Human Trafficking: Exploration Of Best Practices For Restoration And Integration For Survivors In Southeastern United States, Joel D. Shafer Mr.
Human Trafficking: Exploration Of Best Practices For Restoration And Integration For Survivors In Southeastern United States, Joel D. Shafer Mr.
Honors College Theses
Domestic human trafficking, especially of minors, has become a serious though largely
invisible issue in the United States. There are, however, organizations and policies in place that
have become active in caring for, restoring and reintegrating those survivors who have been able
to escape. Through the perspectives of service providers, this exploratory qualitative study
examines the factors of vulnerability of victims, the issues that support reintegration for
survivors and the best practices as well as indicators of success when caring for survivors. This
was accomplished through in-depth, semi-structured interviews with representatives from
various social service agencies in Georgia that are …

Prosecuting Child Soldiers: The Call For An International Minimum Age Of Criminal Responsibility, Brittany Ursini
St. John's Law Review
(Excerpt)
This Note discusses the current state of international law on the MACR and proposes a solution that balances the protection of child soldiers with the rights of the victims harmed by their unlawful conduct. Part I of this Note provides a brief background of child soldiers and closely examines the relevant international law addressing the criminal responsibility of child soldiers. Part II illustrates the deficiencies of current international law and describes how the deficiencies affect and contribute to the competing arguments regarding a MACR. Part III discusses the need for an international MACR. Finally, Part IV proposes an international …

An Evolving Workforce, An Adapting Law: Title Vii's Coverage Of Gender Identity And Criminal History, Sandra Pullman
St. John's Law Review
(Excerpt)
In the half-century since the passage of the Civil Rights Act of 1964, workplace protections under the statute have expanded in a variety of ways. Legal theories that were once considered novel have increasingly been accepted in federal courts across the country, extending coverage to more employees than ever before. Yet, an analysis of these developing issues also exposes the limitations of federal antidiscrimination law. Below, this Article examines the ways that Title VII has been applied to two particularly vulnerable groups: transgender individuals and individuals with criminal records.

Confronting (In)Security: Forging Legitimate Approaches To Security And Exclusion In Migration Law, Angus Gavin Grant
Confronting (In)Security: Forging Legitimate Approaches To Security And Exclusion In Migration Law, Angus Gavin Grant
PhD Dissertations
Perceived connections between security concerns and migration are a central preoccupation of our time. This dissertation explores how the preoccupation has played out in the Canadian context and asserts that a basic and common infirmity of administrative decision-making in this domain is a lack of justification. The dissertation commences by exploring foundational debates within immigration theory about borders, exclusion, the rule of law and the role of justification in decision-making in liberal democracies, particularly in times of perceived emergency. From there, the dissertation moves on to an exploration of immigration inadmissibility determinations in Canada, with particular attention to the emergence …

Media Representations Of Offenders In Televison Series "Law And Order", Darcy L. Sullivan
Media Representations Of Offenders In Televison Series "Law And Order", Darcy L. Sullivan
Scholars Week
Media representations of offenders have varied over time; the rise of television media was an era in which offenders were depicted as active decision makers who committed deviant acts to attain their desires. Overtime, this image evolved into the current depiction of offenders as animalistic and inherently evil white males of upper socioeconomic status who are animalistic. Throughout the life of television media depictions of have ignored offender race, gender, and socioeconomic status, creating constructed realities that do not adequately reflect offenders in the United States. Thus, it is important to study how media depicts crime, criminals, and the criminal …

