The Council Of The Indies And Religion In The Spanish New World, Ashley D. Ellington
The Council Of The Indies And Religion In The Spanish New World, Ashley D. Ellington
College of Graduate Studies: Theses & Dissertations
The Council of the Indies was responsible for the governing of the Spanish Empire, including issues of religion. During the reign of Philip II, the Council gained independence from the Council of Castile and was able to take more control of the Spanish territories. In response to outside factors, the Council codified its laws regarding the spread of the Catholic faith, which became the basis for Council control of religion under the authority of the king. A review of the Council during this time led to many changes in an effort to make the Council less corrupt and more efficient. …
Development And Support Of Dual Language Policies, Hollis Derek Cone
Development And Support Of Dual Language Policies, Hollis Derek Cone
College of Graduate Studies: Theses & Dissertations
Teaching a second language is not a new idea. Bilingual education has gone through a metamorphosis over the years. The most current bilingual program is the two-way or dual language program. Dual language programs educate students that speak a different language in the same classroom. The idea is that one group is strengthened in its native language; the other group acquires the second language.
Each local school board must implement its own policies to create a dual language program; unfortunately, few, if any, research studies exist that identify how local school boards can implement a dual language program. School districts …

The study purpose was to evaluate the effectiveness of a structured education curriculum with simulation training in educating undergraduate Baccalaureate of Science in Nursing (BSN) students to recognize and respond to patients experiencing acute deterioration as first responders. Researchers have demonstrated a lack of adequate clinical reasoning skills in new graduate nurses is a factor in critical patient incidents. A mixed methods design using a quasi-experimental, repeated measures and a descriptive, qualitative approach was used. A convenience sample of 48 BSN students was recruited. Statistically significant increases were shown in knowledge, self-confidence, and perceptions of teamwork. Six categories emerged from …
Technology Licensing In A Differentiated Oligopoly, Aniruddha Bagchi, Arijit Mukherjee
Technology Licensing In A Differentiated Oligopoly, Aniruddha Bagchi, Arijit Mukherjee

We show the effects of product differentiation and product market competition on technology licensing by an outside innovator. For a certain range of product differentiation, both the innovator and the society prefer royalty licensing compared to auction (or fixed-fee), irrespective of Cournot and Bertrand competitions, if the number of potential licensees is sufficiently large. Hence, for such a range of product differentiation, neither the innovator nor the antitrust authority requires information about the type of product market competition in choosing the type of the licensing contract.

Faculty & Staff Scholarship
Concept Inventories (CIs) are assessments designed to measure student learning of core concepts. CIs have become well known for their major impact on pedagogical techniques in other sciences, especially physics. Presently, there are no widely used, validated CIs for computer science. However, considerable groundwork has been performed in the form of identifying core concepts, analyzing student misconceptions, and developing CI assessment questions. Although much of the work has been focused on CS1 and a CI has been developed for digital logic, some preliminary work on CIs is underway for other courses. This literature review examines CI work in other STEM …

Small Fry In Copyright Litigation, James Gibson
Small Fry In Copyright Litigation, James Gibson
Law Faculty Publications
In two of my earlier entries in this series, I discussed the results of an empirical study of copyright cases that I have been doing with my colleague Chris Cotropia. One of those entries focused on how hard the parties in copyright lawsuits fightagainst each other, and the other focused on the role of major media companies in copyright litigation.
In this entry, I will continue to talk about the parties that we observed in our study, but instead of discussing major media companies, I will concentrate on the other end of the spectrum: the individual as a party. This …
A Content Analysis Of Celebrity-Endorsed Cosmetic Products In Fashion Magazines, Caroline Szwed
A Content Analysis Of Celebrity-Endorsed Cosmetic Products In Fashion Magazines, Caroline Szwed
Graduate Theses, Dissertations, and Problem Reports (ETD)
While there have been many studies examining celebrity-endorsed advertisements, few have studied the relationship between race and ethnicity and body types found in celebrity-endorsed advertisements. A sample of 265 celebrity-endorsed advertisements was collected from both Cosmopolitan and ELLE magazine during the first quarter of the year (January, February, March) between 2008-2013. A content analysis was constructed in order to determine the race and ethnicity of each celebrity found in the advertisement as well as their body type. The results suggest that there has been a tendency to use non-minority celebrities in celebrity-endorsed advertisements than non-minority celebrities. Furthermore, the findings demonstrate …

