Background Checks For Firearms Sales And Loans: Law, History, And Policy, David B. Kopel
Background Checks For Firearms Sales And Loans: Law, History, And Policy, David B. Kopel
Sturm College of Law: Faculty Scholarship
This article examines past and present systems requiring that a person receive permission before buying or borrowing a firearm. The article covers laws from the eighteenth century to the present. Such laws have traditionally been rare in the United States. The major exceptions are antebellum laws of the slaves states, and of those same states immediately after the Civil War, which forbade gun ownership by people of color, unless the individual had been granted government permission. Today “universal background checks” are based on a system created by former New York City Mayor Michael Bloomberg and his “Everytown” lobby. Such laws …

Perceptions Regarding Public Safety In Portland’S King Neighborhood, Kris R. Henning, Greg Stewart
Perceptions Regarding Public Safety In Portland’S King Neighborhood, Kris R. Henning, Greg Stewart
Criminal Justice Policy Research Institute Research Briefs
The Portland Police Bureau (PPB) is partnering with Portland State University (PSU) and neighborhood groups to develop new strategies for improving police-community relations and reducing crime. Our most recent initiative seeks to provide residents with greater voice in where PPB officers work in their neighborhood and what steps the City takes there to address public safety concerns.
The King neighborhood in Northeast Portland was chosen as the starting point for this work following a recent gang related shooting at King School Park. Officers from North Precinct had already begun outreach to the community and they wanted additional input from the …

Moving From The Shadows: Shedding Light On Mixed-Citizenship Status Latino Families And Emotional Well-Being—A Mixed Methods Study, Ashley-Marie Vollmer Hanna
Electronic Theses and Dissertations
Throughout history and in contemporary U.S. society, immigration policies and practices have been laced with racist nativism, benefiting the dominant (white, male elite) society at the expense of Immigrants of Color (Chavez, 2008; Hanna & Ortega, 2016; Huag, n.d.; Ortega, Hanna, & Haffejee, 2014; Pérez-Huber, 2008). Today, Latinos are particularly vulnerable as they are the target of racist nativist immigration policy and practices and anti-immigrant rhetoric.
This dissertation examines the emotional well-being of Latino youths and young adults in mixed-citizenship status families using mixed methods research methodology. The study is informed by Critical Race Theory (CRT) and Latina/o Critical Race …
Marijuana Legalization In Colorado: Lessons For Colombia, Sam Kamin
Marijuana Legalization In Colorado: Lessons For Colombia, Sam Kamin
Sturm College of Law: Faculty Scholarship
In 2012 Colorado became the first jurisdiction anywhere in the world to legalize marijuana possession and use for all adults. The regulated and taxed marijuana industry that arose in Colorado following legalization was also the first of its kind and stands a model for other states considering marijuana law reform. In this brief article I discuss the results of the Colorado experiment; I demonstrate that while Colorado’s regulatory model was largely successful, it also demonstrates the limits of generating revenue through taxing and regulating marijuana. I then discuss the implications of this conclusion for post-conflict Colombia, drawing a comparison to …
Regulatory Coherence And Standardization In The Trans-Pacific Partnership, Phoenix X.F. Cai
Regulatory Coherence And Standardization In The Trans-Pacific Partnership, Phoenix X.F. Cai
Sturm College of Law: Faculty Scholarship
This article posits a new taxonomy and framework for assessing regulatory coherence in the new generation of mega-regional, cross-cutting free trade agreements. Using the Trans-Pacific Partnership as the primary example, this article situates the rise of regulatory coherence within the current trade landscape, provides clear definitions of regulatory coherence, and argues that the real engine of regulatory coherence lies in the work of international standard setting organizations. This work has been little examined in the current literature. The article provides a detailed examination of the mechanics by which the Trans-Pacific Partnership promotes regulatory standardization and concludes with some normative implications …

Inmate Legal Information Requests Analysis: Empirical Data To Inform Library Purchases In Correctional Institutions, Kimberli Morris Kelmor
Inmate Legal Information Requests Analysis: Empirical Data To Inform Library Purchases In Correctional Institutions, Kimberli Morris Kelmor
Law Library Faculty Works
The introduction of legal content to Google Scholar made United States case law and law journal articles accessible to an unprecedented extent. With case law freely available and accurate bibliographic information for articles, could Google Scholar be accurate and complete enough for correctional institutions to forgo purchasing either print publications or fee-based services for these materials? This article empirically assesses whether Google Scholar can reliably answer the questions of inmates in a correctional facility, the Baltimore City Detention Center. As a comparison, the same questions are tested in Westlaw Correctional, a subscription database marketed to correctional institutions.

Record blazes swept across parts of the US in 2015, burning more than 10 million acres. The four biggest fire seasons since 1960 have all occurred in the last 10 years, leading to fears of a ‘new normal’ for wildfire. Fire fighters and forest managers are overwhelmed, and it is clear that the policy and management approaches of the past will not suffice under this new era of western wildfires. In recent decades, state and federal policymakers, tribes, and others are confronting longer fire seasons (Jolly et al. 2015), more large fires (Dennison et al. 2014), a tripling of homes …

Conversations said in public do not have an expectation of privacy, and therefore, the ShotSpotter does not violate the right to privacy. This comment will address the following: a) ShotSpotter technology is a necessity in all neighborhoods; b) ShotSpotter does not violate an individual’s expectation of privacy; c) the need for ShotSpotter outweighs the cost of the device; and e) regulations and economic solutions will allow cities to use ShotSpotter while still protecting the individual’s privacy rights.

Predicting Cannabis Cultivation On National Forests Using A Rational Choice Framework, Frank H. Koch, Jeffrey P. Prestemon, Geoffrey H. Donovan, Everett A. Hinkley, John M. Chase
United States Department of Agriculture, Forest Service / University of Nebraska-Lincoln: Faculty Publications
Government agencies in the United States eradicated 10.3 million cannabis plants in 2010. Most (94%) of these plants were outdoor-grown, and 46% of those were discovered on federal lands, primarily on national forests in California, Oregon, and Washington. We developed models that reveal how drug markets, policies, and environmental conditions affect grow siting decisions. The models were built on a rational choice theoretical structure, and utilized data describing 2322 cannabis grow locations (2004–2012) and 9324 absence locations in the states' national forests. Predictor variables included cannabis market prices, law enforcement density, and socioeconomic, demographic, and environmental variables. We also used the …
