Fortifying The Rights Of Unauthorized Immigrant Workers: Why Employee-Focused Incentives Under The Nlra Would Help End The Cycle Of Labor Rights Abuse, Caitlin E. Delaney Jan 2016

Fortifying The Rights Of Unauthorized Immigrant Workers: Why Employee-Focused Incentives Under The Nlra Would Help End The Cycle Of Labor Rights Abuse, Caitlin E. Delaney

Journal of Law and Policy

Over the past several decades, there has been an unmistakable tension between labor law and immigration law in the United States. That tension, addressed by the Supreme Court most recently in 2001, still exists for unauthorized immigrant workers who wish to assert their labor rights under the National Labor Relations Act (NLRA). While the Obama Administration has made significant strides in easing the concerns that unauthorized immigrant workers may have before filing an NLRA claim, the unavailability of the back pay remedy and the uncertainty of protection from immigration authorities leave little incentive for such workers to assert their labor …

Imagining Kashmir, Patrick Colm Hogan Jan 2016

Imagining Kashmir, Patrick Colm Hogan

University of Nebraska Press: Sample Books and Chapters

During the 1947 partition of the Indian subcontinent, Kashmir—a Muslim-majority area ruled by a Hindu maharaja—became a hotly disputed territory. Divided between India and Pakistan, the region has been the focus of international wars and the theater of political and military struggles for self-determination. The result has been great human suffering within the state, with political implications extending globally.

Imagining Kashmir examines cinematic and literary imaginings of the Kashmir region’s conflicts and diverse citizenship, analyzing a wide range of narratives from writers and directors such as Salman Rushdie, Bharat Wakhlu, Mani Ratnam, and Mirza Waheed in conjunction with research in …

Aptitude And Trait Predictors Of Manned And Unmanned Aircraft Pilot Job Performance, Laura Barron, Thomas R. Carretta, Mark R. Rose Jan 2016

Aptitude And Trait Predictors Of Manned And Unmanned Aircraft Pilot Job Performance, Laura Barron, Thomas R. Carretta, Mark R. Rose

United States Air Force: Publications

Previous research has shown that the same aptitude and trait measures that predict success in US Air Force (USAF) manned aircraft pilot training predict remotely-piloted aircraft (RPA) pilot training outcomes with generally similar levels of validity (Carretta, 2013; Rose, Barron, Carretta, Arnold, & Howse, 2014). However, because USAF RPA pilots initially train in manned aircraft, validation of aptitude and traits predicative of RPA pilot success has thus far been limited to RPA pilot training outcomes that actually require manned flight. Hence, thus far there has been no basis for determining the aptitudes and traits predictive of success in environments in …

Beware Of The Genetically Modified Crop: Applying Animal Liability Theory In Crop Contamination Litigation, Michael H. Carpenter Jr. Jan 2016

Beware Of The Genetically Modified Crop: Applying Animal Liability Theory In Crop Contamination Litigation, Michael H. Carpenter Jr.

Buffalo Environmental Law Journal

Genetically modified crops offer vast potential economic and social benefits to farmers and society, but also threaten the profits and harvests of conventional crop farmers through genetic crop contamination. On one hand, genetically modifled crops increase farming efficiency, decrease the cost offood, and provide solutions for global hunger. On the other hand, genetically modified crops may contaminate the crops of organic and conventional farmers through genetic drift, resulting in injury to both farmers and an apprehensive public. Litigation over crop contamination is an unsettled area of the law, even after four major crop contamination incidents. While courts have held that …

Police Contacts And Attitudes Toward Police: A Study Of Race And Policing, Gary Portway Jan 2016

Police Contacts And Attitudes Toward Police: A Study Of Race And Policing, Gary Portway

Undergraduate Review

In the past couple of years, different police departments in the United States have ignited intense criticism for allegedly operating in unethical and unconstitutional ways, namely facilitating the law under racist principles. Since the structure of policing often shifts based on changes within general society, it has become a common standard that policing must match the highest degree of ethics adopted by citizens of the United States. There is a compelling need for more research to be done on the police-citizen relationship. This research studies whether there is disproportionality, with a specific focus on race and ethnicity, in some of …

The Minnesota Farm-Labor Party: The Role Of Third Parties In The Americanization Of European Labor Radicals In The Great Lakes Region, Paul Lubotina Jan 2016

The Minnesota Farm-Labor Party: The Role Of Third Parties In The Americanization Of European Labor Radicals In The Great Lakes Region, Paul Lubotina

Upper Country: A Journal of the Lake Superior Region

This paper examines the political transformation of former radicals from Ethnic Socialist Parties, Industrial Workers of the World, and the Western Federation of Miners during the 1920s and 1930s, as they joined mainstream third party organizations such as The Nonpartisan League and Farm-Labor Party of Minnesota. Former resident of Copper Harbor, Michigan and mayor of Hibbing, Minnesota, Victor Power led a coalition of Americans and immigrants in a struggle to circumvent the burgeoning power of Ku Klux Klan members who dominated local government in the city, with the support of the United States Steel Corporation. This political battle between progressive …

