Part 3: Prisons And Prisoners: The Virginia Way And The Alternatives, Center For Economic Analysis And Policy, Old Dominion University
Part 3: Prisons And Prisoners: The Virginia Way And The Alternatives, Center For Economic Analysis And Policy, Old Dominion University
State of the Region Reports: Hampton Roads
Virginia imprisons large numbers of people; this is expensive. Economic analysis suggests that we would save money if we did not imprison so many people, redefined what constitutes a felony and gave more attention to preparing prisoners for re-entry into society.

Broadband And Mobile Internet Services In Nonmetropolitan Nebraska, Rebecca Vogt, Cheryl Burkhart-Kriesel, Randolph Cantrell, Bradley Lubben, L. J. Mcelravy
Rural Futures Institute: Publications
A recent Pew Research Center survey revealed that home broadband adoption has plateaued in the United States. In addition, there has been an increase in adults who use a smartphone to access the Internet but do not have traditional broadband service in their home. Given these national trends, how do rural Nebraskans access the Internet? Are they accessing the Internet from their cell phones? Are they subscribing to high-speed Internet services at home? How satisfied are they with their Internet services? How important do they feel Internet access is for various items? This paper provides a detailed analysis of these …

Principals' Perspectives On Visual Arts Subject Allocation And Value, Joseph J. Durben
Principals' Perspectives On Visual Arts Subject Allocation And Value, Joseph J. Durben
Theses and Graduate Projects
Research indicates there are unique benefits for students' learning in the visual arts and creative skills learned in the art studio teach students what is needed to be successful in the 21st century. Many schools reduce allocation time for quality visual arts. Although current federal and state policy indicates that visual art is a core subject, it is treated at times as enrichment. To teach the whole child, there needs to be a balance of subjects and equal access for students. In this qualitative study three themes emerged: I ) Principals view the visual arts as a core subject, 2) …

Reducing Brutality Through Improved Police-Community Relations, Karl A. Fenster
Undergraduate Honors Theses
This paper responds to negative public perceptions of United States law enforcement agencies. The research in this paper addresses six areas of policing reforms that have the potential to positively impact police-community relations: (1) building trust and legitimacy, (2) policy and oversight, (3) technology and social media, (4) community policing and crime reduction, (5) officer training and education, and (6) police-media relations. This paper reviews the existing literature in each topic area. The purpose of each literature review is to more accurately understand possible solutions to the widespread distrust of police and the issue of police brutality. This paper makes …

The Implications Of In Re L.M.T.: A Call To The North Carolina General Assembly To Reinstate Procedural Safeguards, A Parent's Right To Appeal, And The Importance Of A Permanency Planning Order, Chelsey Marie Maywalt
Campbell Law Review
Jane Smith had finally gotten her life back on track. Jane, a mother of two, had a checkered past of drug addiction and failure to properly care for her children. After a teacher reported suspicion of child neglect to the local Department of Social Services (DSS), DSS began an investigation of Jane and her two children. At the first hearing, the judge adjudicated the children "neglected" and ordered the children be placed in nonsecure custody. While the children were in nonsecure custody, the court and DSS planned to reunite Jane with her two children and maintain the family unit.

An Examination Of Individual Differences In The Context Of Performance On A Feedback V. No Feedback Vigilance Task, Jenny A. Walker
An Examination Of Individual Differences In The Context Of Performance On A Feedback V. No Feedback Vigilance Task, Jenny A. Walker
Honors Undergraduate Theses
When a task is boring, repetitive, and takes place over a long period of time, individuals have a propensity to experience a gradual decline in performance known as the vigilance decrement (Mackworth, 1948). This negative trend is consistent across most populations (Davies & Parasuraman, 1982), though slight variations can occur based on the characteristics of the task, as well as characteristics of the human performing it. However, despite the many differences between these tasks, most studies are similar in the sense that, more often than not, participants are provided with immediate feedback on their performance throughout most laboratory trials. Yet, …
Easing Reentry Of Incarcerated Youth With And Without Disabilities Through Employability And Social Skills Training, Taryn Vanderpyl
Easing Reentry Of Incarcerated Youth With And Without Disabilities Through Employability And Social Skills Training, Taryn Vanderpyl
CGU Theses & Dissertations
When incarcerated youth – those with and those without disabilities – face the prospect of reentering the community, they have many obstacles to overcome. Employment requirements are often associated with terms of parole or aftercare. Those who fail to obtain and maintain employment often reenter the juvenile justice system instead of successfully reentering society. Research shows employment is critical for successful transition from incarceration back in to the community. Limited information is available about programs that positively impact post-incarceration employment for juveniles, however. Practitioners face the challenge of selecting effective curriculum, interventions, or supports. Unfortunately, the current knowledge base provides …

Lethality, Public Carry, And Adequate Alternatives, Joseph Blocher, Darrell A. H. Miller
Faculty Scholarship
This Article explores the relationship between lethality and the right to bear arms, and considers how that relationship might be shaped by the availability of non-lethal alternative weapons. Prior scholarship has asked whether the Second Amendment includes a right to carry non-lethal “Arms.” An important set of related questions remains: does the Second Amendment necessarily include a right to arm oneself publicly with lethal force, if non-lethal alternatives are available? And how should one evaluate the adequacy of those alternatives?

