Guilty By Reason Of Insanity: Unforeseen Consequences Of California's Deinstitutionalization Policy, Jen Rushforth May 2015

Guilty By Reason Of Insanity: Unforeseen Consequences Of California's Deinstitutionalization Policy, Jen Rushforth

Themis: Research Journal of Justice Studies and Forensic Science

Beginning with the passage of the Lanterman-Petris- Short Act in 1969, deinstitutionalization in California has had a devastating effect on the mentally ill. Instead of affording the mentally ill with more rights and protections, the process of shutting down state psychiatric hospitals and impeding psychiatric care for those in need caused a cascade effect leading to an increase of homelessness and incarceration. Over the past four decades, prisons and jails in California have become the de facto state mental hospitals, with severely mentally ill individuals having nearly a four-to-one chance of ending up in jail or prison over a psychiatric …

The Impacts Of Youth Conservation Corps On Participants: A Multi-Method Examination 2015, Nicholas Justin Prechel

Master's Theses

The purpose of this study was to examine the benefits that participants receive from serving in youth conservation corps. The entire population of one youth conservation corps was selected to participate in the study during the summer of 2012 trail work season. The study utilized a mixed-method approach that included a one-time pre/posttest with a retrospective pretest adapted from the American Camp Association’s Youth Outcomes Battery (YOB) and an open ended interview session. Of the 109 participants in the field at the time, 101 chose to participate in the quantitative survey. The YOB tested four areas: independence, responsibility, teamwork, and …

Gis And Database Management: Summer 2014 Internship With The Town Of Andover, Massachusetts, Heather Marie Cormier

Sustainability and Social Justice

My internship with the Town of Andover, Massachusetts took place during May, June, and July 2014. I worked directly with one supervisor, Laura DeGroot, for all projects, which included editing GIS administrative layers (e.g. boundaries, roads, zoning and school districts, etc.), creating new maps for recycling routes and septic systems within the town, analysis of census data, GPS data collection, and template design for online hiking trail maps. This report also details the mission of the town and how my internship played a role in achieving many of the overarching goals for data availability and communication, along with a reflection …

This survey:

  • identifies which activities appear to have the most positive impact on safety, livelihoods and socio-economic well-being, and why
  • identifies any negative impacts on any intended beneficiaries and the reasons for them
  • provides recommendations to help DDG improve their activities and impact.

The survey was an excellent opportunity to explore how the GICHD’s landmines and livelihoods surveys can be used for the broader human security sector. The findings and recommendations provide DDG with a better understanding of how linkages between security and livelihoods …

Evaluating Peace Support Operations To Enhance International Policy, Noreen Towle May 2015

Evaluating Peace Support Operations To Enhance International Policy, Noreen Towle

Peace and Conflict Studies

The United Nations (UN) is an international organization created from the express consent of states and established upon a multilateral international treaty between those states in order to perform the functions of promoting international peace and security, aid in the development of international relations, promote human rights, and aid in “harmonizing actions” between nations. The most ardent of these functions falls to the UN Security Council due to its responsibility for maintaining peace and security. UN peacekeeping missions were originally an alternative to collective security but they have evolved into Peace Support Operations (PSO) and are deployed with a strategy …

A Review Of Court Cases Involving Discrimination In Physical Ability Testing: 1992-2015, Casey L. Biggs

Masters Theses & Specialist Projects

Organizations that employ physically demanding jobs want to ensure their selection procedures distinguish qualified applicants from unqualified applicants. However, such selection tools typically result in adverse impact against various protected groups and often lead to litigation. Various factors influence the court’s decision to rule in favor of the plaintiff or the defendant. The purpose of the present study is to identify those factors. The ADA (1990) created strict guidelines for plaintiffs and defendants to follow to be credible in a discrimination case. This study will specifically determine the impact of the ADA guidelines and three additional factors that influence court …

The Boundless Treaty Power Within A Bounded Constitution, Saikrishna Bangalore Prakash May 2015

