Master's Theses

2010 And 2013 Data Set Of Building Footprint Shapes And Points For Boise Idaho And Surrounding Region, Khila R. Dahal, Christopher Felt

MILES Data Sets

This is a data set representing a subset of buildings and structures, within areas of special interest in Boise, Idaho and the surrounding region. The polygons and points are a best guess representation, generally determined from aerial photography, of the location and exterior shapes of the buildings. Building footprints may include roof overhangs, coverings for decks, and attached outbuildings that are not distinguishable from the main building. The polygons do not represent true building footprints. The data was originally collected by Geographic General, Inc. from 1986 aerial photography, and is now maintained by City of Boise GIS. Because data collection …

Copyright’S Other Functions, Margaret Chon Jun 2016

Copyright’S Other Functions, Margaret Chon

Chicago-Kent Journal of Intellectual Property

This response to a keynote speech by Judge Margaret McKeown explores some dimensions of copyright in addition to its dominant function as a set of market-facilitating exclusive rights. The recent possible trend towards protecting privacy and other non-commercial concerns via copyright law is not necessarily inconsistent with its historical usages, does not necessarily threaten freedom of expression and may further important privacy policies. The balance of these competing policies is shifting, especially in an environment of proliferating digital content where cyber civil rights may need further development in response to cyberbullying. It examines the specific case of non-consensual pornography as …

Town And Gown Relations: Finding Equitable Prosperity For Neighborhood Resident Stakeholders, Ian T. Foley Jun 2016

Town And Gown Relations: Finding Equitable Prosperity For Neighborhood Resident Stakeholders, Ian T. Foley

Theses and Dissertations

An effective and prosperous community is measured by the sum of its parts, and in the case of a college town, everyone from the college students, to the neighborhood residents are stakeholders in what represents a college town. The neighborhood resident is a less researched stakeholder, but none the less important in understanding challenges. This study expands the limited knowledge base on attitudes of neighborhood resident stakeholders in college towns. A randomized door-to-door survey was conducted in the Glassboro, New Jersey neighborhood surrounding Rowan University, collecting the attitudes of permanent residents regarding interactions with students, property and public safety concerns, …

Moving Beyond Miranda: Concessions For Confessions, Scott W. Howe Jun 2016

Moving Beyond Miranda: Concessions For Confessions, Scott W. Howe

Northwestern University Law Review

The law governing police interrogation provides perverse incentives. For criminal suspects, the law rewards obstruction and concealment. For police officers, it honors deceit and psychological aggression. For the courts and the rest of us, it encourages blindness and rationalization. This Article contends that the law could help foster better behaviors. The law could incentivize criminals to confess without police trickery and oppression. It could motivate police officers involved in obtaining suspect statements to avoid chicanery and duress. And, it could summon courts and the rest of us to speak more truthfully about whether suspect admissions are the product of informed, …

Litigating Medical Device Premarket Classification Decisions For Small Businesses: Have The Courts Given The Fda Too Much Deference? The Case For Taking The Focus Off Of Efficacy, Stephanie P. Fekete Jun 2016

Litigating Medical Device Premarket Classification Decisions For Small Businesses: Have The Courts Given The Fda Too Much Deference? The Case For Taking The Focus Off Of Efficacy, Stephanie P. Fekete

Catholic University Law Review

The manufacturing of innovative medical devices is important for the continued success and growth of the U.S. health care system and economy. The medical device industry is almost exclusively comprised of small businesses. The U.S. Food and Drug Administration (FDA) regulates the medical device industry and employs a rigorous approval process to determine when products may enter the market. While the FDA’s goal is to authorize the sale of innovative devices that are safe for patient use, device manufacturers argue that the process to obtain FDA approval is unnecessarily expensive, burdensome, and has systemic problems. As a result of the …

Wake Effects, Wind Rights, And Wind Turbines: Why Science, Constitutional Rights, And Public Policy Issues Play A Crucial Role, Kimberly E. Diamond Jun 2016

Wake Effects, Wind Rights, And Wind Turbines: Why Science, Constitutional Rights, And Public Policy Issues Play A Crucial Role, Kimberly E. Diamond

William & Mary Environmental Law and Policy Review

Developers of onshore, utility-scale wind farms seek to purchase or lease parcels on which commercial wind turbines will be sited, carefully selecting each particular parcel based on its access to high wind speeds and unobstructed wind flowing across it in the free stream. Accordingly, a wind farm developer’s purchase or lease of a tract of land generally entails a large monetary investment and carries with it an investment-backed expectation that such land will be used for its originally intended purpose. Wind wakes, which disrupt the wind velocity in the free stream, cause downwind turbines to encounter diminished wind speeds and …

Religious Rites And Ceremonies As The Expression Of Local Identity And An Opportunity For Local Development: The Case Of The “Fòcara” Di Sant’Antonio Abate” In Novoli (The Bonfire Of St Anthony Abbot) In A Small Town In The Salento Peninsula In Southern Italy, Anna Trono

International Journal of Religious Tourism and Pilgrimage

Religious ceremonies play an important role when understood as an opportunity for improving the image of a city, improving the socio-economic situation and promoting regional development. These are the objectives of the local administration in Novoli, a small town in the Salento peninsula in Puglia, south-eastern Italy. The most important religious, social and tourist event of the year in Novoli is the feast of Saint Anthony Abbot, which falls on the 17th of January. The festivities continue for many days and include religious rites, street lights, exhibitions, food stands, popular music and brass band concerts, markets and conferences. There are …
