Licensing Health Care Professionals, State Action And Antitrust Policy, Roger D. Blair, Christine Piette Durrance May 2015

Licensing Health Care Professionals, State Action And Antitrust Policy, Roger D. Blair, Christine Piette Durrance

UF Law Faculty Publications

In this Essay, we raise some economic concerns about the wisdom of conferring antitrust immunity on professional licensing boards, which are often comprised of members of the profession and therefore apt to be motivated by self-interest rather than the public interest. In Part II, we examine the political economy of special interest legislation, which suggests that little public good results from replacing competitive market forces with self-regulation. In Part III, we employ a basic economic model to generate predictions of the economic effects of professional licensing. Part IV provides a survey of the empirical research in this area, which confirms …

The Consequences For Children Of Incarcerated Parents., Lashawn Ford May 2015

The Consequences For Children Of Incarcerated Parents., Lashawn Ford

College of Arts & Sciences Senior Theses

There have been many controversies within the United States regarding the criminal justice system. One of the most common notions is the lack of support we give to the victims of crime. Generally, we associate the term “victim” with individuals who are directly harmed by the crime; however, we rarely consider the families of incarcerated offenders as victims (Light and Campbell 306). According to the U.S. Department of Justice, over fifty percent of state and federal inmates have at least one child under eighteen years of age (Glaze and Maruschak 1). This paper will focus on the effects incarceration can …

Reporting Practices, Knowledge And Opinion Of Policy Regarding Drivers With Dementia Among Arkansas Neurologists And Geriatricians, Erika Martin Gergerich

Graduate Theses and Dissertations

Background: States have various policies regarding a physician's ability or responsibility to report at-risk drivers with dementia to the Department of Motor Vehicles (DMV). Some states have mandatory reporting policies, others have optional reporting policies and some have no policy regarding this issue. Arkansas has no reporting policy regarding drivers with dementia to the DMV. Therefore, physicians in Arkansas face the risk of liability if they report a patient against their will to the DMV in good faith. Neurologists and geriatricians are often in a position to diagnose and treat individuals with dementia. Research Questions: The following three research questions …

Human Intelligence In Federal Terrorism Cases, Noah James Schneider May 2015

Human Intelligence In Federal Terrorism Cases, Noah James Schneider

Graduate Theses and Dissertations

Though it has often been quipped that the September 11th attacks changed "everything", domestic policy alterations were among the most significant changes after 9/11. Specifically, the 2002 Ashcroft Attorney General Guidelines and the 2008 Mukasey Attorney General Guidelines were two of the most impactful policy changes following 9/11. These Attorney General Guidelines changed the way the Federal Bureau of Investigation (FBI) investigated terrorism in the United States in addition to making counterterrorism the FBI's top priority. One of the ways the FBI prevents terrorism is through the use of undercover agents and confidential informants. How the 2002 and 2008 Attorney …

Framing Responsibility For Bullying: An Ethnographic Content Analysis, Kayla Knight

Graduate Theses and Dissertations

The purpose of the current study is to explore ways in which American print news media frame responsibility for adolescent and teen bullying. More specifically, how media portray responsibility for the underlying causes and consequences of bullying, as well as for responding to bullying, are examined. Drawing from media studies and the construction of Social problems literature, the study is guided by two broad research questions, 1) How do American news media frame responsibility for bullying? and 2) What news sources, or "claims-makers," are selected as authorities on bullying in news media articles? Articles published between 2009 and 2013 are …

The Effectiveness Of An Evidenced-Based Decision Making Program In Criminal Justice Systems, Tashina Lorraine Keith

Doctor of Psychology (PsyD)

Abstract The National Institute of Corrections selected the Yamhill County Department of Corrections to implement a new evidenced-based decision making program within their criminal justice system. As part of the new program, every individual who was arrested and placed on probation went through a case analysis assessment and had their treatment programs approved by a judge prior to sentencing. In this study 20 randomly selected individuals who received their treatment programming prior to sentencing were matched to 20 randomly selected individuals who received treatment programs post-sentencing. The hypothesis of this study was that those probationers in the pre-sentencing group who …

Blocking Negative Influential Node Set In Social Networks: From Host Perspective, Harneet Kaur

Dissertations, Theses and Capstone Projects (Full IR Collection)

Nowadays, social networks are considered as the very important medium for the spreading of information, innovations, ideas and influences among individuals. Viral marketing is a most prominent marketing strategy using word-of-mouth advertising in social networks. The key problem with the viral marketing is to find the set of influential users or seeds, who, when convinced to adopt an innovation or idea, shall influence other users in the network, leading to large number of adoptions. In our study, we propose and study the competitive viral marketing problem from the host perspective, where the host of the social network sells the viral …

Implementation Of A Patient Satisfaction Survey In A Federally Qualified Health Center, Ricardo Jose Ballin Ii May 2015

Implementation Of A Patient Satisfaction Survey In A Federally Qualified Health Center, Ricardo Jose Ballin Ii

Doctoral Projects

Safety net FQHCs are typically challenged with initiating and sustaining standardized measurement of patient satisfaction. Baseline survey data establishing how patients rate their satisfaction at San Francisco General Hospital (SFGH) Urgent Care Center (UCC), a public safety net federally qualified health center, located in San Francisco, California is needed. Implementing an existing patient satisfaction survey instrument using a standardized method, with volunteer survey administrators, made this study unique and resulted in a higher rate of survey participation that any other method previously attempted. Survey results determine whether patients' needs and expectations were being met, adding value and allowing for comparison …

Putting A Gag On Farm Whistleblowers: The Right To Lie And The Right To Remain Silent Confront State Agricultural Protectionism, Rita-Marie Cain Reid, Amber L. Kingery

Journal of Food Law & Policy

Whistleblowers play an important role in filling gaps in government food safety systems. Unfortunately, several dominant food-producing states have pursued legislative initiatives that punish farm whistleblowers and silence investigative tactics. First, this research describes various state legislative initiatives that curb criticism of agriculture. The work analyzes the federal food safety system and how these protections limiting agricultural criticism contravene that food safety net. Further, the research analyzes the free speech concerns in the newest protectionist laws. The analysis recommends strategies and future research to improve agriculture safety and protect free speech in an evolving food safety landscape.