The Boundless Treaty Power Within A Bounded Constitution, Saikrishna Bangalore Prakash

Notre Dame Law Review

I count myself among those who suppose that the Constitution contains no subject matter limits on the treaty power. More precisely, I believe that the original Constitution granted the President the power to make international agreements, with no particular constraints on the subjects they might touch. I reach this conclusion with a great deal of reluctance not because the case for this proposition is weak but because, as a matter of policy, I favor subject matter limits on the treaty power as a means of ensuring exclusive state authority over certain matters. Nonetheless, I have become convinced that the Constitution …

A Rhetorician's Practical Wisdom, Linda L. Berger May 2015

A Rhetorician's Practical Wisdom, Linda L. Berger

Mercer Law Review

For three years, I had the great good fortune to work in the office next to Jack Sammons. My good fortune extended to a coincidence of timing that allowed me to work with Jack on a co-authored article, The Law's Mystery. During the time I worked next door, I felt cursed by an inability to grasp concepts that to Jack appeared inevitable and essential, whether those inevitabilities and essences were to be found within the law, good lawyering, or good legal education. The curse persisted throughout the writing of The Law's Mystery.

For Jack, the essence of a …

An Ethnographic Study Of Scrappers And Metal Thieves., Benjamin Fred Stickle May 2015

An Ethnographic Study Of Scrappers And Metal Thieves., Benjamin Fred Stickle

Electronic Theses and Dissertations

Metal theft is a crime that has significantly affected the U.S. in the last decade causing millions of dollars of damages and losses. However, little is known about its prevalence and harms to society. Moreover, even less is known about the individuals who are involved in metal theft. This lack of knowledge has hampered the ability of law enforcement, governments and individuals to prevent metal theft. The present study provides the first known qualitative examination of scrappers and metal thieves. Qualitative data is derived from participant observation and unstructured interviews with scrappers as well as metal thieves. The goals are …

Support Partners Of Registered Sex Offenders : Exploring Their Experiences, Identities, And Perceptions., David Patrick Connor May 2015

Support Partners Of Registered Sex Offenders : Exploring Their Experiences, Identities, And Perceptions., David Patrick Connor

Electronic Theses and Dissertations

Although it is widely recognized that many convicted criminal offenders experience considerable setbacks in communities that make their lives more arduous, registered sex offenders (RSOs) who live in American society arguably face more challenging impediments. As a result, ensuring their access to social support is especially salient. The notion that social support is particularly relevant to RSOs is perhaps best manifested through a common feature of community-based sex offender treatment programs, where participating RSOs are obligated to forge social relationships with primary support partners. These individuals are an important population to examine, as they purportedly play important roles with respect …

Judges' Perceptions Of Sex Offender Registration, Community Notification, And Residency Restrictions., Lauren Nicole Lennon May 2015

Judges' Perceptions Of Sex Offender Registration, Community Notification, And Residency Restrictions., Lauren Nicole Lennon

Electronic Theses and Dissertations

There is a meager amount of literature available on how criminal justice system actors perceive the range of sex offender registration and community notification (SORN) policies and their effectiveness, as well as sex offenders themselves. To date, only one study has been done on judges regarding their attitudes toward sexual offenders by Bumby and Maddox (1999). However, a study has not been completed in regard to judges’ perceptions of SORN and its efficacy in addition to their views on residency restrictions. The following study tries to expand the literature available and examines the perceptions of judges concerning SORN, residency restrictions, …

The Impact Of Victimization On The Disabled., Derek James Allen May 2015

The Impact Of Victimization On The Disabled., Derek James Allen

Electronic Theses and Dissertations

To date victimizations amongst the disabled has been researched, but the literature tends to group these victimizations amongst disabled as a whole. This research is also limited for this particular population and this review tries to outline, expand, and attempts to explain improvements for research by identifying the disabled into specific groups rather than all as one group. For example, individualizing policies and research for the blind specifically or any disability in an individualized approach. In the following an intensive online search of literature regarding different victimizations rates, types of disabilities and correlative victimizations, and the relationship these disabled individuals …

