Landsat 8 extends the remarkable 40 year Landsat record and has enhanced capabilities including new spectral bands in the blue and cirrus cloud-detection portion of the spectrum, twothermal bands, improved sensor signal-to-noise performance and associated improvements in radiometric resolution, and an improved duty cycle that allows collection of a significantly greater number of images per day. This paper introduces the current (2012–2017) Landsat Science Team's efforts to establish an initial understanding of Landsat …

Equipment Fragility Due To Shock Response, Christopher Y. Tuan Jan 2014

Equipment Fragility Due To Shock Response, Christopher Y. Tuan

Department of Civil and Environmental Engineering: Faculty Publications

Because of its simplicity, the shock response spectrum has become widely used as a means of describing the shock responses and fragilities of structures and equipment. This paper focuses on the drawbacks of using the shock response spectrum for defining equipment shock tolerance. A cantilever beam with a tip mass was used to model a hypothetical piece of equipment subjected to strong ground motion such as that caused by an explosion. The exact solution from a detailed modal analysis shows that multiple modes of response were excited. Contributions from higher modes can be more predominant than that from the fundamental …

The Effect Of Land Cover/Land Use Changes On The Regional Climate Of The Usa High Plains, Denis Mutiibwa, Ayse Kilic, Suat Irmak

Department of Civil and Environmental Engineering: Faculty Publications

We present the detection of the signatures of land use/land cover (LULC) changes on the regional climate of the US High Plains. We used the normalized difference vegetation index (NDVI) as a proxy of LULC changes and atmospheric CO2 concentrations as a proxy of greenhouse gases. An enhanced signal processing procedure was developed to detect the signatures of LULC changes by integrating autoregression and moving average (ARMA) modeling and optimal fingerprinting technique. The results, which are representative of the average spatial signatures of climate response to LULC change forcing on the regional climate of the High Plains during the …

Assessment Of Load Sharing Members In An Anti-Ram Bollard System, Scott Kinney, Daniel Linzell, Edward O'Hare

Department of Civil and Environmental Engineering: Faculty Publications

Due to the increased frequency, scale, and danger of malicious attacks carried out by Vehicle Borne Improvised Explosive Devices (VBIEDs), anti-ram bollards have become a key element in the protection of critical structures. This study focused on the evaluation of above grade load sharing members in a steel anti-ram bollard system in an attempt to develop efficient load sharing mechanisms that improve the structure’s ability to resist vehicle impacts, while concurrently remaining aesthetically pleasing to the general public. A computational assessment was completed using calibrated LS-DYNA finite element models to determine if effective load sharing member configurations and designs could …

A Study Of Dynamic Right-Turn Signal Control Strategy At Mixed Traffic Flow Intersections, Zhizhou Wu, Li Zhao, Jian Sun Jan 2014

A Study Of Dynamic Right-Turn Signal Control Strategy At Mixed Traffic Flow Intersections, Zhizhou Wu, Li Zhao, Jian Sun

Department of Civil and Environmental Engineering: Faculty Publications

Traffic conflicts among right-turn vehicles (RTVs), non-motorized vehicles (NMVs) and pedestrians were examined for urban signalized intersections with exclusive right-turn lane. This study proposed an approach to dynamically calculate the duration of the prohibited right-turn for vehicles by using a measure called the Degree of Clustered Conflict (DCC). The process of DCC control includes: 1) quantitative calculation of DCC value in the conflict area; 2) establishing the general cost model that combines the delay and conflict indicators; and 3) applying the DCC-control time model to control RTV in real time. Based on these, the paper presented a general approach of …

Using Reasonable Royalties To Value Patented Technology, David O. Taylor Jan 2014

Using Reasonable Royalties To Value Patented Technology, David O. Taylor

Faculty Journal Articles and Book Chapters

In the last several years, commentators have expressed serious concerns with the state of the law governing awards of reasonable royalties as damages in patent infringement cases. Given these concerns, the proper assessment of royalties has been a recent, frequent topic for debate among economists and legal scholars. At the same time, all three branches of the federal government have studied ways to improve the law governing reasonable royalties. In this Article, I reframe the ongoing debate by identifying and exploring two basic paradigms for calculating reasonable royalties: valuing patent rights and valuing patented technology. The traditional paradigm, valuing patent …

