An Investigation Of Motor Vehicle Driver Inattention And Its Effects At Highway–Rail Grade Crossings, Shanshan Zhao Jun 2016

An Investigation Of Motor Vehicle Driver Inattention And Its Effects At Highway–Rail Grade Crossings, Shanshan Zhao

Department of Civil and Environmental Engineering: Dissertations, Theses, and Student Research

The relationship between accident injury severity and drivers’ inattentive behavior requires an in-depth investigation – this is especially needed in the case of motor vehicle drivers at highway-rail grade crossings (HRGCs). The relationship between drivers’ personality/ socioeconomic characteristics and inattentive behavior at HRGCs is another topic requiring research. Past educational programs about safe driving at HRGCs have often not been designed to target people who may be in urgent need of such information, which may limit the effectiveness of those programs.

This dissertation thus focuses on the following four objectives: to investigate the association between motor vehicle inattentive driving and …

A Legacy That No One Can Afford To Inherit: The Gold King Disaster And The Threat Of Abandoned Hardrock Legacy Mines, Kelly Roberts Jun 2016

A Legacy That No One Can Afford To Inherit: The Gold King Disaster And The Threat Of Abandoned Hardrock Legacy Mines, Kelly Roberts

Journal of the National Association of Administrative Law Judiciary

This article begins with a description of the alarming matter of abandoned mines, mainly due to the issue of acid mine drainage. Then, it provides a detailed account of the Gold King disaster, including the current state of affairs surrounding the question of EPA liability. Next, it provides a simplified overview of some of the federal statutory hurdles that make it difficult to tackle remediation of abandoned hardrock mines. In wake of Gold King, another round of legislation has been proposed that might help, and these proposed bills center on familiar themes of reforming the General Mining Law of 1872 …

Report To The California Public Utilities Commission Regarding Ex Parte Communications And Related Practices, Michael J. Strumwasser, Beverly Grossman Palmer, Dale K. Larson Jun 2016

Report To The California Public Utilities Commission Regarding Ex Parte Communications And Related Practices, Michael J. Strumwasser, Beverly Grossman Palmer, Dale K. Larson

Journal of the National Association of Administrative Law Judiciary

Part I contains the analysis of existing law. We review the statutes and regulations governing ex parte communications before the CPUC, examine corresponding laws of other jurisdictions, and compare the CPUC statutes and regulations with those of the other jurisdictions. In Part II we examine actual ex parte practices before the CPUC. Based on data obtained from notices filed on the Commission’s website by parties to rate-setting cases, we provide a quantitative characterization of the extent and nature of noticed ex parte communications over the past roughly 22 years. We then place ex parte communications within the context of the …

Prison Programs To Reduce Recidivism: What Is The Ideal Structure Of An Inmate Reentry Program?, Magali Davila-Centeno Jun 2016

Prison Programs To Reduce Recidivism: What Is The Ideal Structure Of An Inmate Reentry Program?, Magali Davila-Centeno

University Honors Theses

In the United States' correctional system, inmate programs within prisons often do not reduce recidivism. Recent surveys have shown that across the country many prisons have a form of a Prison Based Animal Program (PAP). This study examines the effect that Prison based Animal Programs have on reducing recidivism through their therapeutic effects, focusing specifically on identifying the best practices for structuring such programs and measuring outcomes, for which there is little research. The research is based on a review of journal articles, industry reports, and a case study of a PAP. The analysis incorporates the shift in emphasis from …

The Fourth Amendment Implications On The Real-Time Tracking Of Cell Phones Through The Use Of “Stingrays”, W. Scott Kim Jun 2016

The Fourth Amendment Implications On The Real-Time Tracking Of Cell Phones Through The Use Of “Stingrays”, W. Scott Kim

Fordham Intellectual Property, Media and Entertainment Law Journal

The rights secured to us by the Fourth Amendment were the driving force behind the American Revolution. Today, law enforcement seems to forget that fact when they use cell-site simulators, commonly referred to by the brand name “Stingray,” without first securing a warrant. These devices mimic cell phone towers and force cell phones near them to connect to the cell-site simulator instead of a tower, thereby allowing the user of the simulator device to track a cell phone to its precise location. Ninety-two percent of Americans own a cell phone and forty-six percent of smartphone users say they could not …
