Traffic accident ranks the ninth largest of the cause of death in Indonesia. The most of researches studying Indonesia on traffic accidents were only blaming on human, motor vehicles, and environment as main culprits, not incorporating economic factors into the models. This study aims to analyze the impact of real gasoline prices on traffic accident in Indonesia and the factors of influence them. This research employs time series data from 1970 to 2013 with OLS analysis world crude oil prices as instrument variable. What really matters, what unites disasters of all stripes, including earthquakes in Japan, tornadoes in Oklahoma, oil spills in the Gulf of Mexico, and the terrorist attacks on 9/11, is how you respond during the disaster, how you recover from it afterwards, and how you prepare - or better, prevent - the next disaster from happening. This is what disaster theorists, including Professor Dan Farber at Berkeley Law, term the "disaster cycle." In simplest terms: readiness, response, and recovery.

Widespread pyrethroid resistance has caused an urgent need to develop new insecticides for control of the malaria mosquito, Anopheles gambiae. Insecticide discovery efforts were directed towards the construction of bivalent inhibitors that occupy both the peripheral and catalytic sites of the mosquito acetylcholinesterase (AChE). It was hypothesized that this approach would yield a selective, high potency inhibitor that would also circumvent known catalytic site mutations (e.g. G119S) causing target site resistance. Accordingly, a series of bivalent phthalimide-pyrazole carbamates were prepared having an alkyl chain linker of varying length, along with other modifications. Sub-Saharan Africa suffers an inordinate burden of disease and does not have the numbers of suitably trained health care workers to address this challenge. New concepts in health sciences education are needed to offer alternatives to current training approaches. A perspective of integrated training in population health for undergraduate medical and nursing education is advanced, rather than continuing to take separate approaches for clinical and public health education. The current Supreme Court is very protective of speech, including commercial speech. Threats to commercial speech persist nonetheless. This article briefly examines two: the use of commercial speech restrictions as a form of rent-seeking, and compelled commercial speech. Regulation of commercial speech is sometimes used to protect established corporate interests from competitors who are less able to bear the costs of regulation, with consequences that extend beyond the economic marketplace. In the case of commercial speech, courts have also been unduly deferential to claims of a consumer “right to know” as a basis for mandated labeling and disclosure. Greater and …

Previous research has documented that cetaceans can discriminate between humans, but the process used to categorize humans still remains unclear. The goal of the present study was to replicate and extend previous work on the discrimination between familiar and unfamiliar humans by three species of cetaceans. The current study manipulated the familiarity and activity level of humans presented to 12 belugas (Delphinapterus leucas) housed between two facilities, five bottlenose dolphins (Tursiops truncatus), and six Pacific white-sided dolphins (Lagenorhynchus obliquidens) during free-swim conditions. The purpose of this exploratory case study was to describe community college nursing faculty members' reports of their intention to design instruction to support learning for a broad range of students in their classrooms. Specifically, Ajzen's (1985) Theory of Planned Behavior (TPB) was the conceptual framework used to analyze nursing faculty members' reports of their attitudes, normative beliefs, and control beliefs related to the three Universal Design for Learning (CAST, 2011) principles. The precautionary principle is a legal principle that has found considerable support in international environmental law. Its emergence, however, has not been without problems and controversies: how do we define its normative content and trigger elements, and how do we ensure concrete implementation. The 2011 Seabed Mining Advisory Opinion used states’ due diligence obligations to prevent harm to realize the precautionary principle. Focusing on this case, this article examines how the precautionary principle can be applied using the concept of due diligence. Who Is Harmed By Fantasy? A Deliberative And Charter Analysis Of Canada's Pornography Law, Emily Hansen

Dalhousie Journal of Legal Studies

This paper interrogates the breadth, necessity, and collateral effects of Canada’s child pornography law, as contained in the Criminal Code. The author argues that the inclusion of “fantasy” images in the definition of child pornography is over-inclusive, and considers that this may make the law illegitimate and discriminatory. She proposes that this over-inclusive definition arises from the conflation of a particular type of sexual desire with harm to children. The author draws loosely on deliberative democratic theory to structure her analysis of the law’s legitimacy, and uses Charter analysis to both critique the current law and suggest means of addressing …

Advocacy for the protection of animal welfare and women’s right to reproductive choice have little, if anything, in common. It is productive, then, to question the recurring association of these unrelated ethical issues. If one feels compassion for the plight of the nonhuman animal, the argument goes, then it is morally inconsistent to neglect the fetus. An understanding of the incongruous political contexts at play between abortion and animal welfare effectively repudiates this argument, but a more important question must be answered: why is this strange argument so pervasive? Many economists share the view that the rise in obesity is largely the result of rational decision-making by individuals who compare risks and benefits. A dominant view among economists is that there is no economic justification for government intervention unless there is a market failure. However, recent developments in behavioral economics suggests that people often fail to make optimal decisions, and that public welfare may be improved by government interventions even when there is no externality. The United States has increasingly designed certain public spending programs not as traditional tax-financed programs, but rather as mixtures of private expenditures, subsidies, and limited taxes. Thus part of what could have gone to the government as a tax is instead used to purchase the good or service directly, with only incremental taxes and subsidies to manage distributional goals. This Article terms this “quasi-public spending,” and argues that it is descriptive of our evolving approaches to both health care and higher education. In many clinical programs, collaboration -- through team pairings and group work – has been the norm, and gradually, collaborative work is being developed throughout the doctrinal law school curriculum. This trend fits within a broader societal emphasis on a collaborative model of working and learning. In both professional and educational settings, collaboration is viewed as critical to the success of ideas and products. Section 2 of the Lanham Act, the federal law governing trademarks, lists a number of bars that preclude registration of a trademark on the federal register. This article offers a way to achieve global health with justice as a global health imperative. It is possible to have global health without justice, meaning that improvements in health outcomes could be achieved, but without a fair distribution of the benefits of good health. It is also possible to have justice without global health, where health outcomes are evenly distributed across the population but overall health is not improved. With this understanding, this article challenges current ways of understanding global health, and argues that absolute reductions in morbidity and premature mortality are not robust indicators of success in the …

Compelled commercial speech, including mandatory labeling and the disclosure of factually true information, should not be seen as a separate category of speech under the First Amendment. Rather, compelled commercial speech should be understood as a type of commercial speech and be subject to the same level of protection as commercial speech generally. Accordingly, commercial speech compulsions, such as mandatory disclosures and labeling requirements, must be supported by a substantial government interest under the Central Hudson framework. The assertion of a consumer “right to know” does not constitute such an interest and cannot, by itself, justify compelled commercial speech within …
