสื่อสารทางการเมืองที่มีต่อการสร้างการมีส่วนร่วมของประชาชน โดยใช้วิธีการวิจัยเชิงคุณภาพแบบกรณีศึกษา และเก็บรวบรวมข้อมูลผ่านการสัมภาษณ์เชิงลึกผู้ให้ข้อมูลหลัก 8 คน ประกอบด้วย นายกเทศมนตรีนครยะลา ปลัดเทศบาลนครยะลา หัวหน้าฝ่ายป้องกันและบรรเทาสาธารณภัยเทศบาลนครยะลา เจ้าหน้าที่ฝ่ายป้องกันและบรรเทาสาธารณภัยเทศบาลนครยะลา ผู้รับบริการและผู้มีส่วนได้ส่วนเสียในระดับชุมชนและการวิเคราะห์เอกสารที่เกี่ยวข้อง ได้แก่ แผนการบริหารจัดการอุทกภัย รายงานผลการดำเนินงาน และข้อมูลจากสื่อสังคมออนไลน์ จากนั้นวิเคราะห์ข้อมูลด้วยการวิเคราะห์เนื้อหาโดยใช้กรอบทฤษฎีการสื่อสารในภาวะวิกฤต แนวคิดการสื่อสารทางการเมือง และแนวคิดการสร้างความยืดหยุ่นของเมือง ผลการศึกษาพบรูปแบบการสื่อสาร 5 ลักษณะ คือ การสื่อสารหลายช่องทางแบบบูรณาการ (ดิจิทัล ช่องทางดั้งเดิม และนวัตกรรม IoT) การสื่อสารแบบเรียลไทม์ 3 ระยะ มีการแจ้งล่วงหน้า 8 ชั่วโมง การจัดวางตำแหน่งของเทศบาลเป็นศูนย์กลางข้อมูลที่สามารถชี้แจงต่อสาธารณะ และมีการเปิดเผยข้อมูล ผ่านกลไกต่าง ๆ ประกอบด้วย สภากาแฟ การดูงาน และการประสานผู้ช่วยชุมชน 44 คน และการสร้างเครือข่าย Win-Win กับองค์กรปกครองส่วนท้องถิ่น 20 แห่ง ส่งผลให้เกิดผลสัมฤทธิ์ที่สำคัญ 4 ด้าน ประกอบด้วย การเพิ่มการมีส่วนร่วม (ตัวแทนครัวเรือน 10,000 จาก 25,000 ครัวเรือน อาสาสมัคร 176 คน) การสร้างความไว้วางใจที่สั่งสม 20-21 ปี การเพิ่มประสิทธิภาพการรับมือภัยพิบัติ (ตอบสนองรวดเร็วกว่าหน่วยงานอื่น) และการพัฒนานวัตกรรมอย่างต่อเนื่อง ทั้งนี้ องค์ประกอบของความสำเร็จเกิดขึ้นมาจากความโปร่งใสและการแสดงให้เห็นการทำงานจริง การเปิดโอกาสให้ประชาชนมีส่วนในการตัดสินใจ การคัดเลือกตัวแทนแต่ละหมู่บ้าน การแก้ปัญหาข้ามเขตตามหลักการ Win-Win และบารมีของผู้บริหารที่สั่งสมมา ซึ่งคุณลักษณะดังกล่าวสามารถนำไปประยุกต์ใช้ในการพัฒนากระบวนการบริหารจัดการภัยพิบัติในพื้นที่อื่น ๆ ได้อย่างมีประสิทธิภาพ