Quality Of Care From A Parent’S Point Of View: An Examination Of An Early Childhood Education Center Located At A Community College, Jennifer Brown

Theses and Dissertations

This applied dissertation was designed to understand parents’ views about child care and the variables that influence their decision to place their children in 5-star child-care facilities. Child care of any kind is often the first group experience children have outside the home. The first 5 years are the most important years in a child’s educational life; it sets the educational foundation for the rest of the child’s life.

The quantitative portion of this study consisted of four research questions, which assessed several sets of relationships and issues: (a) the relationship between demographic data and quality of care; (b) the …

Moral Touchstone, Not General Deterrence: The Role Of International Criminal Justice In Fostering Compliance With International Humanitarian Law, Chris Jenks Jan 2014

Moral Touchstone, Not General Deterrence: The Role Of International Criminal Justice In Fostering Compliance With International Humanitarian Law, Chris Jenks

Faculty Journal Articles and Book Chapters

This article contends that international criminal justice provides minimal general deterrence of future violations of international humanitarian law (IHL). Arguments that international courts and tribunals deter future violations – and that such deterrence is a primary objective – assume an internally inconsistent burden that the processes cannot bear, in essence setting international criminal justice up for failure. Moreover, the inherently limited number of proceedings, the length of time required, the dense opinions generated, the relatively light sentences and the robust confinement conditions all erode whatever limited general deterrence international criminal justice might otherwise provide. Bluntly stated, thousands of pages of …

Civil Liberties And The Indefinite Detention Of U.S. Citizens, Chris Jenks Jan 2014

Civil Liberties And The Indefinite Detention Of U.S. Citizens, Chris Jenks

Faculty Journal Articles and Book Chapters

Section 1021 of the 2012 National Defense Authorization Act provides for the indefinite detention of individuals deemed to be part of or substantially supportive of al Qaeda, the Taliban, and associated forces in hostilities against the United States or its coalition allies. Yet the Congress which drafted Section 1021 doesn’t know what its operative terms mean and the Executive Branch simultaneously claims the provisions are problematic yet meaningless and signs them into law. The result is uncertainty over the Executive Branch’s armed conflict detention authority, not on distant battlefields, but here in the United States. This article focuses on three …

A Prospective Study Of Periodontal Disease And Risk Of Gastric And Duodenal Ulcer In Male Health Professionals, Matthew R. Boylan, Hamed Khalili, Edward S. Huang, Dominique S. Michaud, Jacques Izard, Kaumudi J. Joshipura, Andrew T. Chan

Department of Food Science and Technology: Faculty Publications

Periodontal disease is characterized by microbial shifts within the oral cavity and chronic inflammation of the gingival tissue, and can lead to tooth loss. Several studies support an association between periodontal disease and risk of chronic systemic conditions, including vascular disease, chronic obstructive pulmonary disease, diabetes mellitus, and cancer, including gastric adenocarcinoma. These associations may be mediated by systemic inflammation, the immune response to periodontal infection, or direct invasion by pathogens. Previous studies of periodontal disease and risk of peptic ulcer have been limited by cross-sectional design, diagnoses that were not confirmed by medical record review, and a lack of …

Beyond Child Welfare - Theories On Child Homelessness, Jessica Dixon Weaver Jan 2014

Beyond Child Welfare - Theories On Child Homelessness, Jessica Dixon Weaver

Faculty Journal Articles and Book Chapters

According to recent federal data from 2013, the number of children who experience homelessness in the United States has reached an astonishing 2.5 million. Among industrialized nations, America has a one of the highest poverty rates among children, peaking at 22% in 2010. This Article considers why there is an ambivalent and sometimes hostile response to chronic, persistent poverty among families with young children. Various reports on the state of homeless families state that the cause of homelessness is a combination of lack of affordable housing, extreme poverty, decreasing government support, domestic violence, the challenge of raising children alone, and …

