University of Richmond Law Review
This article will cover both consumer and business bankruptcy issues, and is limited primarily to decisions by courts within the Fourth Circuit since mid-2012. Despite these general parameters, because bankruptcy is federal law, there are some cases outside the Fourth Circuit that are included due to their influential and instructive nature. The intention of this update is to provide bankruptcy practitioners in Virginia with concise, yet compre-hensive, case summaries that will prove to be a valuable researchtool.

This article describes and evaluates an 8-week photography workshop, FotoLab, conducted in Italy at an afterschool-tutoring program for students acquiring Italian as an additional language. Seventeen students, age 8-17 and originating from 9 countries, participated. Co-facilitated by three international educator-researchers, FotoLab's purpose was to promote self-expression, collaboration, and visual literacy. Through a qualitative inquiry of the FotoLab curriculum, photographs and videos, field notes, and student questionnaires, this article reflects on themes of multiculturalism and multilingualism, collaboration, and visual literacy within a sociocultural animation framework. While expressions of cultural and linguistic identity emerged, findings emphasize the challenges and benefits of teamwork …

Brain and Mind Institute
OBJECTIVES: Previous studies have shown that residential proximity to a roadway is associated with increased cardiovascular disease risk. Yet, the nature of this association remains unclear, and its effect on individual cardiovascular disease risk factors has not been assessed. The objective of this study was to determine whether residential proximity to roadways influences systemic inflammation and the levels of circulating angiogenic cells.
APPROACH AND RESULTS: In a cross-sectional study, cardiovascular disease risk factors, blood levels of C-reactive protein, and 15 antigenically defined circulating angiogenic cell populations were measured in participants (n=316) with moderate-to-high cardiovascular disease risk. Attributes of roadways surrounding …

Becoming An Ally: Multi-Family Group Therapy Pilot With Low-Income Families, Julie Virginia Estrella
Loma Linda University Electronic Theses, Dissertations & Projects
The increasing demand for couple and family therapists (CFT) in integrated health care settings requires CFTs to learn to effectively serve low-income families. Resilience literature suggests that building families’ resilience and social support directly impacts a family’s chances for socioeconomic mobility. Multi-family group therapy (MFGT) offers an effective vehicle for increasing resilience and social support. This dissertation examines the link between family resilience and poverty and presents an ecological, solution-focused, family resilience lens applied through a pilot MFGT program, Bouncing Forward Family (BFF) Groups, for low-income families. This dissertation includes two publishable papers, and the first focuses on the BFF …

This study advances understanding of predictors of child abuse and neglect at multiple levels of influence. Mothers, fathers, and children (N = 1,432 families, M age of children = 8.29 years) were interviewed annually in three waves in 13 cultural groups in nine countries (China, Colombia, Italy, Jordan, Kenya, Philippines, Sweden, Thailand, and the United States). Multilevel models were estimated to examine predictors of (a) within-family differences across the three time points, (b) between-family within-culture differences, and (c) between-cultural group differences in mothers’ and fathers’ reports of corporal punishment and children’s reports of their parents’ neglect. These analyses addressed …

Implementation Of Positive Behavior Intervention And Support At The High School Level, Bernadette D. White
Implementation Of Positive Behavior Intervention And Support At The High School Level, Bernadette D. White
Dissertations
With schools having an ever-increasing interest in reducing acts of violence and reducing the incidence of out-of-school suspension, new interventions are constantly being sought. How the program is implemented can play a significant role in program effectiveness. Durlak (1998) found that many evaluation methods did not consider the implementation process because they were done after the implementation of the program. Whether an evidence-based intervention would have a positive effect depended on closely following the details of the implementation process (Durlak, 1998). This study was motivated by four research questions: (a) Was the process used to implement Positive Behavior Intervention and …
Student Involvement In Extracurricular Activities And Post-Secondary Education Placement, Courtney J. Martin
Student Involvement In Extracurricular Activities And Post-Secondary Education Placement, Courtney J. Martin
Dissertations
Extracurricular activities have been an important part of adolescents’ lives for generations (Kremer-Sadlik, Izquierdo, & Fatigante, 2010). Extracurricular activities take place outside of the classroom and result in several benefits to students (National Federation of State High School Associations [NFHS], 2010). With the recent recession in the United States, many school districts are having to find ways to cut budgets and are looking at eliminating extracurricular activities to save money (Lamb, 2011). Data from graduating seniors were reviewed in the largest accredited public school district in a Midwestern state. Graduates are required to take a post-follow up survey upon graduating …

Department of Emergency Medicine Faculty Papers
OBJECTIVE: Determination of clinical outcomes following resuscitation from cardiac arrest remains elusive in the immediate post-arrest period. Echocardiographic assessment shortly after resuscitation has largely focused on left ventricular (LV) function. We aimed to determine whether post-arrest right ventricular (RV) dysfunction predicts worse survival and poor neurologic outcome in cardiac arrest patients, independent of LV dysfunction.
METHODS: A single-center, retrospective cohort study at a tertiary care university hospital participating in the Penn Alliance for Therapeutic Hypothermia (PATH) Registry between 2000 and 2012.
PATIENTS: 291 in- and out-of-hospital adult cardiac arrest patients at the University of Pennsylvania who had return of spontaneous …

Wireless Sensor Platform For Pulse Oximetry, Anusha Aithal
Theses
Pulse rate and oxygen saturation are two important clinical measurements that indicate the state of a person’s essential body functions. Oxygen saturation is the measurement of oxygenated hemoglobin in arterial blood i.e. it indicates the level of oxygen in the blood. Pulse oximeters, consisting of LEDs and photodetectors, offer a simple and low cost means of monitoring both pulse rate and blood oxygen saturation non-invasively.
The primary objective of this project was to develop a wireless platform for MEMS devices. For this project, a pulse oximeter was also developed as a demonstration vehicle for this wireless platform. A microcontroller and …

