Compelled Commercial Speech And The Consumer "Right To Know", Jonathan H. Adler
Compelled Commercial Speech And The Consumer "Right To Know", Jonathan H. Adler
Faculty Publications
Compelled commercial speech, including mandatory labeling and the disclosure of factually true information, should not be seen as a separate category of speech under the First Amendment. Rather, compelled commercial speech should be understood as a type of commercial speech and be subject to the same level of protection as commercial speech generally. Accordingly, commercial speech compulsions, such as mandatory disclosures and labeling requirements, must be supported by a substantial government interest under the Central Hudson framework. The assertion of a consumer “right to know” does not constitute such an interest and cannot, by itself, justify compelled commercial speech within …
Special Treatment Stigma After The Ada Amendments Act, Nicole Buonocore Porter
Special Treatment Stigma After The Ada Amendments Act, Nicole Buonocore Porter

This Article explores a unique source of stigma suffered by individuals with disabilities in the workplace. Instead of focusing on those with the most stigmatizing disabilities, I focus on those individuals who have disabilities that are not perceived as very severe, yet they still suffer stigma. These individuals are stigmatized because of the special treatment they receive (or are perceived as receiving) through workplace accommodations provided pursuant to the Americans with Disabilities Act (ADA). In prior work, I have called this phenomenon "special treatment stigma, " the harm that arises from receiving special treatment in the workplace, especially when coworkers …

the eye regions of laptop users. To achieve this, the iris and eye corners are detected by processing the images captured by the standard internal webcam of a laptop. In addition, an artificial neural network (ANN) is used for determining the eye region. Hereby, the iris and eye corners can be detected in the determined eye region. In the study, 107 user images are captured by using a laptop's internal camera under different light intensities, environments, viewpoints, and positions. These images are used for the training of the ANN. Two different methods are used for the iris detection. In the …

Novel Dynamic Partial Reconfiguration Implementations Of The Support Vector Machine Classifier On Fpga, Hanaa Hussain, Khaled Benkrid, Hüseyi̇n Şeker
Turkish Journal of Electrical Engineering and Computer Sciences
The support vector machine (SVM) is one of the highly powerful classifiers that have been shown to be capable of dealing with high-dimensional data. However, its complexity increases requirements of computational power. Recent technologies including the postgenome data of high-dimensional nature add further complexity to the construction of SVM classifiers. In order to overcome this problem, hardware implementations of the SVM classifier have been proposed to benefit from parallelism to accelerate the SVM. On the other hand, those implementations offer limited flexibility in terms of changing parameters and require the reconfiguration of the whole device. The latter interrupts the operation …
Master William’S Hamnet: A New Theory On Shakespeare’S Sonnets, Juan Daniel Millán
Master William’S Hamnet: A New Theory On Shakespeare’S Sonnets, Juan Daniel Millán
Quidditas
This essay suggests the Fair Youth in Shakespeare’s Sonnets is Shakespeare’s son, Hamnet, to whom he later dedicated the cycle. Nevertheless, the larger claims of the essay are independent of the biographical details of Shakespeare’s life, and even independent of the particular ordering of the Sonnets as they have come down to us.
Does Large Family Size Predict Political Centrism?, Benjamin Schmidt
Does Large Family Size Predict Political Centrism?, Benjamin Schmidt
Sigma: Journal of Political and International Studies
Suggesting that voting might be correlated with the number of children voters have has been rare but not unheard of in the last decade. In a 2004 article for American Conservative, Steve Sailer noted a correlation between states with higher birth rates among white voters and the support for incumbent Republican President George W. Bush. Sailer recognized that Bush won the nineteen states with the highest white fertility while Senator John Kerry won the sixteen with the lowest (2004). He also suggested that the lifestyle preferences of white, conservative parents might be to blame for the apparent Republican tilt among …
When The Default Is No Penalty: Negotiating Privacy At The Ntia, Margot E. Kaminski
When The Default Is No Penalty: Negotiating Privacy At The Ntia, Margot E. Kaminski