Two Models Of Pre-Plea Discovery In Criminal Cases: An Empirical Comparison, Jenia I. Turner, Allison D. Redlich
Two Models Of Pre-Plea Discovery In Criminal Cases: An Empirical Comparison, Jenia I. Turner, Allison D. Redlich
Faculty Journal Articles and Book Chapters
Our criminal justice system resolves most of its cases through plea bargains. Yet the U.S. Supreme Court has not required that any evidence, even exculpatory or impeachment evidence, be provided to the defense before a guilty plea. As a result, state rules on pre-plea discovery differ widely. While some jurisdictions follow an “open-file” model, imposing relatively broad discovery obligations on prosecutors early in the criminal process, others follow a more restrictive, “closed-file” model and allow the prosecution to avoid production of critical evidence either entirely or until very near the time of trial. Though the advantages and disadvantages of both …

Transubstantiation In Canadian Public Law: Processing Substance And Instantiating Process, Mary Liston
Transubstantiation In Canadian Public Law: Processing Substance And Instantiating Process, Mary Liston
All Faculty Publications
Canadian public law blurs process and substance, a result confirming the prevailing view that this dichotomy ought never to be conceived as a simplistic bright-line distinction. Recent developments have created more than just a blurring but, rather, a strong linking or even fusion of the two. This paper probes the implications of these developments in public law. Section two briefly presents the historic and jurisprudential distinctions between process and substance and assesses its current legal import. Here I argue that judicially created analytic frameworks could assist by bringing a process-substance problem to the surface and constraining its potentially pernicious effects. …
Situational Awareness Enhancement For Connected And Automated Vehicle Systems, Amin Tahmasbi Sarvestani
Situational Awareness Enhancement For Connected And Automated Vehicle Systems, Amin Tahmasbi Sarvestani
Graduate Theses, Dissertations, and Problem Reports (ETD)
Recent developments in the area of Connected and Automated Vehicles (CAVs) have boosted the interest in Intelligent Transportation Systems (ITSs). While ITS is intended to resolve and mitigate serious traffic issues such as passenger and pedestrian fatalities, accidents, and traffic congestion; these goals are only achievable by vehicles that are fully aware of their situation and surroundings in real-time. Therefore, connected and automated vehicle systems heavily rely on communication technologies to create a real-time map of their surrounding environment and extend their range of situational awareness. In this dissertation, we propose novel approaches to enhance situational awareness, its applications, and …

Portmanteau Ascendant: Post-Release Regulations And Sex Offender Recidivism Symposium Articles, J. J. Prescott
Portmanteau Ascendant: Post-Release Regulations And Sex Offender Recidivism Symposium Articles, J. J. Prescott
Connecticut Law Review
The purported purpose of sex offender post-release regulations (e.g., community notification and residency restrictions) is the reduction of sex offender recidivism. On their face, these laws seem well-designed and likely to be effective. A simple economic framework of offender behavior can be used to formalize these basic intuitions: in essence, post-release regulations either increase the probability of detection or increase the immediate cost of engaging in the prohibited activity (or both), and so should reduce the likelihood of criminal behavior. These laws aim to incapacitate people outside of prison. Yet, empirical researchers to date have found essentially no reliable evidence …
Lessons And Liabilities In Litigating Solitary Confinement Symposium Essays, Keramet Reiter
Lessons And Liabilities In Litigating Solitary Confinement Symposium Essays, Keramet Reiter
Connecticut Law Review
This Essay reviews the recent deluge of legal attention solitary confinement has received in the United States, focusing in particular on three legal cases: Davis v. Ayala (a U.S. Supreme Court case), Coleman v. Taylor (a case filed and recently dismissed in a federal district court in Illinois), and Ashker v. Brown (a settled case filed in a federal district court in California). A close analysis of the reasoning in each of these cases provides a framework for examining the changing landscape of prison reform litigation in what many are heralding as a new era of reform. Together, these cases …
The New Overcrowding Symposium Essay, Jonathan Simon
The New Overcrowding Symposium Essay, Jonathan Simon
Connecticut Law Review
American prisons are seriously overcrowded, perhaps more than ever in our history. Before the era of mass incarceration, prisoner advocates sought to build on progressive penological ideas about the proper standards for housing prisoners, which focused on one person to each prison cell to create a jurisprudence of overcrowding that might compel states to reduce their reliance on incarceration. The goal failed, and states adopted tough new sentencing laws that increased imprisonment. As the prison book got under way, the Supreme Court decisively rejected the one person to a cell rule in the 1981 case of Rhodes v. Chapman. This …
Learning To Counter Mass Incarceration Symposium Essays, Brett Dignam
Learning To Counter Mass Incarceration Symposium Essays, Brett Dignam
Connecticut Law Review
Limited access to education inside American prisons imposes a devastating condition of confinement that cripples both the offender and the community. The prolonged and empty time that characterizes prison today affords little mental stimulation, productive engagement, or preparation for post-release employment. Recent research and analysis has found that education during incarceration correlates with lower rates of recidivism and increases the likelihood and quality of post-release employment. There is a pronounced racially disparate dimension to these effects that are concentrated in communities where investment by the criminal justice system is extraordinarily high. Failure to provide education and the resulting higher rates …
