There Goes The Neighborhood: Exposing The Relationship Between Gentrification And Incarceration, Casey Kellogg May 2015

There Goes The Neighborhood: Exposing The Relationship Between Gentrification And Incarceration, Casey Kellogg

Themis: Research Journal of Justice Studies and Forensic Science

This paper seeks to demonstrate that there is a deliberate and intentional link between residential housing patterns and crime and mass incarceration, and that government plays a strong role in allowing and formalizing this link. Using historical examples, this paper attempts to document the role of government and policy in furthering residential segregation through the processes of gentrification and disinvestment. By contributing to the destruction of low-income communities and the invasion of gentry through covert partnerships with the private sector to develop land and design cities, government has prioritized commercial interests over the needs of the community at all income …

Downtown Parking Meter Demand In El Paso, Thomas M. Fullerton Jr., E. Pallarez, Adam G. Walke May 2015

Downtown Parking Meter Demand In El Paso, Thomas M. Fullerton Jr., E. Pallarez, Adam G. Walke

Border Region Modeling Project

Prior research establishes that the price of parking in the city centre often impacts the decision to travel downtown and the mode of transportation utilized. Other factors that influence the decision to drive and park downtown have received less attention. This study uses time series data to analyse the demand for metered parking spaces in El Paso, Texas, USA. In addition to meter rates, the determinants of demand include personal income, gasoline prices, and the price of a substitute good, parking garage spaces. Because international bridges connect downtown El Paso to neighbouring Ciudad Juárez, Chihuahua, Mexico, the impacts of trans-boundary …

Legal Aspects Of Navigation: The Cases For Privacy And Liability: An Introduction For Non-Lawyers, Frans G. Von Der Dunk May 2015

Legal Aspects Of Navigation: The Cases For Privacy And Liability: An Introduction For Non-Lawyers, Frans G. Von Der Dunk

Space, Cyber, and Telecommunications Law Program: Faculty Publications

Navigation making use of advanced technologies—notably involving radiowaves providing precise information on positioning, navigation options, and on the surrounding geographic environment—has become an ever more present phenomenon in today’s societies. Needless to say, this raises also a number of profound legal issues, some more general in nature, some more specific to the navigation sector or even a specific subsector thereof, alternatively taking on a specific flavor once arising in that context. Among those, arguably the issues of privacy and protection of data against undue interference, respectively liability for erroneous positioning, navigation, or environmental information and any damage or loss suffered …

Taking A Stand?: An Initial Assessment Of The Social And Racial Effects Of Recent Innovation In Self-Defense Laws, Mario L. Barnes

Fordham Law Review

Perhaps, not surprisingly, the controversy over the rise of self-defense reforms in the United States that have come to be known as ―Stand Your Ground‖ (SYG) laws, began with a story about colors. This Article principally applies an empirical method and critical race theory (eCRT) lens to explore whether these reformed statutes, which generally have authorized greater use of force within the context of self-defense, deter crime and differentially affect Whites, Blacks, and other racial groups.

Undergraduate Honors Theses

At the end of the nineteenth century, individuals identified as child savers pioneered an unprecedented movement to save America’s children from physical and moral harm. The establishment of the juvenile justice system came as a result of the actions of the child savers. Researchers have focused extensively on many aspects of the juvenile justice system including studies on the effectiveness of the system to tracking the changes the system has undergone since its establishment. Numerous other studies examined opinions of the juvenile justice system. However, the research has focused solely on the general public, juvenile probation officers and juvenile correctional …

The Space Between: A Rhetorical Analysis Of Space And How It Functions Within Buffer Zone Discourse Concerning Reproductive Healthcare, Skye De Saint Felix May 2015

The Space Between: A Rhetorical Analysis Of Space And How It Functions Within Buffer Zone Discourse Concerning Reproductive Healthcare, Skye De Saint Felix

Communication Undergraduate Honors Theses

This study advances a critical legal analysis using Kenneth Burke's pentad to provide a rhetorical history and political assessment of abortion clinic buffer zones. Using the Freedom of Access to Clinic Entrances Act (1994), Hill v. Colorado (2000), and McCullen v. Coakley (2014), I offer an assessment of the politics of identification and location at play in both the majority opinion and dissent in each case. Although some communication scholarship, most notably Celeste Condit’s book Decoding Abortion Rhetoric (1990), has examined the political rhetoric of the abortion debates particularly in the 1980s, this groundbreaking study departs from the extant literature …

Right Hand Fork Pedestrian Bridge Final Report, Ren Gibbons

Undergraduate Honors Capstone Projects

Right Hand Fork is a tributary canyon whose stream enters the Logan River nine miles east of the mouth of Logan Canyon near Logan, Utah. The access bridge to a popular recreational area, the Hobbit Caves, was damaged in 2011 by flooding. We propose that a new bridge be designed and constructed for the Forest Service to replace the current structure to ensure public safety and minimize environmental impact. We plan to use a longer bridge span that will situate the abutments higher on the stream bank and reduce possible water damage during flood events. Bridge costs will be minimized …

Monitering And Addressing Light Pollution At Utah State University, Rachel Kim Nydegger May 2015