This article explores how community and civil society actors in mining conflicts strategically engage with legal and technical vocabularies to assert legitimacy, contest exclusion, and influence mining governance. Drawing on an empirical case study of Thailand’s Chatree gold mine, the article analyzes how affected groups navigate overlapping normative systems, such as state law, transnational norms, and technocratic discourses, through informal learning and strategic appropriation of expert language. Framed through the conceptual lens of legal pluralism, the study highlights how actors interpret and mobilize diverse normative orders to articulate grievances, shape narratives, and attempt to gain access to decision-making spaces. This mixed-methods Improvement Science Dissertation in Practice (ISDiP) examined high rates of segregation for students receiving special education services in an urban district in central Connecticut. A root cause analysis, supported by a review of existing literature, guided the need for intervention given the widening gap between academic achievement and post-secondary outcomes for students with disabilities as compared to their peers at the secondary level. Using an improvement science framework within a convergent mixed-methods design, this study investigated the implementation of a six-week professional learning intervention for high school administrators. The new judicial federalism is now entering its early middle age. As it has matured—moving from rights to structure—it has become more complicated in its application. For if one were to take arguments about state experimentation and interpretive flexibility to their logical conclusion, there is no reason state legislative, executive, and judicial powers should stay in lanes demarcated by federal constitutional law. Easily amended state constitutions and elected judges support theories of judicial function more akin to statewide legislative policymakers than passive judicial magistrates. In 1988, the Anti-Drug Abuse Act authorized the use of the death penalty for individuals who committed murder while involved in certain federal drug crimes. In recent years, as America has grappled with rising opioid overdose deaths, there has been an increase in calls for expanding murder charges and capital punishment for individuals who deliver drugs that result in an overdose death. Utilizing content analysis of news media and presidential speeches, this paper explores the claims-making process surrounding the arguments in favor of sentencing people who deal drugs to death during the 1980s and the contemporary opioid crisis. This dissertation explores the transformation of police officers into community peace officers by examining the mental and moral conflicts inherent in community engagement and law enforcement. Using scholarly personal narrative (SPN) as my methodology, the study integrates my lived experience as a Black law enforcement officer with broader discussions on race, power, leadership, and institutional culture. Grounded in critical race theory, social justice leadership, and trauma theory, the research investigates how systemic inequities, organizational resistance, and historical trauma influence policing practices and officer identity. Substance use and overdose deaths have been disproportionally disrupting families and communities in rural America. Increasing rates of drug use in these areas can be traced to the outsourcing of blue-collar work to outside of the United States, which economically restructured these areas by decreasing the profitability of generational industries. This is the story playing out in Georgia’s commercial shrimping industry and the communities it used to support. This research uses qualitative data collected over the past ten years to understand the perceptions and impacts of drug use on Georgia’s shrimping community. The criminal legal system in the United States is plagued by serious and systemic problems. There have been countless efforts at reform over the last many decades that have included changes in what is a crime, how crimes are punished, how prosecutors do their job, and changes in policing. Yet, despite these efforts, problems such as mass incarceration remain deeply embedded. It is easy to be swept up in pessimism when discussing the criminal legal system. Information-intensive activities are reshaping political, social, and economic institutions. As they respond to these shifts, legislators and regulators are embracing information as a regulatory device for tech. Far from limiting themselves to public disclosure, consumer notice, and other traditional mechanisms of fostering transparency and information flows, however, legislators are using other, more nuanced tools to incentivize regulated entities to obtain, generate, and share information.

This thesis examines the reconfiguration of racial and labor subordination in the United States from Reconstruction to the present, arguing that the legal abolition of slavery did not dismantle the economic and institutional structures on which it rested. It traces a continuous trajectory through which law and the criminal justice system were systematically weaponized to reconstitute slavery's essential functions under successive institutional forms, each serving as a deliberate mechanism for the extraction of Black labor in service of private and state interests. Does Immigration Enforcement Induce Legalization? Replicating And Extending The H-2b Evidence To Agricultural Guest Workers, Katherine E. Schwab

This thesis examines whether intensified interior immigration enforcement leads employers to increase demand for legal temporary foreign workers through the H-2 guest-worker programs. Using updated administrative data from the Office of Foreign Labor Certification, I first replicate the core findings of Amuedo-Dorantes, Arenas-Arroyo, and Schmidpeter (2021), who find that county-level enforcement significantly raises employer demand for H-2B non-agricultural workers, then apply the same empirical framework to H-2A, the agricultural equivalent.
My replication results are directionally consistent with the original study – the enforcement coefficient on H-2B demand is positive across specifications – though weaker in significance, reflecting routine vintage differences …

In December 2025, Alberta became the second Canadian province to grant its Attorney General statutory immunity from law society discipline. This comment analyzes this amendment to the Legal Profession Act and the rationales and critiques that emerged during the legislative process. It argues that, while some of the critiques were misplaced, the rationales given by the government are problematic in themselves and insufficient to justify the tension between the immunity of the Attorney General to law society discipline and the constitutional principle of the rule of law. This research paper investigates how language-of-instruction policies shape educational inequality and identity formation among Rohingya refugee children living in protracted displacement in Cox’ Bazar, Bangladesh. Analyzed from a human right–based framework, the study examines whether existing educational policies align with international legal standards on the right to education, including the UDHR, ICESCR, Child Convention and SDG 4. While these frameworks guarantee non-discriminatory and inclusive access to education, the reality in Cox’s Bazar reveals a persistent gap between normative commitments and policy implementation. Twenty-five years after adopting the United Nations Trafficking Protocol, anti-trafficking scrutiny is finally being brought to bear on forced labour in global supply chains. This article identifies and examines key aspects of the contemporary governance regime developed to address this endemic problem: corporate social initiatives and transparency legislation, human rights due diligence laws, strategic litigation, and forced labour import bans. As explored in this article, the interplay between public and private governance these interventions entail has a significant impact on whether workers ultimately benefit from these efforts.