Food Safety : Analyzing The Connection Between Government And Industrial Influence., Jennifer Lee Hall 1983- May 2015

Food Safety : Analyzing The Connection Between Government And Industrial Influence., Jennifer Lee Hall 1983-

Electronic Theses and Dissertations

The purpose of this study was to examine the leaders within the U.S. food safety agencies and the top U.S. food producing companies, including meat, grain, and seed, and determine the presence of connectivity between the separate organizations. This involved looking at detailed biographical information on each leader, including previous and current employment, educational background and board memberships. Following identification of the agencies, companies, and their leaders, social network analysis was utilized to locate visual and quantitative links. Using the theories of C. Wright Mills and William Domhoff, the results showed a powerful argument that the power elite is still …

Development Of Optimal Experimental Design Parameters For Pseudo Ambient Vibration Testing Of Bridges, David Samudio Castillo May 2015

Development Of Optimal Experimental Design Parameters For Pseudo Ambient Vibration Testing Of Bridges, David Samudio Castillo

Civil Engineering Undergraduate Honors Theses

The United States of America is facing an infrastructure crisis that is characterized by aging and deteriorating structures, a significant backlog of maintenance and upgrades for existing infrastructure, limited funding and lack of practical and effective tools for identifying and prioritizing the most pressing infrastructure needs. The American Association of Civil Engineers (ASCE) qualifies America’s infrastructure with a D+(ASCE Report Card). This rating reflects the general state of infrastructure that is unlikely to improve dramatically in the short-term, yet the situation costs the nation billions of dollars annually due to losses in economic efficiency and productivity, and in some cases …

Thick Matters: De-Optimizing Infrastructural Redundancies, Pt. 1, Marco Ravini May 2015

Thick Matters: De-Optimizing Infrastructural Redundancies, Pt. 1, Marco Ravini

Architecture Senior Theses

Closed system design methodologies have produced infrastructures that anticipate only a single lifetime use. This approach has burdened many urban areas with defective infrastructures in need of perpetual modification and repair. Rather than continue to over-engineer these vital frameworks to resist the inevitable failure of individual components, the next generation of public infrastructure needs to exceed its

technical specifications and seek ways to create spatial reciprocity among systems. This thesis calls for a renewed understanding of redundancy in order to strategically infuse infrastructure with public agency and diverse utility. Such an approach has the potential to yield greater systemic outputs …

A Feasibility Study Of Distributed Spectrum Sensing Using Mobile Devices, Udit Kumar Gupta May 2015

A Feasibility Study Of Distributed Spectrum Sensing Using Mobile Devices, Udit Kumar Gupta

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

Given the exponential increase in mobile data traffic, there is a growing fear of an im- pending spectrum crunch. Shared use of the so-called ‘Whitespace’ spectrum offers a solution. Whitespace spectra are those that are already licensed for specific use but is understood to be ill-utilized over space and time. Examples include spectra used by ter- restrial TV broadcast or various radars. Shared use of such Whitespace spectra requires that incumbent licensed devices (primary) would have priority. One straightforward mechanism to detect the existence of primary transmissions is spectrum sensing. We are envisioning a spectrum sensing model where mobile devices …

Diversity, Democracy & Pluralism: Confronting The Reality Of Our Inequality, Stacy Hawkins May 2015

Diversity, Democracy & Pluralism: Confronting The Reality Of Our Inequality, Stacy Hawkins

Mercer Law Review

African-Americans were inspired by the election of Barack Obama as the first African-American President of the United States. Women were energized by even the prospect of electing the first female President of the United States. Latinos expressed pride in the confirmation of Justice Sonia Sotomayor to the United States Supreme Court. And a movie was made immortalizing Harvey Milk, the first openly gay politician elected to public office in the United States. This list of celebrated "firsts" goes on and on. All too often in the twenty-first century, we have either celebrated diversity among our civic leaders as a novelty, …
