If Corporations Are People, Why Can't They Play Tag?, Cody J. Jacobs Jan 2016

If Corporations Are People, Why Can't They Play Tag?, Cody J. Jacobs

New Mexico Law Review

The Supreme Court’s decision in Burnham v. Superior Court—despite producing a splintered vote with no opinion garnering a majority of the Court—made one thing clear: an individual defendant can be subject to personal jurisdiction simply by being served with process while he or she happens to be in a forum regardless of whether the defendant has any contacts with that forum. This method of acquiring personal jurisdiction is called transient, or “tag,” jurisdiction. Tag jurisdiction is older than minimum contacts jurisdiction, and once was the primary method for determining whether an out of state defendant could be hauled into a …

Comparing Subsurface Trespass Jurisprudence—Geophysical Surveying And Hydraulic Fracturing, Christopher S. Kulander, R. Jordan Shaw Jan 2016

Comparing Subsurface Trespass Jurisprudence—Geophysical Surveying And Hydraulic Fracturing, Christopher S. Kulander, R. Jordan Shaw

New Mexico Law Review

This article examines the basics of two types of subsurface activity— geophysical prospecting (and the myriad of different surveys that comprise same) and hydraulic fracturing (or “fracing” sometimes herein)—describing the purpose of both, comparing the physical science background, field activities necessary, and data gathered in both, and analysis of the motivations of the parties conducting the activities. The article also contains an examination of selected germane subsurface trespass jurisprudence from New Mexico, Texas, and beyond. The article ends with thoughts and about what ought to be the state of subsurface trespass jurisprudence related to geophysical surveying and fracing and whether …

Decriminalizing Violence: A Critique Of Restorative Justice And Proposal For Diversionary Mediation, M. Eve Hanan Jan 2016

Decriminalizing Violence: A Critique Of Restorative Justice And Proposal For Diversionary Mediation, M. Eve Hanan

New Mexico Law Review

The movement to reduce over-prosecution and mass incarceration has focused almost exclusively on non-violent offenders despite data showing that over half of all prisoners incarcerated within the United States are sentenced for crimes of violence. As a consequence of the focus on nonviolent offenses, the majority of current and future defendants will not benefit from initiatives offering alternatives to criminal prosecution and incarceration. A discussion of alternatives to the criminal justice system in cases of violent crime must begin by acknowledging that violent crime is not monolithic. Many incidents meet the statutory elements of a violent crime, that is, the …

Synthesis Of Radioactive Nanostructures In A Research Nuclear Reactor, Maria Camila Garcia Toro

Masters Theses

In this work, the synthesis of radioactive nanostructures by water radiolysis was studied. The irradiation processes were done in the Missouri University of Science and Technology research nuclear reactor (MSTR).

Radioactive gold nanoparticles (AuNPs) were synthesized from aqueous solutions containing the metal salt precursors by radiolysis of water. Seven different samples were irradiated at 200kW of thermal power for 0.5, 1, 3, 5, 10, 30, and 60 minutes. The average sizes of the obtained nanoparticles ranged from 3 nm to 400 nm, it was found that the particle size decreased with the irradiation time. Some agglomerations of particles were found …

Single Phase Gas Flow Response Of Fractured Horizontal And Vertical Wells To Repeated Production, Divya Kandlakunta Jan 2016

Single Phase Gas Flow Response Of Fractured Horizontal And Vertical Wells To Repeated Production, Divya Kandlakunta

Masters Theses

"Historically, the conventional approach to well production has been to produce continuously, minimizing interruptions to flow insofar as possible. Yet some operators have observed improved well flow rates and ultimate recovery after a significant well shut-in periods. These production increases have not been documented. This study investigates the production impact of cyclic production/shut-in on fractured vertical and horizontal gas well performance.

A numerical reservoir model in Stimplan software was used to model production in fracture stimulated vertical and horizontal gas wells. Reservoir permeability is varied over a range of 0.0001 md to 1 md, and the shut-in period was varied …

Studies On Flocculation Of Fine Mineral Tailings Using Novel Polyacrylamide Based Polymer, Simin Khatibi

Masters Theses

"One of the important features in managing or treating sulfide fine tailings is separating solids from liquid by settling test. This thesis presents results of studied conducted on flocculation of Kaolin suspensions (a model tailings) and sulfide mineral tailings. Two polymers (PAM and Al-PAM) were tested as flocculants. The zeta potential value of slurries was measured by Nano Zetasizer device.

