Between Paris And The “Third World”: Lea Lublin’S Long 1960s, Isabel Plante Feb 2015

Between Paris And The “Third World”: Lea Lublin’S Long 1960s, Isabel Plante

Artl@s Bulletin

Lea Lublin resided for the most part in Paris from 1964 on, and by 1965 she started orienting her work toward establishing a methodology for reading images, based on different parameters of perception and participation related to the devices involved in their exhibition. Until 1972 she articulated a considerable portion of her projects between Paris, Buenos Aires and Santiago de Chile. These networks of production and circulation were decisive in constructing the meaning of her works in terms of exploring the status of representation and culture. We propose a study that would restore the geopolitical density and translocal nature of …

The Persistence Of Power And The Struggle For Dialogic Standards In Postmodern Constitutional Jurisprudence: Michelman, Habermas, And Civic Republicanism, Stephen Matthew Feldman Feb 2015

The Persistence Of Power And The Struggle For Dialogic Standards In Postmodern Constitutional Jurisprudence: Michelman, Habermas, And Civic Republicanism, Stephen Matthew Feldman

Faculty Articles

Since the 1950s most constitutional scholars have presumed that the American political system is pluralistic with autonomous individuals struggling in the legislative arena to maximize the satisfaction of their preexisting private interests The new republicans reject these presumptions and insist that constitutional jurisprudence must recognize the potential for virtuous citizens to engage in a political dialogue that generates public values and identifies a common good Frank I Michelman has pioneered this revival by confronting one of the most troubling and persistent difficulties of civic republican thought the likelihood that the political dialogue will be closed to segments of the community …

Local Government Reconsidered

Rodgers looks into the city of Bell, California and its corruption problems in 2010. Bell's city manager at the time, Robert Rizzo, had developed a plan to enrich himself at the city’s expense, and covered his tracks by involving numerous other city officials in his corrupt scheme, including the city councilmembers who were supposed to serve as a check on Rizzo’s power.

The Politics Of Postmodern Jurisprudence, Stephen Matthew Feldman Feb 2015

The Politics Of Postmodern Jurisprudence, Stephen Matthew Feldman

Faculty Articles

Forms of postmodern interpretivism including philosophical hermeneutics and deconstruction assert that we are always and already interpreting This assertion has provoked numerous scholarly attacks many of which invoke standard modernist hobgoblins such as textual indeterminacy solipsism ethical relativism and nihilism From the modernist standpoint postmodern jurisprudence is either conservative or apolitical because it lacks the foundations necessary for knowledge and critique In this article I argue that these modernist attacks not only are mistaken but that they also obscure the potentially radical political ramifications of postmodern interpretivism Postmodern interpretivism does not lead to an infinite regress of interpretations that undermines …

Diagnosing Power: Postmodernism In Legal Scholarship And Judicial Practice (With An Emphasis On The Teague Rule Against New Rules In Habeas Corpus Cases), Stephen Matthew Feldman Feb 2015

Diagnosing Power: Postmodernism In Legal Scholarship And Judicial Practice (With An Emphasis On The Teague Rule Against New Rules In Habeas Corpus Cases), Stephen Matthew Feldman

Faculty Articles

Whereas modernists constantly attempt to reduce the meanings of texts to an essential core or single truth postmodernists are antifoundationalists and antiessentialists According to postmodernists the meaning of a text is never grounded or stable and therefore one can always find multiple meanings or truths Thus one performs a postmodern flip by taking a segment of a text event or concept that apparently has been reduced to a static meaning or truth and suggesting the possible existence of another meaning or truth The postmodern flip then is completed by exploring how this new meaning or truth of the segment of …

Differentiating Writing Instruction: Meeting The Diverse Needs Of Authors In A Classroom, Mary Shea Feb 2015

Differentiating Writing Instruction: Meeting The Diverse Needs Of Authors In A Classroom, Mary Shea

Journal of Inquiry and Action in Education

Abstract

The proposed article, Differentiating writing instruction: Meeting the diverse needs of authors in a classroom, begins with an explanation of the concept of differentiated instruction as a basis and another term for responsive teaching. This involves writing instruction that is sensitive to the diversity of students’ individual strengths and needs and reacts to these factors in a timely manner with targeted instruction. The practice of responsive teaching — teaching differentially — is also the foundation of RTI (response to intervention) structures, currently developing in schools across the U.S. as a result of the national mandate. However, responsive teaching …

Raising The Standard: An Assessment Of Peer Collaboration As An Enhancer Of Speech Evaluation Fidelity, Terrell Kody Frey Feb 2015

Raising The Standard: An Assessment Of Peer Collaboration As An Enhancer Of Speech Evaluation Fidelity, Terrell Kody Frey

Theses and Dissertations

This thesis explores the state of speech evaluation training in the basic communication course at Illinois State University. Specifically, a new type of pedagogy known as the "peer workshop" is integrated into the course as a potential supplement to the speech evaluation training procedures. Quantitative and qualitative methods reveal how the course has become engrained into the academic expectations of the student body and identify written peer feedback as a necessary focus of future training in the classroom. Specific theoretical and pedagogical implications, as well as limitations and future directions, are discussed in detail.

