Prison Health Care After The Affordable Care Act: Envisioning An End To The Policy Of Neglect, Evelyn Malavé

Inadequate prison health care has created a health crisis for reentering prisoners and their communities—a crisis that is exacerbated by barriers to employment and other collateral consequences of release. This Note will first examine how current Eighth Amendment doctrine has failed to sufficiently regulate prison health care so as to have any significant effect on the crisis. Next, it will argue that the Affordable Care Act (ACA) alters the Eighth Amendment analysis by triggering a change in the “evolving standards of decency” that guide the doctrine. Restorative justice seeks to bring together stakeholders in the justice system by acknowledging harm caused by offending behavior and finding ways to repair that harm. The activities associated with restorative justice create the potential for meaningful and positive outcomes for all stakeholders within the system. Restorative justice asks, what is the harm?, who are the stakeholders?, and, how can the harm best be repaired? In the last decade, dozens of local governments have enacted zoning ordinances designed to limit the concentration of payday lenders and other alternative financial services providers (AFSPs), such as check-cashing businesses and auto title loan shops, in their communities. The main impetus for these ordinances is to shield economically vulnerable residents from the industry’s lending practices in the absence of sufficiently aggressive federal and state consumer protection regulation. This Essay casts considerable doubt on whether zoning is the appropriate regulatory tool to achieve the consumer protection and welfare goals animating these ordinances. As our climate changes, the occurrence of extreme weather events and heavier rainfall becomes more common. This change in weather patterns and precipitation results in a greater number of recorded flood events and a larger magnitude of flood events. Canadian municipalities are therefore facing a pressing demand to perform hazard assessments to identify communities at risk and measure potential economic and societal losses due to flood events. Federal Emergency Management Agency (FEMA) developed a standardized tool, Hazus-MH, for loss estimation from natural disasters for use in the US. Recently, Hazus has been adapted for use in Canada. From 2010 through 2013, an average of 90 firefighters died in the line of duty each year (USFA, 2014). Firefighters who are off-duty continue to die as well, however, it is extremely difficult to determine whether their deaths are a result of on-duty-related exposures or not. Medical and field research has consistently found associations between smoke inhalation and acute and chronic illnesses that highlight the dangers of on-duty exposure to smoke. This study investigates the early removal of the SCBA by firefighters in one fire department while operating at fire incidents. The findings indicate that firefighters are mostly aware of …

Because the city of Boston rests along the Atlantic coast and is highly vulnerable to flooding from hurricanes, local emergency planners have considered utilizing phased evacuation and contraflow strategies as a means to more effectively evacuate. This research attempted to determine whether phased evacuation or contraflow are suitable evacuation strategies that can be incorporated into Boston's evacuation plan in order to increase the evacuation rate and reduce motor vehicle congestion.

The paramedic profession is an inherently difficult, dangerous and stressful profession. The paramedic is constantly barraged with acute stressors during the performance of his duties. These stressors have predictable, documented, negative effects on performance. The acute and chronic exposure to stress can negatively impact the safety and the well being of the paramedic. These stressors, if not successfully managed, can also result in negative effects to patients. Despite the overwhelming presence of stress in the paramedic environment, most paramedics receive little or no training to successfully perform under stress. Research is lacking on rural and small-town policing in the post 9/11 era. This is unfortunate in view of changing perceptions of threat and insecurity, the financial crisis of 2008 and curtailments placed on funding for rural and small-town police agencies. This thesis argues that the proliferation of homeland security resources and priorities has significantly shaped rural and small-town policing in recent years. Rural and small-town law enforcement agencies, often lagging behind in resources and funding as compared to their urban counterparts, have embraced homeland security agendas, priorities and technologies as a means of securing their financial goals and abilities. …

In 2009, Belgium and the Netherlands announced a deal to send approximately 500 Belgian inmates to Dutch prisons, in exchange for an annual payment of £26 million. The arrangement was unprecedented, but justified as beneficial to both nations: Belgium had too many prisoners and not enough prisons, whereas the Netherlands had too many prisons and not enough prisoners. The deal has yet to be replicated, nor has it triggered sustained criticism or received significant scholarly treatment. This Article aims to fill this void by examining the exchange and its possible implications for a global market in prisoners and prison space. …

Twelve years after the September 11th attacks, countering domestic terrorism remains a top priority for federal law enforcement agencies. Using a variety of reactive and preventive tactics, law enforcement seeks to stop terrorism before it occurs. Towards that end, community policing, developed in the 1990s to combat violent crime in inner city communities, is being adopted as a means of collaborating with Muslim communities and local police to combat "Islamist homegrown terrorism." In the Dred Scott case, Justice Taney remarked that black people “had no rights which the white man was bound to respect.” In The Far-Reaching Shadow Cast by Ferguson, Professor Norwood questions whether, in today’s society, Justice Taney’s sentiment still holds true. Citing examples of recent police shootings and beatings of unarmed African-Americans and personal and family experiences, Professor Norwood argues that our country is broken and needs fixing. One of the most common criticisms of the Foreign Intelligence Surveillance Court is that the court has approved more than 99% of the government’s 33,000 ex parte surveillance requests, a fact cited as extraordinary evidence that the court is nothing more than a rubber stamp. This Essay disputes that popular criticism in two ways. This report presents the findings of numerical modeling analyses on rock cut slopes sites in Hardy County (U.S. Route 48) and Raleigh County (U.S. Route 121), West Virginia, and investigates the feasibility of design alternation in lieu of current cut slope practices performed by West Virginia Department of Highways. The process of natural gas recovery by horizontal drilling and hydraulic fracturing, known as fracking, is a major scientific advance in unconventional energy development. Attention has largely been focused on its economic advantages and potential negative environmental repercussions, while less consideration given to its social dimensions. The purpose of this study was to explore the social consequences of fracking for communities in the Appalachian Basin's Marcellus shale.
