The purpose of this study is to explore the way(s) in which the disproportionate return of ex-prisoners to socially and economically disadvantaged communities impact(s) specific community structural factors identified in the study. After three decades of withstanding the enduring effects of the mass incarceration, communities stand at the edge of a new era. Economic realities, and the failure of policies designed to deter crime through imprisonment are rapidly ushering in an era of mass prisoner reentry. Inadequate prison health care has created a health crisis for reentering prisoners and their communities--a crisis that is exacerbated by barriers to employment and other collateral consequences of release. This Note will first examine how current Eighth Amendment doctrine has failed to sufficiently regulate prison health care so as to have any significant effect on the crisis. Next, it will argue that the Affordable Care Act (ACA) alters the Eighth Amendment analysis by triggering a change in the "evolving standards of decency" that guide the doctrine. Local land use laws offer powerful tools for climate change adaptation and mitigation. However, notwithstanding New York municipalities’ many impressive efforts, local laws are not yet being utilized sufficiently to create disaster-resilient or disaster-adaptive communities. New York City has done substantially more than many other cities, including, critically, setting specific CO2 emissions reduction targets and amending zoning and building codes. But, in light of the evidence of climate change and its impacts, local decision makers, resource managers, and planners throughout the state must ask whether we are doing enough. In the past, land use ethics inquiries predominately involved conflicts of interest or an official holding public office while engaging in a previously held business or law practice. Now, prosecutors are looking at the underlying criminality of the unethical acts carried out in the context of land use decisions. With a wide array of criminal statutes in the hands of federal prosecutors, almost all forms of unethical conduct could in some way also violate a federal criminal statute.
Part II of this article reviews the federal statutes most often used by federal prosecutors and provides some examples of recent reported …

In the digital age, every part of federal government has critical cybersecurity interests. Many of those issues are brought into sharp focus by Edward Snowden's disclosure of sensitive government cyber intelligence programs conducted by the National Security Agency, the Federal Bureau of Investigation, and the Central Intelligence Agency. Courts are reviewing various constitutional and statutory challenges to those programs, two government review groups have reported on related legal and policy issues, and Congress is considering cyber intelligence reform proposals. Amid the 2014 FIFA World Cup and the 2016 Olympic Games, strategic policy reforms at the federal, state, and municipal levels have reordered and re-purposed the social space of Rio’s favelas through the implementation of social and physical infrastructure. This research project contributes a geographical perspective to the ways in which fast-paced urbanization transforms and produces social space in Rio’s oldest favela, Morro da Providência. Based on Henri Lefebvre’s conceptual triad concerning the production of social space, this research uses mental mapping to understand the disparity between representations of conceived space and representational lived space. The identification of congestion hot spots plays an important role in congestion monitoring of highway and arterial systems. Traditionally, vehicle detection systems or probe vehicles are used to measure travel time and identify congestion hot spots. This approach is time-consuming and resource intensive. With the advent of new technologies like crowdsourcing, travel time can be collected more cost-effectively using fewer resources. The research presented in this paper develops a new methodology to identify congestion hot spots in an urban area using freely available historical speed data gathered by Google and published as a traffic layer in Google maps. The federal government has expressed fear that immigrants abuse the appellate process to delay their deportations by filing meritless petitions for review with the federal courts. Some courts have responded to these concerns by imposing stricter standards for issuing stays of removal, so that the government can more easily deport petitioners even while their appeals remain pending. The risk with this approach is that immigrants who ultimately prevail may be erroneously deported. What is often overlooked is that the potential for abuse is really a function of time, with longer appeals posing a greater threat to immigration enforcement. This study …

In the last 30 years, the number of women in the criminal justice system has risen significantly, yet the criminal justice system still bases much of its policy on empirical research conducted on a majority male subjects. Risk and need assessments, generally used to categorize inmates into varying risk levels to lower recidivism, have been faulted by many feminist scholars for having little pertinence for women. Their lack of gender sensitive factors has left many scholars questioning their validity.