Larry From The Left: An Appreciation, Grant M. Hayden, Matthew T. Bodie Jan 2014

Larry From The Left: An Appreciation, Grant M. Hayden, Matthew T. Bodie

Faculty Journal Articles and Book Chapters

This essay approaches the scholarship of the late Professor Larry Ribstein from a progressive vantage point. It argues that Ribstein's revolutionary work upended the "nexus of contracts" theory in corporate law and provided a potential alternative to the regulatory state for those who believe in worker empowerment and anti-cronyism. Progressive corporate law scholars should look to Ribstein's scholarship not as a hurdle to overcome, but as a resource to be tapped for insights about constructing a more egalitarian and dynamic economy.

Arrakis: Atlas Of Resonance Rings As Known In The S⁴G, Sébastien Comerón, Trisha Mizusawa Jan 2014

Arrakis: Atlas Of Resonance Rings As Known In The S⁴G, Sébastien Comerón, Trisha Mizusawa

Aerospace, Physics, and Space Science Faculty Publications

Context. Resonance rings and pseudorings (here collectively called rings) are thought to be related to the gathering of material near dynamical resonances caused by non-axisymmetries in galaxy discs. This means that they are the result of secular evolution processes that redistribute material and angular momentum in discs. Studying them may give clues on the formation and growth of bars and other disc non-axisymmetries. Aims. Our aims are to produce a catalogue and an atlas of the rings detected in the Spitzer Survey of Stellar Structure in Galaxies (S⁴G) and to conduct a statistical study of the data in the catalogue. …

Gmos And Iprs Are Key Weapons In Fight Against Hunger, Konstantinos Giannakas Jan 2014

Gmos And Iprs Are Key Weapons In Fight Against Hunger, Konstantinos Giannakas

CAFIO: Policy Research Group Policy Pagers

The introduction of genetically modified organisms (GMOs) into the food system and the assignment of intellectual property rights (IPRs) for plant genetic resources are among the most notable features of the increasingly industrialized agri-food marketing system of numerous developed and developing countries around the world. IPRs have provided innovating firms with incentives to aggressively pursue improvements of crop characteristics (such as herbicide tolerance, insect and virus resistance, drought tolerance and increased nutritional value) through gene splicing techniques, and the agronomic benefits associated with the genetically modified (GM) products have resulted in their embrace by a significant number of agricultural producers …

Ad Hoc Disaster And Crop Insurance Programs May Reduce The Use Of Risk-Reducing Conservation Tillage Practices, Karina Schoengold, Ya Ying, Russell Headlee Jan 2014

Ad Hoc Disaster And Crop Insurance Programs May Reduce The Use Of Risk-Reducing Conservation Tillage Practices, Karina Schoengold, Ya Ying, Russell Headlee

CAFIO: Policy Research Group Policy Pagers

There is growing concern that the risks facing agricultural producers are increasing due to several factors that include the predicted effects of climate change leading to more frequent floods, droughts, and higher temperatures as well greater use of agricultural outputs for nonfood energy products.

These risks are partially managed through federal agricultural programs. Ad hoc disaster payments have frequently been used to provide financial support.

An Environmental Conversation, William Murray Tabb Jan 2014

An Environmental Conversation, William Murray Tabb

Faculty Articles

Federal environmental law and policy ambitiously purports to provide clean air and water, protect endangered and threatened species, clean-up hazardous and toxic waste sites, and infuse environmental considerations into the decision-making process of all federal agencies with respect to major proposals impacting the environment. Despite such lofty goals and an expansion of the regulatory state, certain types of activities and associated risks have eluded statutory coverage. Additionally, these uncoordinated federal environmental statutes typically embody a singular and sometimes myopic focus, leading to unpredictable or undesirable regulatory gaps, constraints, and inefficiencies. Further, limitations on standing and judicial review may significantly limit …

I Need A Doctor: A Critique Of Medicare Financing Of Graduate Medical Education, Stacey A. Tovino Jan 2014