Consumer privacy protection is largely within the purview of the Federal Trade Commission. In recent years, however, the National Telecommunications and Information Administration (NTIA) at the Department of Commerce has hosted multistakeholder negotiations on consumer privacy issues. The NTIA process has addressed mobile apps, facial recognition, and most recently, drones. It is meant to serve as a venue for industry self-regulation. Drawing on the literature on co-regulation and on penalty defaults, I suggest that the NTIA process struggles to successfully extract industry expertise and participation against a dearth of federal data privacy law and enforcement. This problem is most exacerbated …
Reconsidering Federal And State Obstacles To Human Trafficking And Entitlements Victim Status, Amanda Peters
Reconsidering Federal And State Obstacles To Human Trafficking And Entitlements Victim Status, Amanda Peters
Utah Law Review
The crime of human trafficking has received much political and mediaattention in recent years. Lawmakers and actors within the criminal justice system have yet to fully grasp the challenges human trafficking victims face in securing the rights, benefits, services, and protections reserved for this group. One of the qualities of the American criminal justice system is its ability to adapt to new challenges. Law and policy makers must understand whether and why human trafficking victims differ from victims of traditional crime and how entitlements for both groups overlap, yet differ. Without pondering the distinctions, trafficking victims will continue to find …
A Few Notes On Nabokov's Childhood Entomology, Victor Fet
A Few Notes On Nabokov's Childhood Entomology, Victor Fet
Biological Sciences Faculty Research
Nabokov's lepidoptery long posed a question: Was he an amateur or a professional entomologist? Today, it has been amply demonstrated that he was a professional. Kurt Johnson says, "For Nabokov, as with many, fascination with the big picture books of butterflies as a young child grew to concerted collecting as a youngster. As with many scientists, these impressions of youth become a driving life force."3 Nabokov started collecting butterflies in 1906, at age seven, and never ceased; he published his first book of poems ten years later, at age seventeen; his first research paper on butterflies, at age twenty; …
An Implementation Of A High Accuracy Sensor For Distributed Wireless Sensor Network Applications, Jesse Craig Frye
An Implementation Of A High Accuracy Sensor For Distributed Wireless Sensor Network Applications, Jesse Craig Frye
Theses
Biopotentials are typically small electric signals, on the order of a few microvolts to hundreds of millivolts, produced as the result of cellular electrochemical activity in living organisms. Due to high source impedance, investigation of these small electrical signals typically requires use of clinical equipment or professional data acquisition systems that are large, expensive, and utilize AC mains power. Distributed sensor network applications need a low cost, high resolution wireless sensor, suitable for measuring and logging microvolt-level DC accurate signals from high impedance sources. Issues that must be addressed include processing power, power efficiency, auxiliary data storage, and wireless communication …
Performance Of Feature Selection Methods For Machine Learning Based Automatic Malarial Cell Recognition In Wholeslide Images, Vishnu Muralidharan.
Performance Of Feature Selection Methods For Machine Learning Based Automatic Malarial Cell Recognition In Wholeslide Images, Vishnu Muralidharan.
Theses
This work is on investigation of automated detection of malaria parasites in wholeslide images of peripheral blood smears. We compared and analyzed several feature-selection methods for optimization of machine learning using support vector machine (SVM). To this end, cell samples were extracted from the wholeslide image and feature extraction was performed on these samples. In order to identify the best features, a host of feature selection methods were tested. For each set of selected features, the SVM was trained and tuned for optimal model selection using cross-validation and grid-search. Subsequently, test samples were classified using the model. Each feature selection …
The Philosophy Of Mythology, Erwin F. Cook
The Philosophy Of Mythology, Erwin F. Cook
Classical Studies Faculty Research
The early German romantic philosophy of myth can help elucidate the nature of romanticism itself, which notoriously resists descriptive or theoretical definition. To be sure, myth is an equally problematic term, whose precise meaning varies among romantic philosophers, though its role in the romantic project remains usefully consistent: myth is offered as a solution to the crisis of modern alienation, or, more radically, to the crisis of the subject object dichotomy. The sources of this alienation are likewise varied but broadly coherent. I will mention those relevant to the task at hand.

In July 2009, Brigham Young University’s Recreation Management (RecM) Department moved to the Marriott School of Management (MSM), beginning its integration into a nationally ranked business school, including the transition from a college with little coordination between departments to one where all majors share a common core of classes. Despite initial feelings of uncertainty, many insights over time emerged as to how the RecM department could better serve students and professionals. This paper shares some of the lessons the RecM Department learned that hold applicability for other recreation departments, including the (1) influence of names on external perceptions and curriculum, …

Business Communication Practices From Employers’ Perspectives, Tina A. Coffelt, Matthew J. Baker, Robert C. Corey
Faculty Publications
This study investigates the meaning of communication skills from employers’ perspectives. Students enrolled in a business communication course were asked to contact potential employers in their fields of interest, requesting information about important communication skills in those fields. Using content analysis, two coders familiar with business communication analyzed 52 of the resulting open-ended responses. The analysis of 165 skills suggests employers recall oral communication more frequently than written, visual, or electronic communication skills. Of oral communication subskills, interpersonal communication was mentioned more than other workplace communication skills.