BACKGROUND: Heart failure disease management programs can influence medical resource use and quality-adjusted survival. Because projecting long-term costs and survival is challenging, a consistent and valid approach to extrapolating short-term outcomes would be valuable.
METHODS: We developed the Tools for Economic Analysis of Patient Management Interventions in Heart Failure Cost-Effectiveness Model, a Web-based simulation tool designed to integrate data on demographic, clinical, and laboratory characteristics; use of evidence-based medications; and costs to generate predicted outcomes. Survival projections are based on a modified Seattle Heart Failure Model. Projections of resource use and quality of life are modeled using relationships with time-varying …
Arbitrator Bias, William W. Park
Arbitrator Bias, William W. Park
Faculty Scholarship
Seeking to bring arbitration into disrepute, an evil gremlin might contemplate two starkly different routes. One route would tolerate appointment of pernicious arbitrators, biased and unable to judge independently. An alternate route to shipwreck, also reducing confidence in the integrity of the arbitral process, would establish unrealistic ethical standards that render the arbitrator’s position precarious and susceptible to destabilisation by litigants engaged in dilatory tactics or seeking to annul unfavourable awards. To reduce the risk of having cases decided by either pernicious or precarious arbitrators, those who establish and apply ethical guidelines walk a tightrope between the rival poles of …

Financial Rewards For Whistleblowing Lawyers, Kathleen Clark, Nancy J. Moore
Faculty Scholarship
The federal government relies increasingly on whistleblowers to ferret out fraud, and has awarded whistleblowers over $4 billion under the False Claims Act and the Dodd-Frank Wall Street reform and Consumer Protection Act. May lawyers ethically seek whistleblower rewards under these federal statutes? A handful of lawyers have tried to do so as FCA qui tam relators. They have not yet succeeded, but several court decisions suggest that they might be able to do so under confidentiality exceptions to state ethics law, which several courts have held are not preempted by the FCA. No lawyer has been publicly identified as …
How Algorithmic Trading Undermines Efficiency In Capital Markets, Yesha Yadav
How Algorithmic Trading Undermines Efficiency In Capital Markets, Yesha Yadav
Vanderbilt Law Review
This Article argues that the rise of algorithmic trading undermines efficient capital allocation in securities markets. It is a bedrock assumption in theory that securities prices reveal how effectively public companies utilize capital. This conventional wisdom rests on the straightforward premise that prices reflect available information about a security and that investors look to prices to decide where to invest and whether their capital is being productively used. Unsurprisingly, regulation relies pervasively on prices as a proxy for the allocative efficiency of investor capital. Algorithmic trading weakens the ability of prices to function as a window into allocative efficiency.

A Laboratory Of Regulation: The Untapped Potential Of The Hhs Advisory Opinion Power, Christopher J. Climo
Vanderbilt Law Review
Of late, the federal government's approach to regulation of hospitals and other healthcare providers asks them to do more with less. Both the government and private insurers have increasingly assigned hospitals and other providers with financial responsibility for the quality of the care they provide to federal beneficiaries.' At the same time, experts predict that reimbursement rates by both the government and private insurers will fall as a result of the Affordable Care Act's recent efforts to increase access to healthcare. Facing a widening gap between expectations of quality and availability of financial resources, healthcare providers will need to pursue …

National Study Of Brt Development Outcomes, Arthur C. Nelson, Joanna Ganning
TREC Final Reports
Bus rapid transit (BRT) is poised to become the “next big thing” in public transit. From virtually no systems a generation ago, there are now 19 lines operating with at least seven under construction and more than 20 in the planning stages. BRT is gaining popularity because of its combination of low capital cost and potential for high levels of benefits. But are BRT systems effective in attracting development?
To answer this and many more trending BRT questions, the Metropolitan Research Center (MRC) reviewed multiple studies using data from the United States Census Bureau, Longitudinal Employer-Household Dynamics, and CoStar data …

This article investigates how digital technologies in the energy sector are enabling increased value extraction in the cycle of capital accumulation through surveillant proceesses of everyday energy consumption. We offer critical theory (Gramsci, Foucault) and critical political economy (Marx) as a guide for critical understanding of value creation in ICT through quotidian processes and practices of social reproduction. In this regard, the concept of the "prosumer" is extended beyond notions of voluntary participation in Web 2.0 to the political economy of energy use. Within this broad framework we investigate national and local level "smart grid" campaigns and projects. The "smartening" …

An Executive-Power Non-Delegation Doctrine For The Private Administration Of Federal Law, Dina Mishra
Vanderbilt Law Review
Private entities often administer federal law. The early-twentieth-century Supreme Court derived constitutional limits to delegations of administrative power to private entities, grounding them in Article I of the Constitution where legislative power is delegated and in the Due Process Clause where the delegee's bias is apparent. But limits to the delegation of executive power to private administrators of law might exist in Article II. Those limits- in particular, their scope and the interplay among them-have been left underdeveloped by existing scholarship.
This Article explores the possibility of an Article II executive-power non-delegation doctrine for the private administration of federal law, …

The plaintiffs' daughter was four years old when they brought her in to the local medical clinic. Clinic staff gave the girl a sedative to keep her calm while they examined her, but they miscalculated the dose, and she later died.' Tort liability, or the specter of it, is supposed to discourage these kinds of preventable tragedies. The clinic's owner, fearing a potential crippling award to bereaved families, should have trained his staff more carefully. As it happens, the owner instead had carefully scooped all the assets out of the firm. When the girl's parents won a $34.6 million award …