Al-PAM was found to be more effective for flocculation of kaolinite samples and also sulfide samples while PAM with used concentration was not. This study represents the power of flocculation as a possible solution to deal with industrial tailings"--Abstract, page …

Computational Fluid Dynamic Analysis In High Permeability Hydraulic Fractured Horizontal Gas Wells, Hrithu Vasudevan Jan 2016

Computational Fluid Dynamic Analysis In High Permeability Hydraulic Fractured Horizontal Gas Wells, Hrithu Vasudevan

Masters Theses

"Hydraulic fracturing of horizontal wells in unconventional reservoirs has become the dominant type of well completion performed in the United States. In very low permeability reservoirs (~.00001-.0001 mD), the wellbore is aligned with the minimum horizontal stress, and the completion includes multiple transverse fractures. These fractures may be placed with either open hole sleeve type completion systems (OHMS), or cased hole plug and perf systems (P-n-P). In slightly higher permeability reservoirs (1 to 10 mD) multiple longitudinal fractures have been found to be preferred to completions with transverse fractures.

This study presents an evaluation of gas well productivity for both …

Correlation Between Sleep And Lifespan In Drosophila Melanogaster, Courtney H. Fiebelman Jan 2016

Correlation Between Sleep And Lifespan In Drosophila Melanogaster, Courtney H. Fiebelman

Masters Theses

”Sleep has previously been associated with lifespan. Monitoring sleep in any given fly over their lifetime facilitates the ability to predict the lifespan of that given fly. Using this estimate, lifespan can potentially correlate with biological age to identify when health parameters have declined.

To confirm that the prediction algorithm could identify short and long-lived flies, glutathione levels in heads and bodies were compared between two groups. The results showed this to be consistent in the bodies of wild-type Canton S male flies, and showed that glutathione was decreased in the predicted biologically older flies. These data show that glutathione …

Determinants Of Activity Levels In African Americans With Mild Cognitive Impairment., Barry W. Rovner, Md, Robin J. Casten, Phd, Benjamin E. Leiby, Phd

Department of Neurology Faculty Papers

Engaging in cognitive, social, and physical activities may prevent cognitive decline. In a sample of older African Americans with mild cognitive impairment (MCI; N=221), we investigated the cross-sectional relationships between activity levels and participants' demographic, clinical, and neuropsychological characteristics. The average age of participants was 75.4 years (SD, 7.0); 177 (80.1%) were women. Participation in cognitive/social activities was positively associated with education, depression, literacy, mobility, instrumental activities of daily living (IADL), verbal learning, and subcomponents of executive function. A linear regression identified IADLs, education, depression, and verbal learning as independent predictors. Participation in physical activities was positively associated with sex, …

Nanotechnology, Environmental Risks, And Regulatory Options, Vincent R. Johnson Jan 2016

Nanotechnology, Environmental Risks, And Regulatory Options, Vincent R. Johnson

Faculty Articles

Nanotechnology today is viewed by many as a great advance in the quest for stronger and lighter materials, more effective pharmaceuticals, and better medicine. The critical question—largely unanswered—is whether this kind of science harbors destructive powers which, if fully understood, would call for restrictions or a ban on the use of certain types of nanotechnology. Current regulations in the United States and Europe cover chemicals that may be produced in nanoform. However, those regimes are not well designed to detect the risks posed by nanotechnology because they often fail to appreciate what is unique about nanomaterials. It is unlikely that …

The Magna Carta And The Beginning Of Modern Legal Thought, Vincent R. Johnson Jan 2016

The Magna Carta And The Beginning Of Modern Legal Thought, Vincent R. Johnson

Faculty Articles

As the Magna Carta, England's Great Charter of Liberties, marks its eighth centennial, it is appropriate to ask what's in it. The answer, it turns out, lives up to the legend. What's in the Magna Carta is the beginning of modern legal thought. The Great Charter set the expectations that for 800 years have shaped the development of the law in England, America, and around the globe. Like a blazing light piercing the medieval darkness, the Magna Carta illuminated the importance of legal principles, fair procedures, proportional punishment, official accountability, and respect for human dignity. It was unlike any legal …

The rights discussed in this article include the following: 1) The right to open carry a firearm; 2) The right to consume marijuana; 3) The right to marry or to civil unions between same-sex couples; …

Integrity Under Fire: The Wisdom Of General U.S. Grant And Advice For The Neophyte Lawyer, John W. Teeter Jr. Jan 2016

Integrity Under Fire: The Wisdom Of General U.S. Grant And Advice For The Neophyte Lawyer, John W. Teeter Jr.