This study utilized a consumer marketing approach to investigate National Collegiate Athletic Association (NCAA) head coaches' preferences for a mental training mobile application (mobile map) using a conjoint market analysis. Head coaches' preferences for a mental training mobile app were compared based on price, ability to track athlete use of the app, recommendation sources, the inclusion of daily functions, coaches' awareness of the app being used by other teams, and the credibility of the mobile app content creators. Price and tracking athlete use were the two most important characteristics to coaches. Considering all characteristics, coaches preferred mobile apps that cost …
Development Of A Mechanical Vapor-Compression Distiller Incorporating Concentrated Solar Power, Garrett Tyler Rinker
Development Of A Mechanical Vapor-Compression Distiller Incorporating Concentrated Solar Power, Garrett Tyler Rinker
Graduate Theses, Dissertations, and Problem Reports (ETD)
The demand for a reliable energy supply has promoted the development of the Marcellus Shale gas industry in the past few years. However, the produced water from hydraulic fracturing (also known as fracking) poses a hazard to human and environmental health because of its dissolved solid, hydrocarbon, and heavy metal content. This research proposes to develop a portable solar power assisted water distiller which can process produced water on-site for natural gas wells.;The distillation technology developed is a small scale mechanical vapor-compression (MVC) distillation unit. The thermal energy for the evaporation of the water is provided by the solar energy, …
Extent Of Hydraulic Fractures In A Multilayered Geologic Media, Carter L. Hulcher
Extent Of Hydraulic Fractures In A Multilayered Geologic Media, Carter L. Hulcher
Graduate Theses, Dissertations, and Problem Reports (ETD)
In this report, the vertical extent of hydraulic fractures in a layered geological formation was investigated. In reality, the geology of the earth is heterogeneous, and therefore fracture growth will be significantly different. Fracture growth was simulated by using numerical models with relevant geomechanical, fluid flow and proppant transport properties. Results show the horizontal stress gradient plays an important role in fracture propagation. Lower horizontal stress contrasts between layers allow for greater fracture propagation in the vertical direction. Higher fluid viscosities tend to increase the fracture height and width, while decreasing the fracture length. Several other geomechanical properties such as …
The Development Of An Insect Succession Model Suitable For Time-Since-Death Statistics, Anne E. Perez
The Development Of An Insect Succession Model Suitable For Time-Since-Death Statistics, Anne E. Perez
Graduate Theses, Dissertations, and Problem Reports (ETD)
For academic carrion insect succession studies to be applicable to forensic casework, the study must provide statistically defensible postmortem interval (PMI) estimates. Multiple statistical approaches have been used to describe insect succession, but no study to date has been able to determine a confidence interval about a succession based PMI estimate. The ability to reject PMI values, and thereby create a confidence interval is determined by statistical power, of which sample size is a positive correlate. A proposed model established prospective sample sizes for desired levels of statistical power, indicating a target sample size of ~50 carcasses for estimating PMI …

Scholarly Articles in Law Reviews & Journals
Over a dozen years later, the AUMF — which has never been amended — remains the principal source of the U.S. government’s domestic legal authority to use military force against al Qaeda and its associates, both on the battlefields of Afghanistan and far beyond. But even as the statutory framework has remained unchanged, the facts on the ground have evolved dramatically, leading some to call for a new AUMF. In short, calls for a new framework statute to replace the AUMF are unnecessary, provocative, and counterproductive; they perpetuate war at a time when we should be seeking to end it. …
Patent Dialogue, Jonas Anderson
Patent Dialogue, Jonas Anderson
Scholarly Articles in Law Reviews & Journals
This Article examines the unique dialogic relationship that exists between the Supreme Court and Congress concerning patent law. In most areas of the law, Congress and the Supreme Court engage directly with each other to craft legal rules. When it comes to patent law, however, Congress and the Court often interact via an intermediary institution: the U.S. Court of Appeals for the Federal Circuit. In patent law, dialogue often begins when Congress or the Supreme Court acts as a dialogic catalyst, signaling reform priorities to which the Federal Circuit often responds.
Appreciating the unique nature of patent dialogue has important …