Exploring Cross-National Differences In The Incarceration Of Women: A Conjunctive Analysis Approach, Breanna Boppre, Terance D. Miethe, Emily J. Salisbury
Graduate Research Symposium (2010 - 2017)
Cross-national studies of imprisonment rates have examined the social, political, and economic conditions associated with criminal punishments. However, because of the higher numbers of male incarcerated and the lack of national data disaggregated by gender, most previous research on imprisonment rates has focused directly or indirectly on the socio-economic predictors of male imprisonment rates. Using disaggregated data for 128 nations, the current study employs the method of conjunctive analysis to explore the unique and common effects of particular social conditions that underlie female incarceration rates. Measures of nations’ social development, violent crime rates, socio-economic inequality, and political instability are used …
Abuse Us And Lose Us: Regional Effects Of Disarming Domestic Violence Offenders, Dory Mizrachi
Abuse Us And Lose Us: Regional Effects Of Disarming Domestic Violence Offenders, Dory Mizrachi
Graduate Research Symposium (2010 - 2017)
Domestic violence is among one of the most underreported crimes in the United States. Yet, national and international estimates suggest that approximately one in three girls/women will experience domestic violence. Research also demonstrates that this form of gendered violence is commonplace in the lives of millions of women and that it has deleterious outcomes, such as intimate partner homicide. It was not until recent decades that several legislations have been enacted to combat this critical problem. The Lautenberg Amendment, also known as the Domestic Violence Gun Ban of 1996 provided an essential addition to the Gun Control Act of 1968. …
Engagement And Control: Comparing Participation Structures In The Guardian And Washington Post's Coverage Of People Killed By Police, Dan Michalski
Engagement And Control: Comparing Participation Structures In The Guardian And Washington Post's Coverage Of People Killed By Police, Dan Michalski
Graduate Research Symposium (2010 - 2017)
People killed by police have become a focus of current political and social discourse related to criminal justice reform in the United States. Two data journalism projects by respected news media have been central to many of these discussions. The Guardian’s The Counted and Washington Post’s Investigation: Police Shootings have each attempted to create a running log of fatalities at the hands of law enforcement. Such an endeavor not only has added to a collective consciousness about the scope and commonality of deadly police encounters, but also has led to legislation toward police accountability reforms, including greater use of cameras …

Power Of Perspective: The Effects Of Public Perceptions Of Police And Fear Of Crime On Attitudes Towards Aerial Drone Use, Olivia G. Tuttle, Miliaikeala S.J. Heen, Mari Sakiyama, Terance D. Miethe, Joel D. Lieberman
Graduate Research Symposium (2010 - 2017)
Historically, unmanned aerial systems (UAS; i.e., drones) have largely been used by the military and federal government. As UAS have become more affordable and easier to operate in recent years, state and local law enforcement agencies have become interested in adopting this technology to facilitate a wide range of police activities (e.g., search and rescue, surveillance, tactical operations, etc.). The Federal Aviation Administration (FAA) has begun to regulate the use of unmanned aerial systems, which will likely lead to the increased use of drone technology by law enforcement agencies across the country in upcoming years. However, previous research suggests that …

Montana Standard Interviews Barbara Creel On The Violence Against Women Act And Double Standards, Barbara L. Creel
Montana Standard Interviews Barbara Creel On The Violence Against Women Act And Double Standards, Barbara L. Creel
Faculty Scholarship
Barbara Creel, Southwest Indian Law Clinic Director Professor at the University of New Mexico, agreed with Babcock that the case was not about tribal sovereignty.
Yet she said the case reveals inequities in the criminal justice system of tribes created when Congress told them how to structure their governments under the Indian Reorganization Act but did not provide sufficient funding or additional legal protections to make those systems function as intended.
Additionally, in a brief she and colleagues filed to the court, Creel argues that the Violence Against Women Act creates a discriminatory double standard.

Considerations When Implementing Trauma-Informed Care Into Male Domestic Violence Offenders' Intervention Programs, Elizabeth S. Sewell
Considerations When Implementing Trauma-Informed Care Into Male Domestic Violence Offenders' Intervention Programs, Elizabeth S. Sewell
Counseling
This project addresses significant factors to consider when implementing trauma-informed care in Batterer’ Intervention Programs. Literature addressing trauma informed care and domestic violence interventions is discussed to demonstrate how trauma-informed care might be used with male perpetrators of domestic violence. There is a gap in the literature describing how trauma-informed care is integrated with domestic violence perpetrators, and this gap is surprising due to extensive literature supporting a clear link between trauma history and violent criminality. A checklist was created using the best practices in trauma-informed approaches and is intended to be used by agencies in a clinical setting, including …