Faculty Articles

Law is not war. Indeed, litigation serves as a peaceful alternative to trial by battle, and our legal doctrines and procedures are designed to prevent society from disintegrating into a feral, sanguinary struggle of each against all. Furthermore, lawyers simply do not deserve to be likened to warriors, for we neither physically defend our nation from foreign aggression nor sacrifice our lives to preserve our principles and freedoms. Any attorney who engages in excessive battlefield rhetoric should be sentenced to bedpan duty at the local Veterans Administration hospital.

At the same time, however, anyone who has tried a case, negotiated …

Forgetting Nature: The Importance Of Including Environmental Flows In International Water Agreements, Amy Hardberger

Faculty Articles

From the moment States created political boundaries to define their territory, they have shared water. There are 263 transboundary lake and river basins worldwide and 300 known transboundary aquifer systems. Whenever sharing is present, the opportunity for conflict is too. Climate change and increasing population are only two factors that may lead to increasing conflict if attention is not given to these situations. Thankfully, sharing water also creates an opportunity for cooperation. Throughout the world, there are increasing examples of conflict and cooperation regarding shared water resources. International water agreements can promote regional peace and security and encourage economic growth. …

Opting Out In The Name Of God: Will Lawyers Be Compelled To Handle Same-Sex Divorces?, Bill Piatt Jan 2016

Opting Out In The Name Of God: Will Lawyers Be Compelled To Handle Same-Sex Divorces?, Bill Piatt

Faculty Articles

In June of 2015, the United States Supreme Court determined by a 5–4 ruling in Obergefell v. Hodges that same-sex couples have a constitutionally guaranteed right to marry. While this represents a momentous victory for homosexuals, many people are still vehemently opposed to the idea. Homosexuality is especially frowned upon in certain religions, including some sects of Christianity. Is it possible that attorneys who decline on religious grounds to provide legal services to same-sex individuals seeking divorces will be ordered to provide that representation? Might those attorneys be sanctioned if they fail to do so? These are both novel and …

On The Analytical Formulation Of Excess Noise In Avalanche Photodiodes With Dead Space, Erum Jamil, Jeng Shiuh Cheong, J.P.R. David, Majeed M. Hayat Jan 2016

On The Analytical Formulation Of Excess Noise In Avalanche Photodiodes With Dead Space, Erum Jamil, Jeng Shiuh Cheong, J.P.R. David, Majeed M. Hayat

Electrical and Computer Engineering Faculty Research and Publications

Simple, approximate formulas are developed to calculate the mean gain and excess noise factor for avalanche photodiodes using the dead-space multiplication theory in the regime of small multiplication width and high applied electric field. The accuracy of the approximation is investigated by comparing it to the exact numerical method using recursive coupled integral equations and it is found that it works for dead spaces up to 15% of the multiplication width, which is substantial. The approximation is also tested for real materials such as GaAs, InP and Si for various multiplication widths, and the results found are accurate within ∼ …

Detection And Quantification Of Aromatic Hydrocarbon Compounds In Water Using Sh-Saw Sensors And Estimation-Theory-Based Signal Processing, Karthick Sothivelr, Florian Bender, Fabien Josse, Antonio J. Ricco, Edwin E. Yaz, Rachel E. Mohler, Ravi Kolhatkar

Electrical and Computer Engineering Faculty Research and Publications

This work investigates a sensor system for direct groundwater monitoring, capable of aqueous-phase measurement of aromatic hydrocarbons at low concentrations (about 100 parts per billion (ppb)). The system is designed to speciate and quantify benzene, toluene, and ethylbenzene/xylenes (BTEX) in the presence of potential interferents. The system makes use of polymer-coated shear-horizontal surface acoustic wave devices and a signal processing method based on estimation theory, specifically a bank of extended Kalman filters (EKFs). This approach permits estimation of BTEX concentrations even from noisy data, well before the sensor response reaches equilibrium. To utilize estimation theory, an analytical model for the …

Utah Air Quality: Pm 2.5, Randy Martin, Roger Coulombe, Roslynn Brain

All Current Publications

Particulate matter two-point-five (PM2.5) is a tiny suspended particle of air pollution that can penetrate deeply into our lungs and potentially enter the bloodstream. The 2.5 unit means that the particles are smaller than 2.5 micrometers (a micrometer is one millionth of a meter). In Cache Valley and along the Wasatch Front, these tiny particles form and accumulate to unhealthy levels when air is trapped in the bottom of the valley during cold winter days.