Translation Techniques In Voiced-Over Multilingual Feature Movies, Katarzyna Sepielak
Sociology Faculty Publications
This paper maps out the use of translation techniques used for multilingual interactions in voiced-over movies. First, the present study aims to determine how multilingual elements are introduced into the films and what implications these elements carry. Secondly, qualitative analysis is used in view of showing which particular translation techniques are employed to transfer multilingual elements in voiced-over translation. Four multilingual movies available with Polish voiced-over soundtrack on DVD were selected: Vicky Cristina Barcelona (directed by Woody Allen, 2008), Nine (Rob Marshall, 2009), Avatar (James Cameron, 2009), and Inglourious Basterds (Quentin Tarantino, 2009). The analysis enabled us to distinguish a …

Division I College Student-Athlete Career Situation And Attitudes Toward Career Counseling, Adrian J. Ferrera
Graduate Theses, Dissertations, and Problem Reports (ETD)
Few student-athletes advance to the professional level following their collegiate athletic career, leaving many to pursue alternative career paths. Although much attention has been dedicated to student-athlete academic progress and graduation rates, little attention has been given to student-athlete career development and their attitudes toward career counseling. Since the career development of student-athletes is complex and is affected by several variables, the purposes of the present study were threefold: 1) determine the career situation of male and female student-athletes attending an NCAA Division I university, 2) determine if differences existed between student-athletes and non-athlete students in their attitudes toward career …
Aquaponic Production Of Lettuce (Lactuca Sativa L.) Using Effluent From A Cold Water Flow-Through Aquaculture System, Gaylynn Elise Johnson
Aquaponic Production Of Lettuce (Lactuca Sativa L.) Using Effluent From A Cold Water Flow-Through Aquaculture System, Gaylynn Elise Johnson
Graduate Theses, Dissertations, and Problem Reports (ETD)
Aquaponics is the integration of aquaculture (the rearing of fish) and hydroponics (the conventional method of soilless farming). Effluent produced from the production of fish can be utilized as a source of nutrients by plants for growth in a hydroponic subsystem. Lettuce (Lactuca sativa) is an economically important vegetable crop that can be grown aquaponically. However, the suitability of lettuce for production in cold water flow-through systems (FTSs) is poorly described. The purpose of this study was to evaluate the growth, market rating, and nutrient uptake of lettuce grown in a cold water FTS. Three objectives were established to examine …

The Political Economy Of Pork-Barrel Spending, J. Zachary Klingensmith
Graduate Theses, Dissertations, and Problem Reports (ETD)
This dissertation consists of five papers which examine the impact pork-barrel spending has on legislative decision-making. In chapter 1, I introduce the theory behind pork-barrel spending, legislative coalitions and other similar topics. In chapter 2, I determine if pork-barrel spending has any impact on state employment levels. I use both a spatial and non-spatial modeling methodology to answer the question. Chapter 3 examines the relationship between the amount of pork-barrel spending appropriated by the Senator and the amount of money the Senator is able to fundraise. Chapter 4 integrates the results from chapter 3 to develop two-stage and three-stage models …
Understanding The Rural Built Environment From The Perspectives Of Parents Of Preschool-Aged Children, Brandy Lynn Buro
Understanding The Rural Built Environment From The Perspectives Of Parents Of Preschool-Aged Children, Brandy Lynn Buro
Health Nutrition and Exercise Science
Obesity prevention interventions targeting the built environment are an emerging area of research, but few studies have been applied in rural communities or among preschool-aged children, despite being high-priority populations. This study aimed to identify barriers to accessing nutritious foods and physical activity opportunities from the perspectives of parents of preschoolers living in low-income, rural communities. A mixed methods study design guided by a social ecological model incorporated quantitative surveys and qualitative interviews to gain a comprehensive understanding of the rural built environment. Results indicate proximity to recreation spaces, traffic safety, availability of public indoor space, and the consumer food …

