When States’ Legislation And Constitutions Collide With Angry Locals: Shale Oil And Gas Development And Its Many Masters, Heidi Gorovitz Robertson

This Article explores the nationally common problem of tension and conflict among state oil and gas statutes, constitutional home rule, and local control by considering intersections and tensions among the Ohio Constitution’s home rule authority, the Ohio oil and gas law’s preemption provision, and the many regulatory efforts of Ohio’s local governments. It explores the scope of the Ohio Constitution’s home rule authority, in part, by evaluating courts’ statements on the validity of several types of local ordinances, as they confront home rule and a legislative attempt at preemption. More Than Just A Toothache? N.C. Dental Leaves Medical Boards Vulnerable: A Look At Telemedicine Companies And Antitrust Challenges To State Prescription Drug Rules, Alexander R. Kalyniuk

Encouraged by technological advancements and favorable provisions within the Affordable Care Act, telemedicine companies that offer online doctor visits are thriving in the health care industry. Online doctor visits are a relatively new and cost-efficient method to provide medical care over long distances that do not require patients to step outside their homes. However, many state medical board scope-of-practice rules prohibit physicians from prescribing medications without an in-person physical examination of the patient, which impedes telemedicine companies from offering their online services in those states. To circumvent this barrier, telemedicine companies may have a prima facie case under § 1 …

The issue that I decided to discuss is seat belt safety. According to the CDC, 21,022 vehicle passengers died in motor vehicle crashes in 2014 with more than half of these resulting from the individual not being restrained in the vehicle. A car crash isn’t planned, it can happen at any time to anyone. The only way to prepare for something like that to happen is to always take the right precautions which includes putting on your seatbelt every time you get in the vehicle. Over 2.3 million drivers and passengers were treated in emergency departments in 2014. Young adult …

Motorcycle helmet safety. Here in KY there is no helmet law in place at this time. It is completely up to each individual to decide if they choose to wear a helmet or not. Yes the helmets look simple and like they don't look like they could do much for your protection or make much of a difference, but according to the CDC helmets saved over 1,630 lives and over $2.8 billion in economic costs in 2013. Helmets reduce risk of death by 37% and risk of head injury by 69% also mentioned by the CDC.

The Guilty But Mentally Ill Verdict: Assessing The Impact Of Informing Jurors Of Verdict Consequences, Erin Elizabeth Cotrone

In response to public opposition to the insanity defense, the Guilty But Mentally Ill(GBMI) verdict was enacted with the intention of limiting the number of insanity acquittals and alleviating the public’s concerns. Prior research suggests, however, that many jurors are making verdict decisions with limited knowledge of the dispositional consequences of the GBMI and NGRI verdicts. Further, jurors may erroneously assume that the GBMI verdict is a compromise between a NGRI and guilty verdict, which mitigates punishment. In reality, the dispositional consequences of a GBMI verdict are equivalent to or more restrictive than a guilty verdict. The current study examined …

A spatial outlier is a spatially referenced object whose non spatial attribute value is significantly different from the corresponding values in its spatial neighbourhood. In other words, a spatial outlier is a local instability, or an extreme observation which deviates significantly in its spatial neighbourhood, but may not be in the entire data set. In this paper, we have applied the well-known mean algorithm for detecting spatial outliers in the multiple attributes state wise crime data and predicted which states need more attention from the government so as to reduce crimes there. An Examination Of Factors Influencing Postsecondary Career And Technical Educational Engagement Of African American Males, Natalie Jo Cunningham

The purpose of this study was to assess the relative influence of career, financial, personal, and legal factors on African American male engagement in postsecondary career and technical education and to determine whether the influence of these factors was moderated by the participants having graduated or not graduated high school and by thei having or not having been previously incarcerated. Based on a review of the literature, a twelve-item questionnaire was developed and subsequently examined by a panel of judges for the relevance and readability of its contents.