Monitering And Addressing Light Pollution At Utah State University, Rachel Kim Nydegger

Undergraduate Honors Capstone Projects

Many outdoor light fixtures illuminate in all directions, meaning that a large portion of light is emitted upwards. This excess light - light pollution - represents wasted energy and money, decreases public safety, is a health hazard for humans as well as wildlife, and inhibits the view of the night sky. In order to quantify the anthropogenic contribution of local light pollution, I studied detection methods at the National Optical Astronomy Observatory though a summer REU in 2013. Upon my return to USU, I monitored the night sky brightness from September 2013 to April 2015 at Utah State University. Due …

Laboratory Study On The Effects Of Exit Face Inclination Of Critical Gradients, Richard Allen Keizer Jr. May 2015

Laboratory Study On The Effects Of Exit Face Inclination Of Critical Gradients, Richard Allen Keizer Jr.

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

The objective of this research is to help better understand the effects of exit face inclinations on critical gradients. This will lead to more practical ways to predict critical hydraulic gradients and slope stability using soil properties and exit face conditions. Current geotechnical engineering does not consider these factors because they are not thoroughly understood. Despite the attempts to better predict critical gradients, methods developed over 70 years ago to model the heave mechanism are used to model failure mechanisms such as backward erosion (or piping). This critical hydraulic gradient is only calculated by means of the buoyant unit weight …

Experimental Validation Data For Cfd Of Steady And Transient Mixed Convection On A Vertical Flat Plate, Blake W. Lance

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

In this computer age, simulations are becoming common in science and engineering. One category of simulation, Computational Fluid Dynamics (CFD), begins with physical equations but adds approximations and calibrations in order to complete solutions. Translating these equations into computer languages may cause unintended errors. If simulation results are to be used for decision making, their accuracy needs to be assessed. This accuracy assessment is the theory behind the field of Verification & Validation.

Verification involves confirming the translation of physical equations to computer language was per- formed correctly. It also features methods to detect many types of code errors. Validation …

Do Irish Courts And The European Court Of Human Rights Have Achieved The Correct Balance Between Protection Of The Rights Of Individual Prisoners And Pragmatic Concerns Regarding The Proper Functioning Of The Prison System., Adrian Berski

Reports

Nowadays it is very hard to find the relevant balance between decisions of the Irish Courts and European Court of Human Rights (ECtHR), regarding the rights of individual prisoners and the proper functioning of the prison system. On one side, the main function of the courts is resolution dispute, apply the relative law and most importantly: protecting the law and human rights. On the other hand, court decisions have to be based on the relevant prison and justice systems that applies to each particular country.

It is worth taking into consideration that decisions made by the European Court of Human …

An Analysis Of Technical College Student Motivation To Pursue A Higher Grade In Core Academic Classes, Jeffrey Charles Hoffman May 2015

An Analysis Of Technical College Student Motivation To Pursue A Higher Grade In Core Academic Classes, Jeffrey Charles Hoffman

Doctoral Dissertations and Projects

The purpose of this predictive correlational study was to investigate the motivation of students seeking a vocation in the technical college setting. The study used Vroom's expectancy theory as it relates to students' beliefs in their ability to attain a higher grade (expectancy) and their desire for that grade (valence) to the effect on student academic effort (motivational force). The study's participants were selected from degree seeking students at a technical college in the Middle Georgia area. For the correlational element of the study, Hierarchical Multiple Regressions models were used and a statistically significant correlation was found, p < 0.05, thus supporting the use of the expectancy theory as an effective model for predicting student motivation resulting in a mean adjusted R² = .66. Further analysis from this data found that the predictors -valence and expectancy- can predict effort levels of motivation in the technical college degree student with near identical (p = .942) squared semi-partial correlation coefficients of .325 and.324 respectively. This correlational design, employing a within-persons decision-modeling research approach is an attempt to fill the gap in the research in the area of student motivation as it relates to technical college students, whose academics are designed for the sole purpose of preparing the student for employment in areas as diverse as accounting and welding.

The Value Of Dune Width In Avalon, New Jersey: A Hedonic Pricing Analysis, Matthew Mignon

CLAS: Colby Liberal Arts Symposium

Previous research on the economics of coastal housing markets has proven that housing values along the east coast of the United States capitalize on the attributes of local beaches. These recent studies document two important findings: i) that beach width positively affects coastal property values; ii) and that there is a proximity effect, in which distance from the beach plays a significant role in the capitalization of local beach attributes. This paper builds upon these findings to explore the influence that dune width has on coastal property values in Avalon, New Jersey. I hypothesize that homebuyers in a beach town …

The Superagency Solution, K.K. Duvivier

Sturm College of Law: Faculty Scholarship

In many parts of the country, hydraulic fracturing has brought energy development onto people’s doorsteps. Efforts by local governments to employ traditional land use mechanisms to study and mitigate some of the impacts of these latest intrusions have erupted into battles over the scope of statewide agencies’ control. Forgotten in this fray are many renewable energy resources. As a general rule, they are not subject to statewide oversight, and consequently renewable energy providers must navigate the myriad of siting and permitting requirements of local jurisdictions. For several years, scholars have urged more statewide renewable energy siting procedures to level the …
