Reintegration From Sex Trafficking: Chinese Women In Flushing, Ny, Siyun Deng

This article attempts to provide a comprehensive analysis of the needs for reintegration from sex trafficking and the gap of current social services provided to foreign national victims in the United States by focusing on Chinese female victims in Flushing NY. Through the research, the author understands the safe long-term housing ranks first among all the victims' needs for social services in the process of reintegration, which hasn’t been sufficiently addressed yet. Although the U.S. Congress passed the Trafficking Victims Protection Act (TVPA) to protect and assist international victims, and made T-visas available, the laudable goal of protecting and restoring …

This case involves a district court’s patent disregard for a deeply mentally impaired defendant’s right to meaningful representation in capital federal habeas proceedings. By funding only 6% of defense counsel’s request for necessary expert and other resources, the District Court violated the constitution, ignored federal statutory mandates, flouted the Supreme Court’s remand order, blocked counsel’s ability to satisfy professional and ethical obligations, publicly disclosed contents of previously protected information about defense strategy, and set a very dangerous precedent for our justice system.

The Monopoly Myth And Other Tales About The Superiority Of Lawyers, Leslie Levin

The legal profession’s control of much of the market for legal services is justified by the claim that only licensed lawyers can effectively and ethically represent clients. This article challenges that claim. A review of a number of studies suggests that experienced nonlawyers can provide competent legal services in certain contexts and in some cases, can seemingly do so as effectively as lawyers. There is also little evidence that lawyers’ legal training, the bar admission requirements, or lawyers’ psychological characteristics make them more trustworthy than nonlawyer legal services providers. Mutuality In Movement: A Relational Approach To Dance/Movement Therapy With Domestic Violence Survivors, Heather L. Maclaren

This qualitative case study explored the integration of relational-cultural therapy and dance/movement therapy (DMT), or relational-DMT, with survivors of domestic violence. The study examined how participants experience relational-DMT and the therapeutic relationship we established together. Three culturally diverse participants receiving individual short-term counseling services at a domestic violence service agency were included in the study. Three forms of data were collected over six to eight therapy sessions. Following each session, the participants completed the Helpful Aspects of Therapy questionnaire, while the researcher completed embodied case documentation (Fogel, 2007). This article will review New York’s service statute, C.P.L.R. § 308, in light of today’s culture and communications. Part One reviews the Constitutional framework of service, the statutory demands for e-mail as a method of service with appropriate leave of court, and provides an overview of the statute. Part Two reviews the evolution of New York case law. Part Three focuses on “how to” use C.P.L.R. § 308(5) to obtain service of process by e-mail. Part Four contemplates the future of service via e-mail.

Essays In International Migration, Marcelo J. Castillo

This dissertation consists of three essays examining the effects of high-skilled immigration on various economic outcomes within the receiving country. In the first essay, I study how skilled immigrants affect wages and employment in US industries during 1995-2007, using novel microdata on approved H-1B visas. These data show that most H-1B employers specialize in the production of high-skilled services used as inputs by other businesses. In light of this, I consider the downstream effects of skilled immigrants on industry labor market outcomes: how wages and employment in an industry respond to immigration shocks to its suppliers. Taking The Direct File Statute To Criminal Court: Immigration Consequences For Juveniles, Marlon J. Baquedano

Florida is one of fifteen jurisdictions in the United States that have enacted a direct file statute that grants prosecutors the ability to transfer juveniles from the juvenile justice system to adult court. Critiques of the direct file statute have focused on its effectiveness on deterrence and recidivism, its arbitrariness in application, and the tension with the role of juvenile justice in reforming rather than punishing youth. This Note explores the harmful consequences of the direct file statute on non-citizen youth in immigration proceedings and the probability of obtaining immigration relief. Law libraries are filed with the rules that govern our society, thoughtful scholars, conscientious lawyers, some hard working students, and some procrastinating students. In the past, this required libraries to collect hardbound volumes and loose leafs. Today, the collection is beginning to give way to research platforms filed with those same, or similar, materials and then some; much of the primary legal documentation is even freely available on the web.
While the physical footprint of the library may be smaller as a result of this transition, the amount of legal information that researchers have access to has grown exponentially. We …

Undergraduate social work programs are responsible to prepare students who will practice in accordance with the NASW Code of Ethics. Such preparation is not simply limited to developing a body of knowledge or set of skills but extends to adoption of a professional identity. Several research studies point to religious values as a significant motivational factor in choosing social work as a profession, yet little research has been conducted to investigate the integration of religious identity with an emerging professional identity. China has experienced rapid social and economic transformation since the early 1990s. While state control has attempted to maintain a collectivist spirit that emphasizes communal goals and obligations over unrestricted capitalism, rapid economic growth has weakened socialist ideals and individualism has thrived. The present paper draws attention to potential associations between the rise of capitalism, individualism in mainland China, the one-child policy and changes in domestic violence laws with the increased perpetration of cold violence by some men towards their female partners. Access to affordable housing is one of the most critical issues currently facing low-income families. In many urban areas, rising costs, dwindling economic opportunity, and gentrification have foreclosed access to previously available rental stock and contributed to a crisis in housing. For African Americans lingering economic disparities arising from generations of forced racial segregation and the disproportional impact of mass incarceration have magnified these problems. In this Article I explore legal barriers to publicly subsidized housing, a “collateral consequence” of criminal convictions that increasingly serves as a powerful form of housing discrimination.
