Our Time Is Better Spent Influencing Future Disruption: A Call To End The Indiscriminate War Against Self-Help Legal Technology, Olivia Holder

The University of Cincinnati Intellectual Property and Computer Law Journal

Under the guise of consumer protection, lawyers and bar associations have used disparate litigious mechanisms to thwart, inadvertently or not, the use of self-help legal technology. This paper will demonstrate that such adversity is not logical after a consideration of the technical functions that the software performs and unduly restricts underserved populations’ access to the law because of the misapplication of policy to vaguely worded laws. This paper will provide a thorough analysis of legal action taken against the high-profile company LegalZoom under the theory of unauthorized practice of law provides direct support of this claim. Missouri Sentencing And Race: A Closer Look From 2007-2015, Grant Shostak, Ryan V. Guffey

Contrary to the perception, it is judges, not juries, that typically determine the sentence for a convicted criminal defendant. While all citizens are to be treated equal under the law, recent cries to overhaul our criminal justice system came to a head following the wake of Officer Darren Wilson’s (Caucasian) shooting and killing of Michael Brown (African-American) in Ferguson, Missouri. This paper attempts to examine sentencing practices of Missouri courts from 2007-2015, covering a time period both before and after Brown’s death in 2014.

Peter Singer, Drowning Children, And Pro Bono, John M.A. Dipippa

West Virginia Law Review

This Article uses the ethicist Peter Singer's principles to examine and critique the legal profession's pro bono efforts in the face of the persistent gap between the public's legal needs and their ability to meet them. Singer argues that adults should jump into a pond to save a drowning child. Using the drowning child as an analogy, this Article argues that lawyers are morally obligated to (1) increase the amount of their pro bono efforts, (2) be more selective in the cases they take, and (3) be significantly more generous in their financial support for legal services providers. The struggle to gain access to justice requires access to procedural justice, whereby interested parties can effectively participate in the legal processes needed for their pursuit of substantive justice. The justice system’s complexity and cost have effectively rendered the legal system inaccessible to a large portion of U.S. citizenry. A variety of measures have been instituted to increase access to justice, such as government financing of attorney representation, legal aid, pro bono legal assistance, class actions, alternative dispute resolution processes, etc. This paper provides an introduction to some of the issues surrounding the implementation of these measures, with most state-based …

The establishment of the Singapore International Commercial Court (“SICC”) marks a significant development in Singapore’s private international law. This note leverages on the Singapore High Court decision of IM Skaugen SE v MAN Diesel & Turbo SE [2016] SGHCR 6 to discuss two key issues raised by the SICC: the relationship between the Singapore High Court’s and the SICC’s jurisdictional rules, and the applicable test for the exercise of the SICC’s jurisdiction. There has been considerable recent scholarly commentary about the existence of a school-to-prison pipeline. In this research, several authors have questioned whether the presence of school resource officers (SROs) has increased the proportion of students being referred to juvenile justice systems for status or minor offenses. Research to date, however, has not established a clear relationship between the presence of SROs and these referrals. In this study, we examine the relationship between referrals made in urban and rural schools to determine whether rural students are disadvantaged by net widening when compared with their urban counterparts. The Social Worker’S Role In Ensuring Quality Counsel For Defendants With Mental Illness, Lauren M. Pappacena

The current literature surrounding the intersection of criminal justice and mental health is addressed. First, the history of overrepresentation of individuals with a mental health disorder in the criminal justice system is discussed, followed by a discussion of the current gaps in the literature. These gaps need to be addressed to inform better practices among public defenders and their decision making role with clients who have a mental health disorder. The lack of research is evident in ambiguous judicial guidance in ensuring that defendants with a mental health disorder are able to exercise autonomy relevant to their case. Social workers …
