Sex Differences In The Relationship Between Sensation Seeking, Trait Emotional Intelligence And Delinquent Behaviour, Alison M. Bacon, Hannah Burak, James Rann

Levels of sensation seeking peak in adolescence and there is a well-documented association of sensation seeking with delinquency and other risk-taking behaviours. The present study investigated the potential moderating effect of trait emotional intelligence (trait EI) on this relationship. Trait EI encompasses high levels of empathy and emotion regulation and is associated with positive outcomes and well-being. Ninety-six young adults (48 females and 48 males; overall Mage = 19.76) completed measures of sensation seeking, trait EI and self-reported delinquent behaviours (DB) since age 12. Results indicated that sensation seeking and frequency of DB were positively associated, but this effect …

This article surveys recent significant developments in Virginia civil practice and procedure. Part I of this article discusses opinions of the Supreme Court of Virginia from June 2013 through June 2014 addressing noteworthy civil procedure topics. Part II addresses amendments to the Rules of the Supreme Court of Virginia concerning procedural issues during the same period. PartIII discusses legislation enacted by the Virginia General Assembly during its 2014 session that relates to civil practice.

Prosecutorial discretion is a critical part of the administration of immigration law. This Article considers the work and responsibilities of the Immigration and Customs Enforcement (ICE) trial attorneys, who thus far have not attracted significant scholarly attention, despite playing a large role in the ground-level implementation of immigration law and policy. The Article makes three main contributions. First, I consider whether ICE attorneys have a duty to help ensure that the removal system achieves justice, rather than indiscriminately seek removal in every case and by any means necessary. Strange Bedfellows: The Federal Constitution, Out-Of-State Nongrantor Accumulation Trusts, And The Complete Avoidance Of State Income Taxation, Jeffrey Schoenblum

With the maximum rate of federal income tax at 39.6 percent, the Medicare surtax on investment income of 3.8 percent, and some state income tax rates exceeding 9 percent, taxpayers in the highest brackets have been seeking to develop strategies to lessen the tax burden. One strategy that has been receiving increased attention is the use of a highly specialized trust known as the NING, a Nevada incomplete gift nongrantor trust, which eliminates state income taxation of investment income altogether without generating additional federal income or transfer taxes. Freedom of expression has a complex and dynamic relationship with a number of other constitutional rights, including abortion, the right to bear arms, equal protection, the franchise, and religious liberty. This Article discusses one aspect of that relationship. It critically analyzes the regulation of "rights speech" - communications about or concerning the recognition, scope, or exercise of constitutional rights. As illustrative examples, the Article focuses on regulation of speech about abortion and the Second Amendment right to bear arms. Many states passed legislation in the 1990s to address the problem of violent sex offenders. While academic inquiries into the nature and extent of sexual offending have revealed some interesting findings, very little is known regarding how communities address the issue of managing violent sex offenders. This account documents how the state of Wisconsin attempted to manage violent sex offenders once released from prison and civilly committed under a sexually violent person statute. It chronicles the experience of a committee charged with locating possible sites for a facility for sexual predators under supervised release to the community. In addition, this …

The efficiency of cognitive radio networks mainly depends on the spectrum sensing stage, in which spectrum opportunities are exploited. However, one of the challenges facing spectrum sensing is the presence of fading and log-normal shadowing. Moreover, when the spectrum utilization is high and details regarding primary user activity are not available, a need to sense the whole spectrum arises. Hence, developing a wideband spectrum sensing technique is a fundamental concern.

California communities are increasingly grappling with whether to deploy new surveillance technologies ranging from drones to license plate readers to facial recognition. This is understandable, since public safety budgets are tight, technology vendors promise the ability to do more with less, and federal agencies or industry sponsors may even offer funding.

But surveillance can be both less effective and far more costly to local agencies and to the community at large than initially imagined, leaving communities saddled with long-term bills for surveillance that doesn't end up making the community safer. To this day, the law of charity is often thought of as a matter for the states. In fact, the crucial law relating to charity is now almost always federal. For certain purposes, state law still determines whether a given entity is "charitable." It also determines the propriety of a charitable fiduciary's conduct when someone who has standing sues. But federal law determines whether an entity qualifies for various tax incentives, such as exemption from the federal income tax and eligibility to receive tax-deductible gifts, and qualification for these incentives generally determines whether the entity comes into existence and, if …

Florida law is currently unclear on the issue of whether a professional may rely upon a limitation of liability clause in a professional services contract. Limitation of liability clauses are common in business contracts, especially in construction, a field that includes many professionals such as engineers and architects. While Florida has historically enforced limitation of liability clauses in professional services contracts, recent cases have cast doubt on whether the clauses are enforceable.