I Need A Doctor: A Critique Of Medicare Financing Of Graduate Medical Education, Stacey A. Tovino

Faculty Articles

In its broadest sense, this Article examines the complex relationship between population booms, doctor shortages, and United States government financing of graduate medical education (GME). More specifically, this Article argues that current rules governing the calculation of Medicare payments to teaching hospitals for the costs of GME are based on cost, population, and other data that are no longer relevant. As applied, these formulas discriminate in favor of the nation's oldest teaching hospitals, located in New England and the Middle Atlantic, and against current and future teaching hospitals located in growing population centers, especially regions in the South and West. …

Lost In The Shuffle: How Health And Disability Laws Hurt Disordered Gamblers, Stacey A. Tovino Jan 2014

Lost In The Shuffle: How Health And Disability Laws Hurt Disordered Gamblers, Stacey A. Tovino

Faculty Articles

Gambling disorder is not a legally sympathetic health condition. Health insurance policies and plans have long excluded treatment for gambling disorder from health insurance coverage. Individuals with gambling disorder who seek disability income insurance benefits from public and private disability income insurers also tend not to be successful in their claims. In addition federal and state antidiscrimination laws currently exclude individuals with gambling disorder from disability discrimination protections. This Article is the first law review article to challenge the legal treatment of individuals with gambling disorder by showing how health insurance and antidiscrimination laws hurt problem gamblers. Using neuroscience, economics, …

Using Plant Extracts To Reduce Asexual Reproduction Of Apple Scab (Venturia Inaequalis), János Bálint, Szilveszter Nagy, Rezso Thiesz, Imre-István Nyárádi, Adalbert Balog

Turkish Journal of Agriculture and Forestry

The aim our research was to develop effective methods for organic apple farming, based on the use of plant extracts to control the asexual reproduction of Venturia inaequalis. Plant extracts of artemisinin, chelidonine, thymol, and populin tested in vitro under laboratory conditions significantly slowed down the germination of V. inaequalis conidia. During a 2-year study under field conditions, the effect of 1% populin, an extract from black poplar buds, on apple scab was tested in parallel with synthetic fungicides and a no-pesticide regime on Golden Delicious and Jonathan apples. Populin significantly reduced the number of scabbed leaves and fruits on …

Dynamic Base-Age Invariant Site Index Models Based On Generalized Algebraic Difference Approach For Mixed Scots Pine (Pinus Sylvestris L.) And Oriental Beech (Fagus Orientalis Lipsky) Stands, İlker Ercanli, Aydin Kahri̇man, Hakki Yavuz

Turkish Journal of Agriculture and Forestry

Data from stem analysis of 397 dominant trees (198 Scots pine and 199 Oriental beech) were used to evaluate dynamic base-age invariant site index models derived from Bertalanffy-Richards, Hossfeld, and Lundqvist-Korf functions with the generalized algebraic difference approach (GADA) for mixed Scots pine (Pinus sylvestris L.) and Oriental beech (Fagus orientalis Lipsky) stands. These functions were compared with respect to residuals of these models; specifically, the evaluation criteria were bias (E), root mean square error (RMSE), absolute mean error (AME), adjusted coefficient of determination (R^2_{adj}), and Akaike information criterion. The best results were obtained with generalized algebraic difference equations derived …

Assessment Of Forest Road Conditions In Terms Of Landslide Susceptibility: A Case Study In Yığılca Forest Directorate (Turkey), Remzi̇ Eker, Abdurrahi̇m Aydin

Turkish Journal of Agriculture and Forestry

Forest roads are one of the biggest investments in forest management. Their possible adverse effect on the environment is becoming an important issue for administrators due to a recent increase in public awareness. Especially in the Black Sea Region of Turkey, road-related landslides are common in forested areas because the roads are located in hilly regions with steep slopes. In addition to their impact on forests, landslides can cause damage to roadbeds which requires immediate maintenance. Landslide-susceptibility maps are widely used for different purposes such as reducing the effects of landslides, decision making, and planning. These maps can easily be …