Dynamic Pricing In Supply Chains Bringing The Perishable Approach To Dynamic Car Market, Prateek Tripathi
Industrial and Manufacturing Engineering
In a business environment, using dynamic pricing is a standard practice, especially in the management of revenue. Given the availability of online information concerning inventory and pricing, customers are in a position to understand pricing strategies that sellers employ, and at the same time to be able to develop a possible response strategy. In this thesis, Dynamic Pricing in the Supply Chain: Bringing the Perishable Approach to Dynamic Car Market is investigated and evaluated. This study incorporates strategic consumer response to dynamic prices, particularly for perishable goods, using a number of variables, such as income, demand and price. The main …

Estimating A Path Through A Map Of Decision Making, W. A. Brock, R. A. Bentley, Michael J. O'Brien, C. S. Caiado
History Faculty Publications (Archived)
Studies of the evolution of collective behavior consider the payoffs of individual versus social learning. We have previously proposed that the relative magnitude of social versus individual learning could be compared against the transparency of payoff, also known as the "transparency" of the decision, through a heuristic, two-dimensional map. Moving from west to east, the estimated strength of social influence increases. As the decision maker proceeds from south to north, transparency of choice increases, and it becomes easier to identify the best choice itself and/or the best social role model from whom to learn (depending on position on east-west axis). …

Phylogenetic Analysis Shows That Neolithic Slate Plaques From The Southwestern Iberian Peninsula Are Not Genealogical Recording Systems, R. D. García, Michael J. O'Brien
History Faculty Publications (Archived)
Prehistoric material culture proposed to be symbolic in nature has been the object of considerable archaeological work from diverse theoretical perspectives, yet rarely are methodological tools used to test the interpretations. The lack of testing is often justified by invoking the opinion that the slippery nature of past human symbolism cannot easily be tackled by the scientific method. One such case, from the southwestern Iberian Peninsula, involves engraved stone plaques from megalithic funerary monuments dating ca. 3,500-2,750 B.C. (calibrated age). One widely accepted proposal is that the plaques are ancient mnemonic devices that record genealogies. The analysis reported here demonstrates …

Measuring Capability For Healthy Diet And Physical Activity, Robert L. Ferrer, Inez Cruz, Sandra Burge, Bryan Bayles, Martha Castilla
Public Health (Archived)
PURPOSE Patterns of diet and physical activity, major drivers of morbidity and mortality, are contingent on people’s feasible opportunities to pursue healthy behaviors. Our objective for this mixed methods study was to develop measures of feasible opportunities for diet and activity.
METHODS The Capability Approach framework for evaluating people’s real freedoms to pursue their values guided the research. A community-based participatory model was applied to conduct focus groups of adults with obesity or diabetes mellitus from an economically disadvantaged Latino community. Focus group themes were developed into survey items that assess how individual circumstances and neighborhood contexts influence opportunities for …

Toward An Understanding Of Preference For Agile Software Development Methods From A Personality Theory Perspective, Dave Bishop, Amit Deokar
Research & Publications
This paper presents the results of an exploratory research study that investigates factors contributing to preference for the agile software development approaches. The initial exploration revolves around the Five Factor Model of personality and the premise that these personality factors provide a partial explanation of preference for an agile approach. A survey instrument for measuring the preference for agile methods was developed and validated. The results from the quantitative data collected from the survey study indicate that three out of the five personality factors from the Five Factor Model show a correlation with above average preference for agile methods. These …

Do We Have Zero Privacy In Transportation? An Exploratory Study Of Video Surveillance Systems, Michael Latta
AMTP Proceedings 2014
The extent of and ethics of video surveillance has moved the conversation about privacy and surveillance from the internet to the camera, from home to transportation systems, and from static to real time marketing analytics. The issue of privacy and surveillance is international in scope for transportation surveillance, since, like the internet, transportation knows no borders and there are no limits on transportation types where surveillance of the public can be done routinely. The extent of surveillance systems worldwide is not well documented. This exploratory study seeks to document the extent of surveillance video camera systems around the world used …