Urban Sprawl As A Risk Factor In Motor Vehicle Crashes, Reid Ewing, Shima Hamidi, James B. Grace Jan 2016

Urban Sprawl As A Risk Factor In Motor Vehicle Crashes, Reid Ewing, Shima Hamidi, James B. Grace

United States Geological Survey: Staff Publications

A decade ago, compactness/sprawl indices were developed for metropolitan areas and counties which have been widely used in health and other research. In this study, we first update the original county index to 2010, then develop a refined index that accounts for more relevant factors, and finally seek to test the relationship between sprawl and traffic crash rates using structural equation modelling. Controlling for covariates, we find that sprawl is associated with significantly higher direct and indirect effects on fatal crash rates. The direct effect is likely due to the higher traffic speeds in sprawling areas, and the indirect effect …

Adults Only: Florida's Botched Case Of Youth Employment Discrimination, Viktoryia Johnson Jan 2016

Adults Only: Florida's Botched Case Of Youth Employment Discrimination, Viktoryia Johnson

St. Thomas Law Review

This Article argues that Florida courts got it wrong. Part II of this Article reviews the chronological evolution of Florida's anti-discrimination law. It then contrasts Florida courts' reading of the FCRA to extend age-related protections only to individuals over forty to the Commission's unyielding argument for the Act's age-neutral application. This Part further illustrates this interpretative incongruity by juxtaposing the Fourth District Court of Appeal's holding in City of Hollywood v. Hogan to the Commission's final order in Williams v. Sailorman, Inc. Part III of this Article reviews the Commission on Human Relations' role enforcing the FCRA and describes the …

Religious Law And Women's Human Rights: Reflections Upon The African Human Rights System, Julia L. Ernst Jan 2016

Religious Law And Women's Human Rights: Reflections Upon The African Human Rights System, Julia L. Ernst

UC Law SF International Law Review

In many countries, governments have permitted the application of religious laws and have delegated judicial authority to religious courts. These practices may violate women's human rights for at least four reasons. First, women are barred from leadership positions within many religious institutions, and are therefore prevented from helping interpret the religious precepts and develop the law that is being applied by the religious courts. This exclusion of women violates their right to participate in governance, democracy, and decision-making, which are essential components of law-making. Second, women are excluded from serving as judges on religious courts, thereby calling into question the …

Petroleum Pipelines—Facts And Safety, Steven S. Sibray, Douglas R. Hallum Jan 2016

Petroleum Pipelines—Facts And Safety, Steven S. Sibray, Douglas R. Hallum

Panhandle Research and Extension Center

Since 2005, increased United States oil and natural gas production and increased oil output from Canadian oil sands has outpaced existing transportation infrastructure. As a result, there are plans to increase both natural gas and oil pipelines in the U.S. Although increased production of hydrocarbons has economic benefit, there are concerns about leaks and spills from petroleum pipelines and their potential environmental impacts. There has been particular concern about protecting Nebraska’s water resources from possible leaks of the proposed Keystone XL pipeline extension, the permit application for which was denied by the U.S. Department of State on November 6, 2015. …

Use Of A Small Unmanned Aerial System For The Sr-530 Mudslide Incident Near Oso, Washington, Robin Murphy, Brittany Duncan, Tyler Collins, Justin Kendrick, Patrick Lohman, Tamara Palmer, Frank Sanborn

School of Computing: Faculty Publications

The Center for Robot-Assisted Search and Rescue deployed three commercially available small unmanned aerial systems (SUASs)—an AirRobot AR100B quadrotor, an Insitu Scan Eagle, and a PrecisionHawk Lancaster—to the 2014 SR-530 Washington State mudslides. The purpose of the flights was to allow geologists and hydrologists to assess the eminent risk of loss of life to responders from further slides and flooding, as well as to gain a more comprehensive understanding of the event. The AirRobot AR100B in conjunction with PrecisionHawk postprocessing software created two-dimensional (2D) and 3D reconstructions of the inaccessible “moonscape” region of the slide and provided engineers with a …

As Good As It Gets? Security, Asylum, And The Rule Of Law After The Certificate Trilogy, Graham Hudson Jan 2016

As Good As It Gets? Security, Asylum, And The Rule Of Law After The Certificate Trilogy, Graham Hudson

Osgoode Legal Studies Research Paper Series

This article uses constitutional discourses on the legality of security certificates to shed light on darker, neglected corners of the security and migration nexus in Canada. I explore how procedures and practices used in the certificate regime have evolved and migrated to analogous adjudicative and discretionary decision-making contexts. I argue, on the one hand, that the executive’s ability to label persons security risks has been subjected to meaningful constraints in the certificate regime and other functionally equivalent adjudicative proceedings. On the other hand, the ability of discretionary decision-makers to deport individuals who pose de jure security risks to face torture …