A Report On An Arts-Led, Emotive Experiment In Interviewing And Storytelling, Kip Jones Feb 2015

A Report On An Arts-Led, Emotive Experiment In Interviewing And Storytelling, Kip Jones

The Qualitative Report

This paper reports on a two-day experimental workshop in arts-led interviewing technique using ephemera to illicit life stories and then reporting narrative accounts back using creative means of presentation. Academics and students from across Schools at Bournemouth University told each other stories from their pasts based in objects that they presented to each other as gifts. Each partner then reported the shared story to the group using arts-led presentation methods. Narrative research and the qualitative interview are discussed. The conclusion is drawn that academics yearn to express the more emotive connections generated by listening to the stories of strangers. The …

American Indian/Alaskan Native College Dropout: Recommendations For Increasing Retention And Graduation, David A. Patterson-Silver Wolf, Sheretta T. Butler-Barnes, Carol Van Zile-Tamsen

Center for Social Development Research

Throughout the United States, the college dropout rate among American Indian/Alaskan Native (AI/AN) students in public universities is the highest compared to any other student group. Researchers have identified this problem and offered reasons for it, but few have made specific efforts to disrupt the continued dropout rates. This article identifies and discusses three recommendations to address the dropout problem from a systems, rather than individual, perspective: (1) living and learning communities, (2) social belonging intervention, and (3) self-regulated learning activities. Studied with minority students, these endeavors show promise for retaining underrepresented students, specifically AI/AN students. To disrupt the long-term …

Cry Havoc: Are Incompetent Private Military Companies Ruining The Defense Base Act?, William Burke Feb 2015

Cry Havoc: Are Incompetent Private Military Companies Ruining The Defense Base Act?, William Burke

William & Mary Business Law Review

The Defense Base Act (“DBA” or “Act”) provides a no-fault, insurancebacked workers’ compensation mechanism for compensating private security contractors who are injured overseas. Critics of the Act allege that it should be fundamentally altered or replaced because combat zone work is uninsurable, the Act’s compensation is insufficient, and it is less efficient than the alternatives. This Note argues that, on the contrary, the DBA insurance market is functional and improving, its benefits are sufficient when viewed in combination with contractors’ other compensation, and it is a far more efficient compensation system than is offered by tort litigation. The flaws cited …

A Comparison Of Float Ownership Issues For Construction Projects Between Taiwan And China, Ming-Teh Wang, Su-Ling Fan, Chi-Chen Tsai, Luh-Maan Chang Feb 2015

A Comparison Of Float Ownership Issues For Construction Projects Between Taiwan And China, Ming-Teh Wang, Su-Ling Fan, Chi-Chen Tsai, Luh-Maan Chang

Journal of Marine Science and Technology–Taiwan

Float ownership is a controversial issue in construction projects. This study, which focuses on Taiwan and China, finds that attitudes regarding float ownership differ among stakeholders with different national and occupational backgrounds. To avoid disputes, practitioners should notice these differences before signing contracts. This study uses surveys to identify the potential differences in attitude regarding three important float ownership issues. The results vary from a previous study undertaken in the United Kingdom. The major findings of the study include: (1) contracts need to include clauses related to float ownership; (2) Taiwanese contractors and Chinese owners tend to view the float …

Legal Ignorance And Information-Forcing Rules, J. H. Verkerke Feb 2015

Legal Ignorance And Information-Forcing Rules, J. H. Verkerke

William & Mary Law Review

People are often ignorant about the legal rules that govern the most common transactions in their lives. This Article analyzes one common regulatory response to our widespread legal ignorance. A surprisingly broad range of legal rules have the ostensible purpose of inducing sophisticated parties to draft express contract language that will inform their contractual partners about the legal rules governing a particular transaction. However, this “legal-informationforcing” objective often remains unrealized because people routinely sign contracts without reading and understanding their terms. In theory, courts could design information-forcing rules that would be truly informative. But recognizing the potential futility of attempts …

The Transnational Rhetoric In Cabeza De Vaca’S La Relacion, Bincy Abdul Samad Feb 2015

The Transnational Rhetoric In Cabeza De Vaca’S La Relacion, Bincy Abdul Samad

Ray Browne Conference on Cultural and Critical Studies (2015-2021)

Abstract on La Relacion by Cabeza de Vaca

Identity is an important concept in postcolonial literature, especially when one’s identity is achieved rather than inherent. It is interesting to pursue how Cabeza de Vaca, the protagonist of La Relacion undergoes a transformation from his initial identity as a Spanish colonizer to a transnational hybrid, the Spanish-American. Despite multiple critics’ argument that La Relacion is “a discourse of failure” that “subverts the established order,” my paper rereads the narrative as a transnationally successful rhetoric by incorporating multiculturalism and hybridity. Thus Cabeza de Vaca becomes a hero if we accept his story …