State Vs. Federal: Marijuana Legislation And Its Effect On Taxes, Mamie G. Duckworth May 2015

State Vs. Federal: Marijuana Legislation And Its Effect On Taxes, Mamie G. Duckworth

Honors Theses

Marijuana is becoming increasingly popular and accepted within our society; so much so that certain states have legalized it for medical or recreational use, despite marijuana remaining illegal with regards to the federal government. This has lead, and will continue to lead, to complicated and uncertain tax scenarios for the businesses that produce and sell marijuana. Many problems stem from the federal government being unable to recognize or associate with businesses that deal with marijuana. This affects these otherwise legitimate businesses by disallowing the use of federally insured banks as well as taking away the ability to seek federal bankruptcy …

Another Collateral Consequence? : Examining Homeless Shelters Policies On Sex Offenders Across Four States., Shawn M. Rolfe May 2015

Another Collateral Consequence? : Examining Homeless Shelters Policies On Sex Offenders Across Four States., Shawn M. Rolfe

Electronic Theses and Dissertations

The primary focus throughout the literature regarding sex offenders has been on the efficacy and collateral damage of sex offender laws such as Sex Offender Registration and Notification (SORN) and residency restrictions. However, there is a lack in scholarship regarding transient sex offenders. The current research examines homeless shelter’s policies on permitting sex offenders to use their services in Michigan, Ohio, Kentucky and Tennessee. Previous research has found that sex offenders face reoccurring obstacles throughout the reintegration process, which has affected their ability to find suitable housing, employment and social support. The author explored homeless shelters’ policies and whether or …

Beyond The Right To Counsel: Increasing Notice Of Collateral Consequences, Brian M. Murray

University of Richmond Law Review

This article responds to these questions by focusing on the primary roots of this justice issue, namely the prevalence of guiltypleas and the continued efforts of legislatures to increase the life- long price of a conviction. Part I begins with a discussion of these practical realities within the criminal justice system. Part II then examines the law of guilty pleas under the Fifth Amendment, including constitutional standards for valid pleas, and how current jurisprudence fails to account for the collateral consequences mentioned in Part I. Part II also discusses the right to effective assistance of counsel under the Sixth Amendment, …

Physiologic Responses Of Firefighting Training Officers In The Structured Live-Fire Firefighting Training, Takahisa Koide

Boise State University Theses and Dissertations

Introduction: Firefighting is one of the most strenuous and dangerous occupations in the community. Training Officers are senior firefighters who take on the preparation and education of their fellow firefighters. One of the Training Officers’ tasks is structured live-fire training. During live-fire training, they are exposed to the stress of fire and high heat multiple times per day. In spite of this issue, there is no research focusing on Training Officers during the live-fire training evolution. Purpose: The present study was a pilot study to measure the stress experienced in the live-fire training and possibly reduce this stress by managing …

Immigration And Sentencing: Does Geograhical Region Of Citizenship Influence Sentence Longevity?, Oladipupo V. Adegun

Masters Theses and Doctoral Dissertations

A large volume of sentencing research has examined the effects of offender characteristics on sentencing outcomes. Most of this research has focused on offender race/ethnicity. Despite the growth of immigration debates in the United States, there is limited knowledge on the role played by citizenship status. The current study builds upon that body of sentencing literature by going beyond the examination of the legal status of offenders to explore whether sentencing outcomes vary according to geographical location of citizenship. Specifically, federal sentencing data is used to assess whether the length of sentence for non-US citizens convicted of drug trafficking is …

From The Warehouse To The Deathbed: Challenging The Conditions Of Mass Death In Prison, Ernest K. Chavez May 2015

From The Warehouse To The Deathbed: Challenging The Conditions Of Mass Death In Prison, Ernest K. Chavez

Themis: Research Journal of Justice Studies and Forensic Science

The purpose of this project is to analyze the crisis of mass incarceration by placing the conditions faced by elderly, terminally ill, and dying prisoners, as its main point of focus. Much of this crisis was built through post-1970s American penal policies which set in place tough sentencing laws, increased prosecutorial power, and ultimately, led to a significant growth in the prisoner population. Today, elderly and terminally ill prisoners make up the fastest growing population inside of prisons. Few of these prisoners are approved for early release, and instead die while incarcerated. This has resulted in a condition of mass …

Prison Privatization: Driving Influences And Performance Evaluation, Carla Schultz May 2015

Prison Privatization: Driving Influences And Performance Evaluation, Carla Schultz

Themis: Research Journal of Justice Studies and Forensic Science

United States conservatism and neoliberalism have created a market for prison privatization. The business of making money from incarcerated bodies is in direct conflict with the goals of the justice system. Driving economic and political forces are examined and used to explain the rising prison-industrial complex. Private prison performance is measured by recidivism, cost, inmate rights, and quality of confinement. This paper suggests that prison privatization must be reformed or abolished to improve the corrections system in the United States.