Although fisheries management decisions impact people and places, multiple drivers of change are at play in coastal communities. Moreover, the interactions among those drivers, whether they build upon or offset one another, are where the action lies. While interested in the changes brought about by the imposition of transferable catch shares, this research takes a holistic approach to studying coastal communities. This study focuses on instances of transition from a greater presence of the fishing industry to new configurations of fisheries, maritime sectors, and tourism. Situated in places in the midst of such change, the work clarifies what fisheries dependence …

Due to the technological improvements of the last two decades, it is possible for innovations to follow each other rapidly. However, not all innovations are useful ones, and a lot of producers often do not know how to market their new products. Diffusion theory, started by Gabriel Tarde (1903), first proposed the S-shaped diffusion curve. After this research few investigations followed until 1943. In this year Bryce Ryan and Neal Gross published their study about innovation diffusion. This led to an enormous overflow of publications. Later, Rogers (2003) contributed additional research and many others followed him.

Correlating Behavior With Non-Invasive Physiological Measures To Evaluate Mating Strategies In Belugas, Justin Thomas Richard
Open Access Dissertations
With conservation and ethical concerns facing cetaceans, minimally invasive research on reproduction is important for population management. Belugas (Delphinapterus leucas) are endangered in parts of their range, yet little is known about their breeding behavior and much of the existing research depends on post-mortem sampling. To date, there have been no directed studies of social interactions between belugas during the breeding season, and few studies have attempted to correlate reproductive physiology with behavior in any species of cetacean. Improved understanding of reproductive strategies in this species would facilitate management. This work describes the development of minimally invasive methods …

Background:
The pediatrician’s office frequently provides the first opportunity for behavioral health intervention. However, pediatricians are limited in time, tools, and training to assess and treat behavioral health problems. Even a brief intervention Motivational Interviewing intervention more than doubles the length of a physical exam appointment. Studies investigating the usefulness of technology to assist with behavioral health interventions in pediatric primary care are limited, but one study found that technology was a feasible approach for use in pediatric primary care (Harris et. al., 2012). That study assessed for alcohol with computer technology and provided the findings to the attending physicians …

Global climate change is threatening the structure, function, and health of ecosystems. While factors of climate change have been studied extensively over the past few decades, most research has focused on the response of single organisms or populations; as our ecosystems are comprised of complex interactions and relationships, it is of critical importance to understand how entire communities are going to be impacted by climate change. Ocean acidification (a by-product of increased atmospheric carbon dioxide, CO2), and nutrient loading are two major forces of global change that are projected to have detrimental impacts on coastal marine species and …

Complex carbohydrates exist in almost all species of plants, animals and microorganisms. Because of their physiochemical properties, they have been traditionally applied as emulsifiers and stabilizers in food, cosmetics, textiles and as pharmaceutical ingredients. Complex carbohydrates generally exist as a layer of thick, sequential, hydrous polymers consisting of monosaccharides and non-carbohydrate substituents such as acetate, pyruvate, and phosphate. While complex carbohydrates are generally believed to serve as structural support or energy sources for the producing organisms, their potential biomedical properties have been less investigated. Our understanding of the biological activities of complex carbohydrates is further complicated since most have been …

A Pragma-Dialectical Approach To Argumentative Discourse, Touria Drid
Khazar Journal of Humanities and Social Sciences
Theoretical and procedural diverseness is a feature characterising the study of argumen- tation. The common core in all perspectives is to examine a type of discourse that attempts to convince another party of the acceptability of one’s view(s) through a set of arguments, but what differs, to a larger or lesser extent, is the theoretical apparatus through which discourse is scrutinised. The present paper offers a general account of the pragma-dialec- tical approach to argumentation. Expatiating on the principal theoretical and methodolo- gical lines on which the theory proceeds, the paper aims at delineating the analytical tools provided in this …
