The theoretical concepts relevant to this project are based on the ideas that the shared values of a community are a positive …

The Insecure City: Space, Power, And Mobility In Beirut, Kristin V. Monroe
Anthropology Faculty Book Gallery
Fifteen years after the end of a protracted civil and regional war, Beirut broke out in violence once again, forcing residents to contend with many forms of insecurity, amid an often violent political and economic landscape. Providing a picture of what ordinary life is like for urban dwellers surviving sectarian violence, The Insecure City captures the day-to-day experiences of citizens of Beirut moving through a war-torn landscape.
While living in Beirut, Kristin Monroe conducted interviews with a diverse group of residents of the city. She found that when people spoke about getting around in Beirut, they were also expressing larger …

Carsey Perspectives: Saving Salt, Protecting Watersheds, In Winter Road Maintenance. Highlights From A Social Venture Innovation Challege Winner, Andrew Jaccoma
Carsey Publications
In this Carsey Perspectives brief, author Andrew Jaccoma--who took first prize in the Community Track of the 2014 Social Venture Innovation Competition for his Sensible Spreader Technologies entry--explains the science behind the Coverage Indication Technology (CIT) created to increase road safety, increase efficiency, reduce wasteful dissemination of deicers, and lessen society’s impact on the environment. CIT uses cloud computing to share plowing, salt spreading, and location information throughout the entire fleet in real time. This empowers operators to make better decisions in the field and encourages the fleet to work together effectively. In addition, newer operators who may be less …
Judicial Power To Regulate Plea Bargaining, Darryl K. Brown
Judicial Power To Regulate Plea Bargaining, Darryl K. Brown
William & Mary Law Review
Plea bargaining in the United States is in critical respects unregulated, and a key reason is the marginal role to which judges have been relegated. In the wake of Santobello v. New York (1971), lower courts crafted Due Process doctrines through which they supervised the fairness of some aspects of the plea bargaining process. Within a decade, however, U.S. Supreme Court decisions began to shut down any constitutional basis for judicial supervision of plea negotiations or agreements. Those decisions rested primarily on two claims: separation of powers and the practical costs of regulating plea bargaining in busy criminal justice systems. …
Plea Bargaining And The Substantive And Procedural Goals Of Criminal Justice: From Retribution And Adversarialism To Preventive Justice And Hybrid-Inquisitorialism, Christopher Slobogin
Plea Bargaining And The Substantive And Procedural Goals Of Criminal Justice: From Retribution And Adversarialism To Preventive Justice And Hybrid-Inquisitorialism, Christopher Slobogin
William & Mary Law Review
Plea bargaining and guilty pleas are intrinsically incompatible with themost commonly-accepted substantive and procedural premises of American criminal justice: Plea bargaining routinely results in punishment disproportionate to desert, and guilty pleas are an insult to procedural due process. This Article argues that the only way to align plea bargaining with our criminal justice premises is to change those premises. It imagines a system in which retribution is no longer the lodestar of punishment, and in which party-control of the process is no longer the desideratum of adjudication. If, instead, plea bargaining were seen as a mechanism for implementing a sentencing …

Substantive Representation By The Unelected: The Role Of Staff Gender On Mayoral Priorities In U.S. Cities, Sara M. Hottman
Dissertations and Theses
The literature on descriptive and substantive representation focuses on elected representatives, but overlooks the gender of those who play an integral role in policy process (agenda-setting) and outcomes (implementation): The elected’s chief of staff, senior policy advisors, and, in council-manager systems, the city manager. This thesis examines the role policy staff and city manager gender plays in substantive representation. After analyzing staff composition and agenda priorities — gleaned from State of the City addresses — for mayors of the 50 most-populous cities in the United States, I found substantial evidence to support my hypotheses that the chief of staff’s gender, …

Although Congress intended to protect women in Indian Country from domestic abuse, they condoned the use of prior “uncounseled” tribal court convictions to charge and convict an Indian as a federal habitual domestic violence offender.
Justice Ruth Bader Ginsburg, who wrote Bryant, denigrates Indian people’s civil rights, citing the need to protect Native women from domestic violence. But Department of Justice statistics show most domestic violence perpetrators in Indian country are non-Indians, and the Bryant decision leaves intact their constitutional rights, including the right to appointed counsel.
